On April 6, 2023, Child Care Staff Member (CCSM) 1 placed Child A In a restraint during an altercation with another child. On April 6, 2023, the Blue and Orange classrooms were out of ratio. The child care children in the Blue classroom do not have access to water.

The program director Madison Sorenson and child care staff members mak conversations in front of the childcare children. Child Care Staff Member 2 We remarks about Child D and refuses to assist her with eating or diapering. inspection to the child care center. We met with the program director, Madison Sorenson and explained the allegations in the complaint and the need to interview the child care staff members. The licensee designee, Melissa Rabideau joined us in the office and I explained the reason for our visit and the need to ant, interview the child care staff members. Ms. Rabideau stated that she was unaware of there being any issues that would require an investigation at the center, she was not in the center the last couple of weeks due to illness. Ms. Rabideau stated that Child D was in the Purple Classroom and the Child Care Staff Members (CCSMs) in that classroom are Child Care Staff Member (CCSM) 2 and CCSM 3. Ms. Rabideau stated, "Child D has done well since enrolling at the child care center and appears to be adjusting well. Child D cried a lot when she first started, but within her first 3-5 days she stopped crying as much." After the allegations were read to Ms. Rabideau, she stated the allegations go against her center values, as she incorporates diversity into her center with diverse children and child care staff members. She said she has never heard Ms. Sorenson or CCSM 2 make any comments. CCSM 4 told Ms. Rabideau that Ms. Sorenson or CCSM 2 are not from diverse areas, so Ms. Rabideau suggested CCSM 4 help educate them. Ms. Rabideau heard a conversation between CCSM 2 and CCSM 4 regarding _ CCSM 4 was explaining this to CCSM 2 CI who lacked the knowledge. She has never had any concerns about CCSM 1 and has never heard CCSM 1 mak We informed Ms. Rabideau of the allegation that Child D was not fed on February 27, 2023, because CCSM 2 did not want to feed her or change her diaper. Ms. Rabideau stated she was unaware of this and if this truly happened it goes against the values of the child care center. Ms. Rabideau confirmed that Child D attended on February 27, 2023. We reviewed the child care application used by the child care center. The pictures taken on February 27, 2023, showed Child D eating cheerios and crackers during snack time. We then reviewed the video footage of Child D having lunch. The footage was time stamped starting at 11:34 a.m. Child D was observed sitting at the table with CCSM 3 with her food in front of her. Child D is observed throughout the video taking sips of her water, eating apple sauce, and Cheerios. CCSM 3 had Child D on her lap and assisted her in eating her lunch. CCSM 3 attempted for feed her pasta, however Child D refused the pasta. Child D ate some applesauce and took a few bites of food from her lunch on her own. CCSM 2 was present in the classroom, however the video footage did not show CCSM 2 providing care for Child D. All of Child D's care was provided by CCSM 3. CCSM 2 was providing care to other child care children. During the onsite inspection and I interviewed Ms. Sorenson regarding the allegations in the complaint. Ms. Sorenson stated that CCSM 2 grew up in a small town that did not have a lot of diversity and was not educated about different Ms. Sorenson stated that on February 27, 2023, CCSM 2 made a comment that ild D's She went on to say that CCSM 2 reportedly had food poisoning from something she ate the day before and was nauseated and was sensitive to smells. Child K is one of CCSM 2's favorite children and she was unable to provide care for him that day as well because he and it was making her feel sick. During the onsite inspection, and I interviewed CCSM 2. CCSM 2 is the lead caregiver in the Purple assroom. CCSM 2 said she believed she was being interviewed because she heard it had something to do with Child D. CCSM 2 stated Child D is emotional and cries for her mom a lot but has started doing better. CCSM 2 stated that CCSM 3 is Child D's primary careg Child ran out of the center and was found by a restaurant employee. Incident was not reported to the department. Child C is a = and left the center without child care staff members knowledge. Child Care Staff Member I the child care children's and =them on the nap cots. Child Care Staff Members leave Child B i until he is cold and has to go home. Madison Sorenson, Program Director was made aware that a child care staff member had COVID and did not make parents aware.

