On 4/10/2023, 1 interviewed Child A's Mother. She said that Child A's Grandmother told her that Child A was and said, uThis is where Child B Chi s Mother said a as never said anything to her before about . She feels that Child A is still in the process of developinQ his language but felt at he might tell her if someone . When Child A's Mother picks him up 2 from the center, he sometimes introduces her to his friends, but she has never met Child B. I interviewed Child A's Grandmother. On Wednesday, 41512023, Child B was on his iPad watching one of his shows. He started giggling so she looked over to see if he what he was giggling at. She kept hearing him say something about "the boys." She looked over at the show to see which characters were being shown and what he was watching. At the time he had She noticed and Child s Grandmother said, "What are you doing? Don't do that? She then asked him, Child A kept saying Child B's name. At this point Child A's Grandmotherthought Child B was an adult. She asked him, "When did you start getting this idea about' He kept saying Child B's name. She asked him to gild B She touched his stomach to try to get Child I and he kept touching his her said she saw Child A and when she said sometl Child 's Grandmother said that Child A was working with speech teachers at his previous school to help him express himself more clearly. Child A's Grandmother talked to Child Care Staff Member M 1 the next morning. She mentioned that she had some concerns about on, so they stepped out of the classroom. Child A's Grandmother *bnrieeyflyy shared with CCSM 1 that Child A said that Child B . CCSM I said that she was going to talk to Child B's parents. On 411012023, 1 conducted an unannounced onsite inspection. I interviewed Matt Beck, substitute program director. Mr. Beck has been employed with the center since November 2022. On 41612023, Mr. Beck received a text from CCSM 1 and went directly to the classroom to talk to her. CCSM 1 informed Mr. Beck of the accusation from Child A's Grandmother that Child A the night before and Child A said that is where Child B Beck is not aware of any incidents wafare nter and has not witnessed any Child A has a speech delay, and his language is very limited, so Mr. Beck was surprised when he heard that Child A said Child B - .. Child B is another child in the classroom. There have been several incidents when Child B gets Mr. Beck reported e incident o the YMCA Supervisor. R!RPS!~perviMor structed Mr. Beck to contact Megan Christensen, program director at the time. Ms. Christensen reported the incident to child care licensing. Mr. Beck and YMCA Supervisor contacted Mr. Beck confirmed that they did not contact the parents of Child B regarding the accusation. I interviewed CCSM 1, lead caregiver in Classroom I since January 2023. On Thursday, 416123, Child A was dropped off at the center for Before Care. Child A's Grandmother asked her who Child B was. CCSM 1 took Child A's Grandmother into the hallway to talk privately. CCSM 1 informed Child A's Grandmother that Child B 3 was another child in the classroom. Child A's Grandmother told he*she hou ht it was an adult in the classroom. She told CCSM 1 that Child A was and then said, This is where Child B Child A' asked CSM I to keep an eye on things in th"casslRoom. CCSM 1 informed her that she takes the accusation very seriously. CCSM 1 said there have been no reports of that have happened in CCSM 1's classroom before this. There are no private spaces and no times that children are alone. The classroom uses the children's bathrooms upstairs and child care staff members monitor the bathrooms when children are using them. Child A is I He has .... and — is a big pa o at. On 01/25/2023, I spoke with assigned child care licensing consultant, Karen Woodman. She said CCSM 1 had posted on Facebook that children eat food off the floor and people reacted to her post via comments, which turned into a large ordeal. On 01/25/2023, I received a screen shot of the Facebook post written by CCSM 1. The post states when children drop food onto the floor and the floor is clean, she tells children to eat off the floor. She then mentions imagine the children going home to tell their parents that CCSM 1 allows them to eat food off the floor. On 02/01/2023, I spoke with Child A's Mother. She said CCSM 2 and CCSM 1 are the child care staff members who work in this classroom. She said Child A has never mentioned anything about eating food off the classroom floor and she has never heard of this concern before. There are no cameras that parents have access to, so she is unable to view Child A throughout the day. She said she wouldn't be surprised if this were true, but she has never witnessed any children eating food off the floor and hasn't spoken to other parents about this. On 02/01/2023, child care licensing consultant, Karen Woodman and I made an unannounced visit to the center. Program director Laura Seyfarth was interviewed. She said CCSM 1 began working at the center sometime during the summer of 2022 and worked in the preschool classroom. Ms. Seyfarth