I completed an unannounced onsite inspection on 5/8/2023. I interviewed Kailin Allen, program director and licensee designee. Ms. Allen has been the program director and licensee designee for almost a year. Ms. Allen was in her office when CCSM 1 told her there was an incident on the playground and Child A was missing for approximately 10 minutes. CCSM 1 said that the Red Room was playing on the hill area behind the center. The Red Room serves children ages 2 to 3 years old. The hill area is an area behind the center that classrooms can use if they want to play with the ramps or they need more running space. If classrooms use the hill area, there is supposed to be a CCSM stationed at the bottom of the hill at all times. CCSMs are supposed to spread out and have a global view of the area. CCSMs were not trained on the rules of using the hill area but Ms. Allen said CCSMs knew about the rules through word of mouth from other CCSMs. We discussed the importance of training all CCSMs on the rules and expectations for using the hill area, including positioning of CCSMs and using cones to form a visual barrier. Ms. Allen said that CCSM 2, CCSM 3 and CCSM 4 who were present for this 2 incident received a disciplinary write up. Ms. Allen sent an email to all child care staff members who work at the center telling them they needed to have a child care staff member present at the bottom of the hill if they were going to use that area. I interviewed CCSM 1. CCSM 1 said that she was leaving for lunch at approximately 11:15 A.M. when she noticed the Red Room, playing on the hill area. CCSM 2 was "walking around frantically" then came over and told her that Child A was missing. CCSM 1 ran to the woods looking for Child A. CCSM 1, CCSM 2 and CCSM 4 were all searching for Child A in the woods. After approximately five minutes she heard CCSM 4 say, "I got him." Child A doesn't respond to his name and was found right off the trail in the brush. CCSM 1 walked back to the group with CCSM 4 and Child A and then talked to CCSM 2. CCSM 2 told her that they noticed Child B walking toward the hill and told her she couldn't walk out there without them. Child B told CCSM 4 there was a person in the woods. CCSM 4 walked back to the top of the hill where the rest of the children were and counted the children. CCSMs realized they only had 11 children instead of 12 children. CCSM 2 said there is usually a person stationed at the bottom of the hill, but they didn't have anyone stationed there at the time of the incident. CCSM 1 stated that there was no call on the walkie talks that there was a missing child and that she just happened to be on her way to her car next to the hill area. CCSM 1 called to the front desk to let the program director know what happened. After Child A was found, CCSM 1 called Child A's Mother to let her know what happened. Child A's Mother was just happy that Child A was found. I interviewed CCSM 2, the lead caregiver in the Red Room. She has been employed by the center for four years. CCSM 2 said the Red Room was playing on the southside hill and all the children were at the top of the hill playing. CCSM 4 noticed Child B running towards the woods and called for her to stop. Child B told CCSM 4 she saw someone in the woods. CCSM 4 looked down the trail but did not see anyone. She brought Child B back up to the top of the hill and told CCSM 2 what Child B said. CCSM 2 and CCSM 4 did a head count and realized that a child was missing. CCSM 2 yelled to CCSM 1 who was in the parking lot. CCSM 1, CCSM 2 and CCSM 4 spread out to look for Child A. CCSM 3 stayed with the children and another CCSM from another classroom came to help supervise the children. CCSM 4 went back down the trail and found Child A who was hiding in the brush. Child A was missing for approximately 10 minutes. CCSM 2 feels the response time was quick, but they couldn't find Child A because he was hiding in the bushes. On 1/12/2023, I received a telephone call from Kaitlin Allen, program director/licensee designee. She informed me of an incident that occurred regarding Child A being left unsupervised in the hallway. She also sent me the required incident report on 01/12/2023. On 01/18/2023, I completed an unscheduled on-site inspection with consultant Samantha Struppa. Ms. Allen was not present at the center at the time of my on-site inspection. I spoke with Annie Sullivan, office manager. 2 Ms. Sullivan was in the front office on the day of the incident. Child care staff members Kennedy Hariston, Isabella Riopelle and Olivia Langley were present in the classroom the day of the incident with nine children. Ms. Langley is the lead caregiver in the classroom. Ms. Langley came to the office with Child A at 11:15 a.m. She told Ms. Sullivan that she went to the bathroom and when she came out, she found Child A in the hallway by herself. Ms.Sullivan said based on the video recording, Child A was unsupervised for about 2 minutes 45 seconds before Ms. Langley found her in the hallway. Neither Ms. Hariston nor Ms. Riopelle notified Ms. Sullivan that Child A was missing from the classroom. Ms. Sullivan called Kaitlin Allen, program director, to let her know what had happened. Ms. Allen asked Ms. Sullivan to review footage and get an idea of the exact timeline. Ms. Sullivan was instructed to communicate with each employee associated with incident and let them know there would be follow up steps. Ms. Sullivan spoke with Ms. Hariston and Ms. Riopelle individually and made them aware of the situation. Ms. Langley contacted Child A's parents by phone the same day. Typically, child care staff members will call the office if they need to step out of the classroom for a bathroom break or phone call. In this situation, child care staff members did not call down for