I completed an unannounced onsite inspection on 07/18/2023. I interviewed Melissa Rabideau, licensee. Ms. Rabideau was offsite at a meeting when she received a message through Bright Wheel saying that Child B's parents were coming to the center and wanted to speak with Madison Sorenson, substitute program director. Bright Wheel is the software system that the center uses to track attendance and send messages to families. Ms. Rabideau logged into the camera system to view footage from the classroom to see if there was a reason Child B's parents wanted to talk to Ms. Sorenson. When Ms. Rabideau logged into the camera system and reviewed the past footage, she saw Child A was in the lobby by himself. Ms. Rabideau returned to the center immediately. When she returned to the center, Ms. Sorenson told her that Child A wanted to play with the foam blocks in the front lobby. Ms. Sorenson told Child A that he had to wait until his father picked him up. When the Blue Room transitioned to combine with the Orange Room due to lower attendance numbers, Child A went out the gate and into the lobby during the transition. When Child A was in the lobby, another parent and child walked through 611 W. OTTAWA. P.O. BOX 30664. As that parent and child walked out the front door, they let Child B's Father 1 and Father 2 into the lobby. Child B's Father 1 and Father 2 were in the lobby and noticed Child A in the lobby. Ms. Sorenson came out to talk to Child B's Father 1 and Father 2 and saw Child A in the lobby. Ms. Rabideau told Ms. Sorenson to send a message to child care licensing regarding the incident and call the parents of Child A. Ms. Sorenson tried to call both parents but had to leave a message for them on Bright Wheel. Ms. Rabideau said the supervision policy at the center is to use name to face attendance and the Bright Wheel app. Bright Wheel tells the child care staff members how many children are in the classroom. Name to face attendance is completed every 30 minutes and tells the Child Care Staff Members (CCSMs) how many children are in each classroom. CCSMs look at the list and then the child's face to verify they are present. CCSMs complete the name to face every time the children cross a threshold. Ms. Sorenson and Child Care Staff Member 1 (CCSM 1) were looking at their name to face lists when Child A slipped out into the lobby. Ms. Rabideau is putting a bell on the interior door so CCSMs can hear when it is opened. She is also scheduling extra child care staff members to work during pick up time. I interviewed substitute program director Madison Sorenson. On 07/14/2023, Ms. Sorenson was working in the Blue Room around 5:00 PM. As children were picked up and the number of children dropped to 15 children between the Orange Room which is ages 2 to 3 and the Blue Room, which is ages 3 to 5, the two 1/2 1/2 classrooms combined. The Blue Room was transitioning to the Orange Room. Ms. Sorenson was behind the group of children and CCSM 1 opened the gate and let the children from the Blue Room into the Orange Room. Ms. Sorenson completed name to face attendance with the children when they left the Blue Room and when they went through the gate into the Orange Room. Ms. Sorenson told CCSM 1 how many children she had. CCSM 1 was checking the children in on the name to face sign in sheet in the right back corner of the classroom and Ms. Sorenson was checking the children into the Orange Classroom on Bright Wheel at the same time. Ms. Sorenson admitted that she and CCSM 1 were both facing away from the children working on the sign in sheets. A few minutes after working on the sign in sheets, Child B's Father 1 sent Ms. Sorenson a message saying that he was in the lobby. When Ms. Sorenson opened the door to the lobby, Child B's Father 1 told her that Child A was in the lobby playing. Ms. Sorenson took Child A back to the Orange Room and asked CC