has helped in this classroom and has never seen children eating food off the floor. Occasionally a child has accidently dropped food on the floor and ate it, but there isn't much that can be done when this happens. Children are not expected or encouraged to eat off the floor. She said she has never heard of anyone complaining about this happening in the classroom. CCSM 1 called her on 01/23/2023 to report she posted something on Facebook regarding the child care, but that she has since removed this post. She said an email was sent to all parents regarding the Facebook post about children eating food off the floor. She said CCSM 1 meant for her post to sound like the child care center is so clean children can eat off of the floor, but her words were poorly chosen. Prior to this, no parents, child care staff members or children ever mentioned concerns about children eating food off the floor. I interviewed Kimberly Vaughn, licensee designee. She said CCSM 1 posted on social media that the floors are so clean in her classroom, you could eat off them. 3 This post ended up going viral for two days. People were calling the center "disgusting." She said she has never seen children eating food off the floors and has never heard of anyone complaining that this was happening. I interviewed CCSM 2, lead preschool child care staff member. He said he primarily worked with CCSM 1. CCSM 1 has made comments that the floor is so clean, you could eat off it, but she never forced children to eat food off the floor as children do not eat food off the floor. Occasionally a child drops food on the floor and eats it quickly and CCSM 1 would comment that the floors are clean. CCSM 1 posted on Facebook that the floors are so clean you could eat off them, to which someone had texted CCSM 2 a screen shot of the post. Children do not eat food off the floors, all meals and snacks are placed on the table to eat and never on the floor. He has never heard of anyone complaining that this happens. I interviewed Megan Christensen, licensee designee for the center. She said CCSM 1 made a Facebook post stating the floors in her classroom are clean and mentioned the five second rule if a child drops food off on the floor, because the floors are so clean, children can eat off them. She said she would have let this pass if it didn't evolve into a social media scandal. She said CCSM 1 meant this to be in a joking manner and wasn't seriously allowing or making children eat food off the floor. She said she has observed a child dropping food onto the floor and picking it up and eating it faster than bein

On 01/25/2023, I spoke with assigned child care licensing consultant, Karen Woodman. She said there was an incident on 01/23/2023 regarding Child A receiving nurse maid elbow. The program director, Laura Seyforth did not know about this injury until 01/24/2023, as this was when she received communication from Child A's Mother via email that Child A was taken to the emergency room. Ms. Seyforth also did not know that there was an incident involving Child A on 01/23/2023. Child A's Father came into the center on 01/25/2023 upset that they did not receive an accident report from the center explaining that their child was injured. Ms. Woodman explained CCSM 2 and CCSM 1 were present at the time of the incident with Child A. Ms. Woodman spoke with Child A's Mother on 01/25/2023 and learned that another child pulled on Child A's arm to which she received an ice pack on 01/23/2023. Child A's Mother was upset that she wasn't notified that Child A hurt her arm and received an ice pack. Child A's Grandmother picked up that day and told her Child A was crying and upset during pick up. Child A didn't say what was wrong nor did the child care staff members. Child A's Mother said Child A was up for most of the night, so they decided to take her into urgent care where she was diagnosed with nurse maid elbow. Ms. Woodman spoke with Ms. Seyforth today, 01/25/2023 as well and learned there would be a meeting tonight with the parents to discuss the incidents. On 02/01/2023, I spoke with Child A's Mother. She said on 01/23/2023, Child A's Grandmother picked up Child A at the center. When Child A came home, she seemed upset and looked as if she had been crying. She asked her what was wrong, and Child A said another child grabbed her by the arm and pulled her down and now her arm was hurting. Child A's Mother iced it the remainder of the night. The next day, she called the center, spoke with Megan Christensen and asked why 5 no one told her she had hurt her arm while in care. Ms. Christensen apologized. Child A was taken to Urgent Care where she was diagnosed with nurse maid elbow and something regarding her tendons. Child A's Father was also upset regarding the matter and spoke with Ms. Christensen on 01/25/2023. Ms. Christensen emailed Child A's Mother later in the day indicating she interviewed CCSM 1 and CCSM 2 who were involved, and she is waiting on a few more incident reports to be completed and she would follow up with Child A's Mother. On Thursday, 01/26/2023, Child A's Mother and