    R 400.8158 · R 400.8158 Incident, accident, injury, illness, death, fire reporting. (3) A licensee, licensee designee, or program director shall report to the department, via phone, fax, or email, within 24 hours of notification by a parent that a child received medical treatment or was hospitalized for an injury, accident, or medical condition that occurred while the child was in care.

    On 6/27/22, the complainant said that child care staff member 1 told her she had some concerns about an incident that took place at the center on 6/22/22. Child care staff member 1 told her that when she was working on the playground that day, she found Child A and Child B behind the shed with their pants down and they had said they touched each other. Child care staff member 1 also told her she was concerned because once there was an ambulance at the center. On 6/30/22, I visited the center and spoke to licensee and program director Dawn Lynch. Ms. Lynch said she was inside cleaning and child care staff members 1, 2 and 3 were on the playground with the children. Child care staff member 1 and child care staff member 2 had 13 children at 4:30pm and the youngest in their group was 3 years of age. Child care staff member 3 had three toddlers ages 30 months and under. The toddler area of the playground is separate from where the older children play. Child care staff member 2 came in and told her that child care staff member 1 said she saw Child A and Child B with their pants down "peeing" behind the shed. Nothing was mentioned about Child A and Child B touching each other. Ms. Lynch said a few other times at the center children have gone "pee" outside. When children come back from camping with their families, they think it is all right to "pee" outside. Ms. Lynch went outside and took Child A and Child B in with her and talked to them, explaining that the only place they can go to the bathroom is inside the center. On 7/7/22, child and staff attendance records were reviewed and the center was in ratio. Child care staff member 2 was supposed to leave earlier but stayed until child care staff member 1 had the right number of children to be alone. On 7/20/22, child care staff member 1 said that she had about 20 children by herself outside for about 10 minutes. Child care staff member 2 had been working with her but was in and out of the center, bringing children in to use the bathroom once in a while or to get their diaper changed by Ms. Lynch. Child care staff member 1 said the children know they are not supposed to play behind the shed. When she noticed Child A and Child B with their pants down she went over to them and asked them if they were doing something inappropriate and if they were touching each other. Child A said "Child B touched me once and I touched him back". Child care staff member 1 asked child care 3 staff member 2 to go get Ms. Lynch and tell her what happened. Child care staff member 1 said once an ambulance was at the center but that she did not know if that was related to licensing. On 7/20/22, child care staff member 3 confirmed that she had three children under 30 months on the day of the incident. She did not see what took place because her area of the playground was in a different location. She thought child care staff member 1 was alone for about ten minutes but she wasn't sure. Ms. Lynch and child care staff member 2 had been working with her but were both in and out. On 7/20/22, child care staff member 2 said that she had been working on the playground with child care staff member 1. When a child needed to go in for a diaper change, she sent them in to Ms. Lynch. She would then wait by the door with the door open, watching the children playing outside and watching for the child getting their diaper change to come back out at the same time.