On April 10, 2023, I spoke to the Complainant regarding the allegations. The Complainant was concerned that CCSM 1 had Child A in a "passive restraint on April 6, 2023? The Complainant stated the restraint was reportedly done because Child A was being with another child and the child care staff members. On April 17, 2023, l made an unannounced onsite inspection to the child care center. I discussed the allegations in the compliant with the Melissa Rabideau, Licensee Designee. Ms. Rabideau stated that Child A is towards child care staff members as well as other children in the child care Men r. Ms. Rabideau stated they have been working on these issues with his arents, who have been getting for him to address his m. During the onsite inspection on April 17, 2023, l reviewed the classroom video footage from April 6, 2023. In the video Child A goes up to another child in the classroom . CCSM I intervened and redirected Child A. The video footage then showed i goin up to a child sitting at a table and attempting to the other child . The video footage showed CCSM 1 attempting to stand in between Child A and the other child and redirect Child A to another activity. Child A became toward CCSM 1. CCSM 1 continued throughout the video foo age o an"re ect Child A and stand in his oathw0awhen he was attempting to go u to other children to b Child A again became with CC an she sat the floor with Child A in her lap area him to calm him down. Ms. Rabideau and I discussed the incident. Ms. Rabideau stated it is hard to know when Child A is going to become or child, as it comes out of nowhere. I did not interview CCSM 1 during the onsite inspection, as she was not at the center at the time of my onsite inspection. 3

On April 10, 2023, I spoke to the Complainant. The Complainant believed the children in the Blue Classroom did not have access to water because the Complainant was concerned that upon arrival at the center, they saw water bottles in the front of the center where the children enter the center and not in the back where the Blue room is located. On April 17, 2023, I made an unannounced onsite inspection to the child care center. During the onsite inspection I discussed the allegations in the complaint with the licensee designee Melissa Rabideau. Ms. Rabideau stated the child care children have access to water at all times in the Blue room and in the other classrooms. The water bottles are placed in the front of the center before pick up so the water bottles are not forgotten. At the time of the inspection, I observed water 5 bottles sitting on the counter in the Blue Room. There is also an operable water fountain in the classroom at a level the children can reach to get water. During the onsite inspection I viewed video footage of the classrooms from April 6, 2023. The video footage showed water bottles in the classroom on the counters.

On March 2, 2023 and I interviewed Ms. Melissa Rabideau the licensee designee. Ms. Rabideau was aware that Child A went out of the back door adjacent to the locker room. CCSM 4 was the child care staff member in the classroom with Child A at the time he left. Child A ha . Ms. Rabideau plans to install door alarms that will prevent this from happening again. I 10 advised Ms. Rabideau that this incident should have been reported to licensing within 24 hours of the incident. Ms. Rabideau was unaware of this and will provide the written report before the 72-hour timeline. I showed Ms. Rabideau the applicable child care licensing rules 400.8158 (2) & (4) in the rule book. On March 2, 2023, and I interviewed Ms. Sorenson. Ms. Sorenson was aware that Child A left e center and the child care staff members were not able to locate him for a short period of time. CCSM 4 was providing care for Child A in the Blue Room. Ms. Sorensen was providing care for children in the Purple classroom. CCSM 4 brought Child A into the Purple Room to give CCSM 3 a break, because Child A was having issues, he was hitting and kicking CCSM 3. Ms. Sorenson was previously Child A's primary caregiver, and she is usually able to assist in calming him down. Ms. Sorensen rocked with Child A and when he was calm, she took him back to his classroom. Approximately 15 minutes later CCSM 4 came into the room and asked her to come and assist with Child A again. CCSM 4 told her Child A was making threats and was sitting in the corner of the room and she was giving him his space. When they entered the classroom Child A was gone. At the time that Child A left the classroom he was in the classroom with CCSM 5. CCSM 5 had the remaining children standing on their symbols that are on the floor preparing for snack time. They immediately started looking for Child A. They checked the supply closet, locker room, and bathrooms. She also went back to the locker room and checked inside of the lockers. When she still could not locate him, she checked the camera footage and saw Child A went through the locker room and out the back door that goes into a garage like area. The garage like area is connected to the restaurant next door. The center stores stuff in the garage area. Child A was crying when