Father met with Ms. Christensen, Kimberly Vaughn and Ms. Seyfarth were present. They wanted CCSM 2 to attend the meeting as well and were upset that he was not present for this. Child A's Mother and Father received two incident reports for two separate situations. The first incident stated Child A was grabbed by the arm by another child. The second incident involved another child pushing Child A down and Child A fell on her bottom, but this wouldn't have caused injury to her arm. Child A's Mother is concerned that that there were two separate incidents that she was not notified of immediately and Child A received a serious injury. On 02/01/2023, child care licensing consultant, Karen Woodman and I made an unannounced visit to the center. Program director, Laura Seyfarth was interviewed. She said she has been employed at the center since 2019. She explained she was cc'd on an email that Child A hurt her arm. It appeared Child A was playing in the gym and another child, while Child A was playing on a mat, pulled her by the arm from one mat to the other mat. The email stated this incident happened on 01/23/2023. On Tuesday, 01/24/2023 Ms. Christensen spoke with CCSM 1 and CCSM 2 regarding Child A's injury. CCSM 2 stated he didn't see the incident, but CCSM 1 said Child A complained that her arm hurt, so she gave her an ice pack and had her sit until she felt okay enough to go back and play. On 01/25/2023, I spoke with child care licensing consultant Karen Woodman. Child A's Mother said she had concerns about CCSM 2. There was a time last week that Child A needed to use the restroom, but CCSM 2 refused to let her go and Child A had an accident. On 02/01/2023, I spoke with Child A's Mother. She said on 01/09/2023, Child A was outside, and she asked CCSM 2 if she could go inside to use the restroom. CCSM 2 told Child A that she couldn't go inside right now, and Child A said "okay, I'll hold it." So, she then asked another child care staff member and this person, unknown who, said "Do you really want to make the whole class go in to go use the restroom?" Child A ended up urinating on herself. During pick up, Child A's Mother addressed this with CCSM 2 and replied that he was sorry, but Child A said she could hold it. He said he was outside with CCSM 5 and wasn't allowed to leave the children as 10 this would put the classroom out of ratio. Child A's Mother is concerned with what the plan is when children are outside and need to use the restroom. On 02/01/2023, child care licensing consultant, Karen Woodman and I made an unannounced visit to the center. Ms. Seyfarth was interviewed. She said heard about Child A having an accident, unknown from who. She does not know exact details surrounding the incident. In general, if there is a group of children outside and one needs to go inside to use the restroom, the center always has extra child care staff members available and can use their walkie talkies to ask for help in these situations. She has never heard of anyone complaining that child care staff members are not allowing children to use the restrooms. She said she has no concerns for the care that CCSM 2 provides to the children or the way he interacts with them. No parent or child care staff members has ever complained about CCSM 2. Kimberly Vaughn was interviewed. She said she has never heard of Child A having an accident because she wasn't allowed to use the restroom. She explained there are always extra child care staff members at the center and if children are outside and one needs to come inside to use the restroom, child care staff members can use walkie talkies so someone can take a child into the restrooms. All lead caregivers carry their cell phones with them as well and can use this to ask for help whenever needed. She said she has no concerns with CCSM 2 or the way he interacts with the children. Child A's Father had a concern that CCSM 2 was hugging on Child A "all the time", Child A really like CCSM 2 and tends to come towards him and is affectionate with him. She said she has never noticed that CCSM 2 is overly affectionate with anyone, and he typically does a "side hug". I interviewed Megan Christensen, she said she wasn't present at the center when Child A soiled herself, but CCSM 2 sent her the message her received from the app and asked how he should respond. From her understanding, everyone was outside getting ready to come inside when Child A asked CCSM 2 to use the restroom. CCSM 2 told her everyone was lining up to go inside and to wait two minutes to use the restroom. Then Child A soiled herself. She said she doesn't believe it was an intentional "we aren't going to take you in right now," but rather everyone was getting ready to go inside and they were waiting for the other children to line up. She said the center has extra child care staff members available so if a child needed go inside, child care staff members can use walkie talkies to ask for help. Child A's Mother did not speak to her about Child A's accident. On 03/10/2023 I attempted to contact CCSM5, however the number provided was disconnected. On 03/10/2023 I called CCSM2. A voicemail was left requesting a return call. On 03/15/2023, I spoke with CCSM 2. He explained he was outside with CCSM 5 with approximately 24 children. Child A said she had to use the restroom so he told her that if she had to go inside, he would need to gather

