Ms. Zinger did not ensure that all staff provided appropriate care and su ervision of children at all times. On 03/01/2021, Child A had pants pulled down and Child B ii ) was touching area. This incident -oycecaur-rorledd,W uring snack time and Ms. Zinger and Ms. Munro were sitting at tables with the children. There was a bookshelf blocking Child A and B from view of child care staff members. Ms. Zinger and Ms. Munro were not providing appropriate care and supervision.
' On 03/01/2021, Child A -year-old& )wassab er ed with stets pulled down, and Gild B -year-old, was touching area. INVESTIGATION On 03/05/2021, I completed an onsite inspection. I interviewed child care staff member Ms. Andrea Dennis, Ms. Dennis stated that program director Ms. Laura Zinger and child care staff member lbs. Kathryn Munro were in the classroom when this incident occurred. Ms. Dennis had taken another child to the bathroom. When she returned to the classroom, she saw Child A and Child B by the table in a corner of the room that is located at the front of the classroom. This area is located on the opposite side of the room from the entrance to the classroom. Child B was on ® knees withy pants and idled down past hottorn. Child A was up against the wall with hand of Child Bs by This happened during snack time, leis. finger was sifting a table with a group of children toward the back of the room. Its. Munro had been preparing and serving snack and was located in the front of the room by the sink. Child A and B were located to the right of her. lbs. Munro was not aware that this was going on. Ms. Zinger told Ms. Dennis that she last observed Child A and B sitting underneath the table whispering. Earlier in the day, Ms. Dennis noticed that Child A and B were pushing furniture around in the play kitchen area. Child A and B were standing behind a shelf that they had moved. When she asked what they were doing, they stated that they were taking a bath. lbs. Dennis told them that they do not take baths at school and they were not to rearrange furniture. Ms. Zinger and Ms. Munro were not present at the time of this onsite inspection. On 04102/2021, 1 interviewed program director Ms. Laura Zinger. Ms. Zinger reported that she noticed that Child A and Child B were sitting underneath the table whispering while she was preparing snack. She knew that they were up to something but felt that the behavior would be destructive in nature. Neither Child A nor Child B have ever displayed inappropriate touching behaviors. They do have and have displayed destructive and aggressive behaviors. While Zinger was preparing snack, Ms. Munro was working on puzzles with a group of children and Ms. Dennis had taken some of the children to the bathroom. When snack was served, Ms.. Zinger suggested that Child A and Child B join the group for snack, but they chose not to do that. lbs. Zinger was shocked when Ms. Dennis told her what she observed when she walked back into the classroom. At that time, Ms. Zinger was sitting with at a table with a group of children while they were eating snack. She did not observe this incident. She believes this incident must have happened very quickly to have happened without her seeing it. As a result of this incident, some of the furniture in the room has been rearranged so that there are no blind spots in the room. Child care staff members are shadowing Child A and Child B to ensure that an incident like this does not happen again. During my onsite inspection, I observed the setup of the classroom. At the front of the classroom there is a refrigerator, counter top space, and handwashing sink. To the left of the refrigerator there is a small table with two chairs located in the corner. The entrance to the classroom is on the right-hand side of the room. There is a larger table located directly in front of the counter top/handwashing sink. There were two bookshelves placed back-to-back that are in front of the table. Behind the bookshelves there are two more larger table. Children were sitting at these tables for their snack. Ms. Zinger was sitting at one of those tables. The way that the room is set up, she would not have had direct sight of Child A and B without standing up. On 04/02/21, Child B's Mother stated that she was not aware that this incident occurred and she does not recall Ms. Zinger talking to her about the incident. Ms. Zinger has talked to her in the past about Child B's behaviors in the class, but
