    R 400.1913 · R 400.1913 Discipline; child handling. (3) Personnel shall not do any of the following: (a) Hit, spank, shake, bite, pinch, or inflict other forms of corporal punishment.

    On December 22, 2021, I initiated my investigation by interviewing Child A's Mother. Child A's Mother expressed that Child A was enrolled in Ms. Kalinin's child care family home from October to mid December 2021. On December 10, 2021, Child A reported after returning home that he was smacked in the mouth and put in time out by Ms. Kalinin because his baby sister was crying all day. Ms. Kalinin also yells and screams at the children all day. There were no marks or bruises observed on Child A, however, he did not want to attend Ms. Kalinin's child care after that alleged incident. Child A demonstrated how Ms. Kalinin smacked him on the mouth and he consistently repeated the same story. Child A struggles immensely with attention deficit hyperactivity disorder. Child A is also deaf in his left ear and partially deaf in the other ear. Child A wears hearing aids and can sign as well as verbalize. There were no communication issues with Ms. Kalinin and she was able to communicate with Child A with no problems. The incident that occurred was never brought up to Ms. Kalinin, however, there were other children attending on December 10, 2021. Child A no longer attends child care with Ms. Kalinin. On January 4, 2022, I conducted an unannounced onsite inspection. I arrived at 12:40 p.m. where Ms. Kalinin and six children in care were present in the home. Ms. Kalinin denied that she used any form of physical discipline on Child A and expressed that she never screams at the children. Child A was enrolled from the end of September until December 17, 2021. Child A's Mother never addressed a concern regarding inappropriate discipline with Child A. Child A did struggle with behavior issues related to his attention deficit hyperactivity disorder and would regularly cry and be irritable because it was believed that he was starting to show signs of being allergic to dogs. Child A's Mother was informed of these concerns, and it was requested that she get Child A tested to see if allergies were an issue that needed to be treated. However, Child A's Mother refused and stated that Child A would eventually get over the possible dog allergies. Child A was also deaf in one ear and wore hearing aids, but there were no issues with communication. For the most part Child A did well, however, he struggled with transitions like when he would first come to the home—he would run away from his mother or uncle and they would have to chase him. Ms. Kalinin has never physically disciplined a child in her care and always follows her discipline policy where she will assist the child by redirecting them and giving them a break on the coach where she will talk to the children about the situation. There were no specific incidents on December 10, 2021 that could be recalled, and there were other children in care on that day. I was able to review Ms. Kalinin's attendance record for the children on December 10, 2021, and there were three other children in attendance with Child A. 3 During the onsite inspection I was able to observe the interaction between Ms. Kalinin and the children in her care. The children were all comfortable and not fearful of Ms. Kalinin. There were no concerns of inappropriate discipline observed during the inspection. On January 24, 2022, I interviewed Child B's Mother. Child B's Mother expressed that she has never had any problems with Ms. Kalinin and the quality of care provided to her child. Child B has never come home with any marks or bruises and is never fearful of Ms. Kalinin. Child B is happy and very comfortable with Ms. Kalinin and there are no concerns. There were no unusual incidents witnessed or reported on December 10, 2021. On January 24, 2022, I interviewed Child C's Mother. Child C's Mother stated that she has never had any concerns regarding inappropriate discipline with Ms. Kalinin. Child C has never come home with any marks or bruises and is always comfortable with Ms. Kalinin. There were no unusual incidents witnessed or reported