On October 21, 2022, I spoke to child care licensing consultant Karen Woodman. Laura Seyfath, program director notified Ms. Woodman that Child Care Staff Member 1 was placed on leave due to an allegation of sexually harassing a minor employed as a lifeguard at the YMCA Parkwood location. Ms. Woodman spoke to Officer Casaday from Meridian Township Police Department. He told her that he wasn't sure why she was calling in to make a report, as he could not do anything without more information. He also told her the victim could make a police report if she chose to do so. On October 25, 2022, I completed an unannounced on-site inspection at the child care center with Ms. Woodman. I individually interviewed Program Director Laura Seyfarth, Director of Human Resources Amy Stearns, Licensee Designee Kimberly Vaughn, Marketing and Communications Director Krista Beyer, and Minor Employee 1. Laura Seyfarth, Program Director stated that Minor Employee 1 is employed as a lifeguard at the Parkwood YMCA location. She reported to Ms. Beyer that she was sexually harassed by Child Care Staff Member 1. Ms. Seyfarth stated that Minor Employeel did not report this information directly to her and she did not observe Child Care Staff Member 1 sexually harass Minor Employeel. Ms. Seyfarth stated that Child Care Staff Member 1 was placed on leave until an internal investigation is completed. Ms. Seyfarth stated that no other employees expressed concern to her about Child Care Staff Member 1 making inappropriate comments or exhibiting inappropriate behavior. Krista Beyer, Marketing and Communication Director stated on October 20, 2022, she observed Minor Employee 1 sitting behind the welcome desk wearing her lifeguard uniform. Ms. Beyer told Minor Employee 1 that employees are not allowed to sit at the welcome desk, and she could wait in the office until her shift began. Ms. Beyer stated that Minor Employee 1 followed her into her office and told her that she wanted to tell her about an incident involving Child Care Staff Member 1. Minor Employee 1 told her that two weeks ago Child Care Staff Member 1 made inappropriate comments about how her body looked. He asked her "do you want to do cardio" and winked his eye twice. Minor Employee 1 stated they were standing by the preschool bathroom, which is located on the main floor of the building. When I asked Ms. Beyer if Minor Employee 1 stated what Child Care Staff Member 1 meant when he asked if she wanted to do cardio, she said no. Ms. Beyer stated she thought it implied "sex." Ms. Beyer stated that Minor Employee 1 did not state if children were present when Child Care Staff Member 1 made the alleged comment. Ms. Beyer's also stated that she did not know if Child Care Staff Member 1 and Minor Employee 1 were working when this occurred. Minor Employee 1 also stated that on a separate occasion while she in the weight room working out, Child Care Staff Member 1 gestured with his finger for her to come over to him, and he stated, 3 "it's funny how I can make you come over with one finger, but I can make you cum with two." Minor Employee 1 stated that this occurred two weeks ago, but she could not remember the date. Ms. Beyer stated the weight room is located on the lower level of the building. She called licensee designee Kimberly Vaughn. Ms. Vaughn conducted a Microsoft Teams meeting with her and Minor Employee 1. Minor Employee 1 shared the allegations with Ms. Vaughn during the meeting. Minor Employee 1 also shared a text message conversation between she and Child Care Staff Member 1. When I asked Ms. Beyer if Child Care Staff Member 1 knew that Minor Employee 1 was 17 years old, she stated that she believed that he knew her age. Ms. Beyer stated that no other employees expressed concerns of Child Care Staff Member 1 making inappropriate comments or exhibiting inappropriate behavior. I interviewed the Ms. Woodman, child care licensing consultant. The center is part of Ms. Woodman's assigned workload. Ms. Woodman spoke to the program director Ms. Christensen, and Child A's Mother. Ms. Christensen told her that the children in care were directly supervised at the time the accident. The wood stump that Child A stood on are meant for sitting when the children participate in group time. One child chose to stand on the log and was directed to get down. Once the first child got down, Child A decided to jump on a similar log and fell. Child A was provided with first aid. Child A's Mother was contacted immediately as she also works at the center. She did not observe the accident; however, she was nearby caring for a group of children. Child A's Mother said that she informed Ms. Christensen that Child A was being taken for medical treatment immediately. Although Child A's Mother believes that it was an accident, she wondered about