he was found. He never went outside and unattended for about two minutes when the restaurant owner found him and returned him to the child care staff members. Ms. Sorensen said she did not know she was supposed to report the incident to child care licensing. Ms. Rabideau told Ms. Sorensen she would handle the situation. On March 2, 2023, and I interviewed CCSM 3. CCSM 3 said Child A is having some difficulties. Child A is normally in the Blue room and he fled the center because he wa Child a went out of the backdoor adjacent to locker room, leading to the garage area and a worker from the neighboring restaurant returned Child A to the child care center. CCSM 3 said Child A was missing for approximately 5-10 minutes. During the onsite inspection on March 2, 2023, and I interviewed CCSM 4 regarding the allegations in the complaint. During the interview " asked CCSM 4 if any of the children ran or tried to run from the c ild care sta .CCSM 4 said Child A ran yesterday (March 1, 2023) and the child care staff members had to search for him. CCSM 4 said Child A is to other children and the child care staff members. On March 1, 2023, Child A d her he wanted so she went and got Ms. Sorenson for assistance. Ms. tc Sorenson was previously Child A's primary caregiver and is usually able to calm him 11 down. After Ms. Sorenson got Child A calmed down and returned him to her classroom, he started to "act out again." She went to get Ms. Sorenson again and when they returned to the classroom Child A was gone. She is not exactly sure where Child A was found, but he was missing for approximately five minutes. Ms. Sorensen stated that Child C has attempted to run out of the center, but the child care staff members always stop him. Child C runs to the lockers and to other classrooms within the building but has never left the building. On March 7, 2023, during the onsite inspection and I interviewed CCSM 1. CCSM 1 stated Child C is a ~an Res to leave the center, but they are always able to stop him. On March 7, 2023, during the onsite inspection and I interviewed CCSM 6. CCSM 6 stated that Child C is a around the building and tries to leave out of the building. There was one time Child C got out of the door, but a child care staff member was right there behind him and brought him back in. On March 7, 2023 and I interviewed CCSM 3. CCSM 3 stated that Child C is a around the building, however, there has never been an occasion where the child care staff members did not know his location. On March 9, 2023, and I called Child C's Mother. Child C's Mother stated that she does not have any concerns about the care provided to Child C. Child C is around the center, but to her knowledge he has never run outside of the center, d C's Mother said the child care staff members contact her regarding Child C's or if they have him remain inside of the center because he is-. 14

On March 2, 2023, and I made an unannounced onsite inspection to the child care center. We met with the licensee designee Melissa Rabideau. Ms. Rabideau denied having any concern with CCSM 1. During the onsite and I interviewed CCSMI. She admitted she has closer to her with children on them to bring them closer to her. She was asked directly if she ever dropped the cots when she was dragging them towards her. She was not able to answer directly, but stated, "this could have happened," but she does not recall. She said there were times she has pulled the cots toward her with her foot. CCSM 1 said when the child care children don't want to lay down during nap, she constantly tells them to lay down. I explained to CCSM I that of child care children them to her was not a positive form of discipline and inappropriate in a child care setting. On March 2, 2023, and I interviewed CCSM 6. CCSM 6 said CCSM 1 is quick to jump at things. She has never seen CCSM 1 be with any of the children. She has however seen CCSM I move a cot while a child was still on it lifting is maybe a foot off of, he ground, but she does not recall how the child acted or why she did this. 15 On March 9. 2023 and I called Child C's Mother. Child C's Mother stated Child C does not take naps the center, because he is only there half days. On October 9, 2023, and I spoke to Child F's Father. He stated Child F she naps at child care. When Child F does not nap, she is allowed to play with a toy on the cot. He has no concerns of physical discipline at the child care center. On March 9. 