coverage. Ms. Sullivan and Ms. Allen are currently in the process of formal disciplinary write ups with action plans and corrective action plans for the child care staff members in the classroom where the incident occurred. During the on-site inspection I viewed the classroom and hallway area. The classroom has two doors. One door opens to the hallway and the interior door on the other side of the coat room leads to the classroom. I viewed the video recording of the incident. The video does not have audio and the time is off by 1 hour, so it says p.m. but the time is actually a.m. There are two cameras that show the hallway area. The video shows child care staff member Ms. Langley leaving the classroom at 12:14:44 p.m. (real time 11:14:44 a.m.) At 12:15:01 p.m. (real time 11:15:01 a.m.), Child A leaves the classroom and is in the hallway. At 12:17:48 (real time 11:17:48 a.m.), Ms. Langley returns from the bathroom and sees Child A in the hallway. Based on the video footage, I concluded that Child A went into the hallway and was unsupervised for approximately 2 minutes and 47 seconds. The child care staff members inside the classroom were not aware that she was gone. I interviewed Kennedy Hariston, child care staff member. She is a child care staff member in the toddler room and started working at the center on 01/06/23. She was present the day of the incident. Ms. Hariston was not aware of the incident until later in the day when Ms. Sullivan pulled her aside and told her that Child A, a 2-year-old, left the classroom at 11:14 a.m. when Ms. Langley went to use the bathroom. Child A was alone in the hallway for just over 2 minutes. Ms. Hariston was sitting on blue carpet reading to the children when the incident occurred and does not remember Child A walking out the door after Ms. Langley. When Ms. Langley said she was leaving to use the bathroom, Ms. Hariston thought Child A was in the corner reading books. On 05/20/2021 the department received an incident report submitted by Program Director, Elizabeth Garland-Lauren. The incident report stated the following: "On May 19, 2021, while administrators were watching video of the classroom, Bethann was in the block area building a structure with another child. [Child A] walked over to Bethanne and the other child and kicked Bethanne's structure causing it to fall. Bethanne used both hands firmly on each arm to pull the child close to her. She then spoke with an elevated tone with the child's face inches away from her face. She told the child, "you don't do that, no thank you." Then firmly seated the child on the floor in front of her. Administration immediately entered the room and removed Bethanne from the space for reflection." The incident report further detailed that due to the incident, child care staff member, Bethanne Bailey was placed on probation until August 3, 2021. Ms. Bailey was also required to find an appropriate professional development opportunity to support her in working with children with challenging behaviors and toddlers. The training was to be completed by May 28, 2021. On 05/20/2021, I conducted an onsite inspection at the child care facility. During the onsite inspection I conducted an interview with Ms. Garland-Lauren. Ms. Garland- Lauren stated that prior to her observing the incident a child care staff member approached her with concerns about Ms. Bailey using a "loud tone" with the child care children. The child care staff member stated that she did not see anything inappropriate, but she felt that Ms. Bailey was yelling at the children. Ms. Garland- Lauren and her assistant director worked in the classroom with Ms. Bailey on various occasions and had not witnessed the yelling, so she thought it would be best to observe the class via the cameras that are set up in every classroom. Ms. Garland-Lauren went to her office and put the camera feed on her computer and allowed it to play in her 3 office while she worked on other projects. Ms. Garland-Lauren stated that as she was watching the camera feed in the "yellow room" she saw the interaction between Child A and Ms. Bailey. Ms. Garland-Lauren described the incident as Ms. Bailey sitting on the floor with two children, each one sitting on each side of Ms. Bailey. Ms. Bailey and one of the children were building block towers, while the other child was playing with a ball. Child A eventually walks up to Ms. Bailey's tower and kicks it knocking down some of the blocks. Ms. Bailey then grabbed Child A by the arms, pulled Child A close to her face and yelled at Child A saying "you don't do that. No thank you. These are my blocks." Ms. Garland-Lauren stated that this was a "full on yell," not a simple raised voice tone. Upon witnessing this, Ms. Garland-Lauren immediately went to the room and asked Ms. Bailey to come with her to the office. In the office, Ms. Garland-Lauren confronted Ms. Bailey about the incident. According to Ms. Garland-Lauren, Ms. Bailey's response was "it's not what it looks like." Ms. Garland-Lauren then had Ms. Bailey watch a replay of the incident and Ms. Bailey continued to deny that she handled Child A inappropriately. During the conversation with Ms. Bailey, Ms. Garland-Lauren informed her that she would be placed on probation and be required to complete additional training. Ms. Garland-Lauren indicated when she presented the formal write up to Ms. Bailey, she signed the document without reading the details of the discipline. Ms. Bailey was also expected to present Ms. Garland-Lauren with the titles of the trainings she planned to complete when she arrived for her next shift, however Ms. Bailey did not return the following day. Ms. Garland-Lauren stated Ms. Bailey has worked at the facility for three years and has had one prior incident of inappropriately handling a child.