the amount of supervision taking place. Child A's Mother did not report any other concerns. I completed an on-site inspection to the center. I interviewed Ms. Seyfarth, program director. She was not present when the accident occurred. Ms. Seyfarth stated that the center is no longer using the logs for sitting. She believes that this was an accident and that the children receive good care and supervision while in care. I interviewed Mr. Ely, child care staff member. He has worked at the center for 4 1/2 years, and he enjoys working with the children. He stated that on 7/5/2022, he was working with children 3-5 years of age. There were 16 children in the group with three child care staff members including himself, Ms. Sargent, and Child A's Mother. Child A's Mother was stationed in a nearby large open door shade tent with eight children. Mr. Ely and Ms. Sargent were with the remaining eight children near an open sided green shade tent and circle time area that contained sitting logs. The group was preparing to transition to another learning activity. The eight children were engaged in freedom of choice learning with toys, as well as were allowed to sit on the nearby logs. The logs are not meant for climbing. Mr. Ely stated although busy setting up for the next activity, that he continued to provide the children with active supervision. He observed one child stand on one of the sitting logs. He immediately redirected the child to get down. He explained to the child, and other children present, that the logs were for sitting only. He explained that standing on the logs was not a safe choice, and that their feet needed to remain on the ground. 3 Mr. Ely continued to supervise the children. Within seconds, Child A decided to jump on top of one of the sitting logs, despite just being redirected not to climb on them. Mr. Ely did not have time to further intervene as Child A immediately fell and landed on the ground. His left foot hit the ground first and then his body in a "twisting" motion. Child A cried. Mr. Ely picked him up and immediately alerted his mother. Child A was provided ice. Soon after, Child A's Mother left with Child A. Mr. Ely later heard that Child A broke his femur. Mr. Ely has not spoken to Child A's Mother since the accident. He feels "terrible" that a child got hurt. He stated that this was an isolated accident. He believes that the children all receive good care and supervision while in care. In addition, the logs have been removed. I observed the area where the accident occurred. The area consists of a large grassy opening. Mr. Ely, Ms. Sargent, and eight children were positioned under and near a green open sided shade tent. The sitting logs used during circle group time were approximately nine feet from the tent and in direct line of sight. Child A's Mother and her group of eight children were located approximately 30 feet away in an open-door tent, within direct line of sight of the logs and green shade tent. I observed the sitting logs. The logs were no longer being used

She stated that the injury occurred on 7/5/22 at about 4:00p.m. The program director, Ms. Christensen was made aware that medical treatment was being sought for Child A on 7/5/22. Ms. Woodman was not notified of the accident until 7/7/2022, thus being past the 24- hour required reporting time. I interviewed Ms. Christensen. She stated that at on 7/5/2022 at approximately 4:20p.m. — 4:30p.m., she was informed that Child A was injured. She spoke with 5 Child A's Mother on 7/5/2022 right after the accident. Child A's Mother told her that she would be taking Child A to urgent care because they thought that he may have hyperextended his knee. Child A's Mother told her on 7/6/22 that Child A was taken to the emergency room and that he fractured his femur. She reported the accident to the department within 24 hours of his mother telling her that Child A was taken to the emergency room on 7/6/2022. I spoke with Ms. Christensen about her reporting time to the department after Child A received medical treatment. According to Ms. Christensen, Child A's Mother told her that she was taking Child A to urgent care on 7/5/2022 shortly after the accident. Ms. Christensen stated that she was not aware that going to urgent care fell under the department's definition of seeking medical care. As such, she did not report that within 24 hours. She stated that Child A's Mother told her on 7/6/2022 that Child A went to the emergency room. She reported that to the department on 7/7/2022, within 24 hours of this notification by Child A's Mother. I explained to Ms. Christensen that notification to the department within 24 hours is required for medical treatment or hospitalization. Being treated at an urgent care medical center would qualify as receiving medical treatment, and as such 24-hour notification is required. Ms. Christensen expressed an understanding of this requirement, saying it was a misunderstanding. I interviewed Child A's Mother. Child A's Mother told Ms. Christensen that she was taking Child A for medical treatment on 7/5/2022, and she left the center.