2023 and I called Child G's Mother. Child G's Mother stated she has no concerns with the child care staff members. Child G and Ms. Sorenson have a very playful relationship. If there were any concerns with their interaction or Ms. Sorenson pulling his leg, he would have told her. She does not have concerns with discipline at the center. On March 9, 2023, and I spoke to Child H's Father, and Fathe They have never been informed of any issues with Child H during nap time an being on his cot informed them it was alleged that CCSM 1 children by their an the children's with her Pa to get their attention and this reportedly happened to Child H. I informed them is was not appropriate and would be addressed by the department. On March 16, 2023 and I called Child E's Mother. Child E's Mother stated that it was her understanding that the children ate lunch from 11a.m.-12p.m. and then had naptime afterwards. She said the children nap on a cot and if they don't nap, they must at least have quiet time. Child E does not nap at home or on weekends, so she does not believe he naps during child care. Child E's Mother denied having any knowledge of him being picked up and on the cots or if CCSM I pulling him on the cot. Child E's Mother believes if this occurred Child E would have told her. Child Es Mother suggested speaking with Child E's Sister; because they are best friends and if he didn't tell her he would definitely tell his sister. She feels the child care is a positive environment, she has never seen or heard anything negative. On March 16, 2023 and I interviewed Child J. Child J was able to pass the forensic interview pro ocol. Child J agreed to only talk about the truth. Child J stated she enjoys watching YouTube at home. asked Child J if she has rules during naptime at child care. Child J stated that ey have to stay on their cots, not play, but can color, asked if she had ever broken the rules during naptime and she denied ever breaking the rules. Child J stated she does not know what happens when people break the rules and does not remember seeing anyone pulled on the cots. Ms. Sorenson confirmed that Child B has and because of this condition he can't get cold. Child B must have socks on, rated, stay warm, and eat nutritious foods. Child B's Mother sends two meals for him. He sometimes refuses to eat one of the meals packed for him. Child B has recently had frequent because he has been in the Blue Classroom and is usually in the OrangeRassRoom. Children in the Blue classroom are older and go to the on their own. On March 2, 2023, and I discussed the allegation in the complaint with Ms. Rabideu. She denied having any knowledge of any child care staff member having contracted COVID-19. Ms. Rabideau denied any knowledge of Ms. Sorenson not relaying information to her. On March 2, and I interviewed Ms. Sorenson. Ms. Sorenson stated that CC2S0M2 33 t,e"sDted I ve for COVID-19 with a home test kit, then tested negative a few days later. Ms. Sorenson did not send out a notice to the parents. On March 7, 2023 and I interviewed CCSM 3. CCSM 3 stated that on February 7, 2023 she tested positive for COVID-19, she sent a text to Ms. Sorenson and informed her that she contracted COVID-19 and sent her a picture of the positive test results. CCSM 3 allowed and I to see the text message -11 that was sent. 18 On March 16, 2023, after completing child interviews and I completed an exit conference with Ms. Rabideau. I discussed the need for positive discipline and discussed CCSM 1 of the children a We further discussed e had in front of the child care children by the child care staff members and hat conversations about comments about parents' . We went over the rule to notify the department any time and child is lost or left unsupervised. We further discussed the program director and the child care staff members needing diversity, equity, and inclusion training. I discussed the recommendation of a provisional license and increased monitoring. I also provided technical assistance explaining Ms. Sorenson's role as a mandated reporter. We discussed the fact that all of the child care staff members are mandated reporters and obligated by law to report suspected or actual child abuse *ne t and that is unlawful for there to be repercussions from an employer. asked her why she would threaten that "if she found out who made the t they were done." Ms. Sorenson denied saying this, then showed her the text message attached to her phone number making that statement. Ms. Sorenson then recanted and stated she was just mad when she sent that text message.

