    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    E On 02/02/2023, I conducted an onsite inspection with where we interviewed child care staff members. On 02/02/2023, I interviewed Child Care Staff Member 1. Child Care Staff Member 1 stated that he is currently one of the lead child care staff members for the infant and toddler room. On 01/26/2023, Child Care Staff Member 1 was working in the infant room area and after naps and changing diapers, Child Care Staff Member 1 moved Child A and Child B into the toddler room area with Child Care Staff Member 2 to be in ratio with four children at about 2:15 p.m. Around 3:30 p.m. - 4:00 p.m. Child A was brought to the changing table to change diapers and Child Care Staff Member 1 could not locate her diapers in the area. Child Care Staff Member 3 came into the infant room to assist in locating Child A's diapers and upon finding the diapers she noticed at this time a scratch on Child A's forehead. Child Care Staff Member 3 inquired with both Child Care Staff Member 1 and Child Care Staff Member 2 how Child A received the scratch on her face, and neither Child Care Staff Member 1 nor Child Care Staff Member 2 knew how she got the scratch. There was also another scratch found on the back of Child A's ear. Program Director Addie Gearardo was informed and she immediately inquired with the child care staff members if they were aware how Child A received these scratches. At about 4:30 p.m. Child Care Staff Member 4 notified Child A's Mother to inform her that Child A received scratches but that they are currently investigating how it occurred while in care. Child Care Staff Member 1 explained that during the period that Child A was with him, Child A did not have any observed injuries until it was noticed around 3:30 p.m. on the changing table. It was later discovered when Child Care Staff Member 4 reviewed the video surveillance video that Child A was being chased by another toddler, Child B, in the toddler room and then pushed to the wall hitting her head. Child B was grabbing Child A's hair with Child Care Staff Member 2 present during this incident. Child Care Staff Member 2 was not aware of the incident while in her care because she was known to be on her phone a lot and was seen once falling asleep when the children were napping. The past concerns of Child Care Staff Member 2's lack of interest in being engaged with the children were addressed to Child Care Staff Member 2 by Child Care Staff Member 4 with the hope she would improve. Phone policy where personal phones are not permitted to be used during work shifts were communicated on the first day of hire for all staff. Upon pick up, Child A's Mother was understanding of the situation but upset that it had occurred. The safety plan established was to separate Child A and Child B so that they would not be in the same classroom. In addition, Child Care Staff Member 2 was immediately 3 terminated after it was discovered that Child A was injured while in her care the day of the incident. On 02/02/2023, I interviewed Child Care Staff Member 2. Child Care Staff Member 2 stated that she has been working at Brilliant Lil Mindz since October 2022 and has been an assistant child care staff member that floated where there was a need in the classrooms. On the day of the incident with Child A, Child Care Staff Member 2 started in the preschool room at about 8:40 a.m. After snack and lunch, the second to last preschooler was picked up by parents, and it was just one preschooler in the classroom. Child A and Child B were with Child Care Staff Member 1 in the infant room and after lunch, Child A, Child B, Child Care Staff Member 1's child--Child C, and another toddler were moved into the toddler room area for the remainder of the day with Child Care Staff Member 2. Once moved to the toddler room, Child B was observed trying to bite Child C's arm and Child B was redirected. It was explained to Child C that since he was older, to not engage in a physical manner with Child B. Child Care Staff Member 2 t
