On November 19, 2021, I opened an investigation after I received an incident report from licensee designee, Shani Webb, stating that Child A was inappropriately disciplined while in the classroom by child care staff member Terena Ray. There were no marks or bruises found on Child A. Ms. Ray's employment was terminated after it was verified through the center's classroom video surveillance footage where Ms. Ray physically disciplined Child A. On November 23, 2021, I conducted an unannounced onsite inspection. I arrived at 1:20 p.m. I observed the toddler room where Child A was present and comfortable with child care staff member Makayla Whiting. Ms. Whiting verified that child care staff member Ms. Ray is no longer working at the center. On November 23, 2021, I interviewed licensee designee, Shani Webb. Ms. Webb stated that at the end of the day on November 12, 2021, Child A had reported to his mother that his teacher Ms. Ray had pushed him while they were in the classroom that day. Child A's Mother then immediately reported it to the center and upon receiving that information the toddler classroom video footage was reviewed. The video footage from November 12, 2021 did show that Child A had an accident and wet his pants on the carpet. Ms. Ray had then asked Child A to come towards her and that is when it was observed that she thumped him on his forehead three to four times. There were no marks or bruises observed on Child A according to Child A's Mother. Ms. Ray was the only child care staff member present in the classroom at the time of the incident. Ms. Webb expressed that she met with child care staff member Ms. Ray on November 15, 2021 and discussed the incident with her, however, Ms. Ray denied that she physically disciplined Child A. The classroom video footage was shown to Ms. Ray and she still did not acknowledge that she physically disciplined Child A. It was explained to Ms. Ray that she had violated the center's policy regarding inappropriately disciplining a child while in her care and she was terminated from her employment with the center. Ms. Webb explained that she has never witnessed Ms. Ray to have inappropriately disciplined children in care in the past, however, one time was enough for grounds of termination. Child A's Mother was informed of the actions taken with child staff member Ms. Ray and informed the other toddler room parents that their teacher would no longer be working at the center. In addition, video footage history from the classroom with Ms. Ray was viewed and there were no other incidents. During the onsite inspection, I was able to view the toddler classroom video footage dated November 12, 2021 from 10:27 a.m. to 11:30 a.m. with child care staff 3 member Ms. Ray and Child A. At approximately 10:30 a.m. Child A is seen with other children at the classroom carpet and stood up for a second to approach child care staff member Ms. Ray who was sitting down on the carpet. When Child A approached Ms. Ray, Ms. Ray used her fingers and thumped him three times on his forehead. Child A was observed to be startled by this action and put his right hand on his forehead, and Ms. Ray proceeded to thump him on the forehead a fourth time. Child A was visibly upset as he then placed both his hands on his forehead as he was asked to then stand in front of the classroom door. Ms. Ray was getting the rest of the children lined up to utilize the center's bathroom. Ms. Ray was then observed shifting Child A in an aggressive manner to make room for the other children lining up at the classroom door. On January 14, 2022, I interviewed Child A's Mother. Child A's Mother expressed that Child A is still attending the center and she knows that Ms. Webb cares for the safety and wellbeing of her child and those that attend Infinite Learning Center. On November 12, 2021, child care staff member Terena Ray was observed to utilize disposable gloves while changing a child in the toddler room and failed to dispose of the gloves after the diaper change. Ms. Ray continued to wear the disposable gloves for another twenty minutes as she navigated throughout the classroom before they were discarded.