On 9/19/22 and 9/26/22, I conducted an unannounced onsite inspection to the center and interviewed Ms. Melissa Rabideau, owner. I informed Ms. Melissa Rabideau of the allegations. Ms. Melissa Rabideau confirmed to a lot of child care staff members abruptly quitting employment with her child care center. Ms. Melissa Rabideau explained that some of her child care staff members began to cause internal strife with her business and were trying to get other child care staff members to follow their course and abruptly quit employment with her. Ms. Melissa Rabideau explained that she believes the cause of this recent child care staff member turmoil was based on a child care staff member being diagnosed with cancer. When the child care staff member made Ms. Melissa Rabideau aware of the illness, she informed her that she would work with her around her illness and time off needed. This child care staff member got upset when Ms. Melissa Rabideau would 3 not allow the child care staff member to leave work early one day as Ms. Melissa Rabideau did not have any child care staff members available to cover her shift. The child care staff member wanted Ms. Melissa Rabideau to call parents and have them come and pick up their children form work. Ms. Melissa Rabideau tried to explain to this child care staff member that she could not call ten child care families to have them come and pick up their children as the families need to have child care readily available to them, so they are able to work and provide for their families. Ms. Melissa Rabideau tried to explain that this is a major part of her job. As a child care center is to assure that the center can provide optimum care for the child care parents each day. According to Ms. Melissa Rabideau, the child care staff member became upset that she could not leave and put her in two weeks' notice on 9/9/22. This child care staff member also had a couple friends and relatives who worked at the center. She also encouraged them to stop working at the center. On 9/11/22, this child care staff member emailed a letter to all of the child care families informing them she and other child care staff members quit working at the center. Ms. Melissa Rabideau said she had to call of the of the child care parents to explain what took place and ensure them that she was actively interviewing new applicants to work at the center. Ms. Melissa Rabideau said some of the parents were friends with the child care staff members who quit and asked Ms. Melissa Rabideau personal questions regarding Ms. Rabideau's personal life as the child care staff members were making up untrue statements regarding Ms. Melissa Rabideau and why they quit working at the center. One of the child care parents made Ms. Melissa Rabideau aware of a letter she received while dropping off her child for care at the center from a former parent who used to have a child enrolled in care at the center. The letter said that the center was "unsafe" and that the child care staff member was forced to work when she was sick and then got fired. The letter also said the child care staff member heard that Ms. Melissa Rabideau's father was working with the children. Regarding 9/12/22, Ms. Melissa Rabideau said she initially had enough child care staff members scheduled to work, however the child care staff members who quit were continually calling the remaining child care staff members trying to encourage them to also quit working at the center. On 9/12/22, an additional child care staff member did not show up for work. Ms. Melissa Rabideau had to adjust her schedule and place herself, and her father, Mr. Joseph Rabideau, unsupervised volunteer on the schedule to work in the purple room with the toddler aged children. Ms. Melissa Rabideau denied operating over the child care staff member to child ratio requirements. Ms. Melissa Rabideau said Mr. Joseph Rabideau is an unsupervised volunteer who has completed his fingerprints and child care licensing background requirements with the department. He has also completed the other licensing requirements for being an unsupervised volunteer that include the health and safety preparedness course 1 and course II training courses, completed tuberculosis test and signed a form 7 acknowledging that he is aware of the mandated reporting requirements for child abuse and neglect. Ms. Melissa Rabideau denied Mr. Rabideau sitting in a chair glued to his phone the entire time he assisted her in providing care for the children. Ms. Melissa Rabideau said Mr. Joseph Rabideau actively engaged with all the children that day and every day he comes into the center. A lot of the children refer to him as "grandpa" and enjoy interacting with him each day. Ms. Melissa Rabideau also denied children being sent home in soiled diapers. The centers policy for diapering is to check the children diapers every 1 -1 hours or change when '/2 needed. Ms. Melissa Rabideau said she checked and changed all of the children's diapers on the day Mr. Joseph Rabideau was working with her in the purple room. In addition, all the children's diaper changes are recorded on the center Bright Wheel automation system which informs the families of the children's daily record of the child's food intake, sleeping patterns, elimination patterns, developmental milestones, and any changes in the child's usual behaviors. Ms. Melissa Rabideau said the only way a child could have left in a soiled diaper is if a parent picked up the child from care while they were engaged in outdoor activities. During that timeframe, the child care staff member takes the child indoors to change the wet or soiled diaper before having the child leave. On occasions, parents pick up their child from care and change their diaper when they return home. On 12/01/22, I interviewed Mr. Joseph Rabideau, volunteer via telephone. I informed Mr. Joseph Rabideau of the allegation. Mr. Joseph Rabideau confirmed Ms. Melissa Rabideau's statement regarding him completing all the requirements to be an unsupervised volunteer for the center that included his fingerprints and child care licensing background requirements with the department. He confirmed Ms. Melissa Rabideau's statement regarding the child care staff members checking the children's diapers every 1 — 1 hours or changing them when wet or soiled. There were complainants that the some of the toddler-aged children came home with soiled diapers.
