On 3/15/2023 I completed an unannounced on-site inspection at the child care center. Licensee designee and program director Kristen Morgan was aware of the allegations and confirmed she notified her assigned child care licensing consultant, Karen Woodman, both verbally and in writing of the incident. Ms. Morgan said on 3/9/2023 she was in her office talking to a parent when she heard Child A cry out. Ms. Morgan knew Child A's class just went outside so she walked over to Child A's classroom. She observed Child A inside the classroom looking outside through the window. Ms. Morgan took Child A outside and found the children from Child A's classroom were still lined up for the Child Care Staff Members (CCSMS) to complete an attendance count. Ms. Morgan said the policy for completing attendance counts involves one CCSM reading off the names of the children whose names are on the attendance log at that time. When the first CCSM reads off the child's name, the second CCSM lays eyes on that child and says "yes" to confirm the child is accounted for. The CCSMs complete this process prior to 611 W. OTTAWA. When Ms. Morgan spoke to Child Care Staff Member (CCSM) 1 and CCSM 2 about the incident, CCSM 1 said before they went outside, she read off Child A's name from the attendance record then heard CCSM 2 say "yes." CCSM 1 said she did not look up to see Child A, she only heard CCSM 2 reply. CCSM 2 told Ms. Morgan she is confident she saw Child A in line when CCSM 1 called his name for attendance. CCSM 1 and CCSM 2 said Child A likes to take his gloves off when he is inside, so they wonder if Child A took his gloves off in the classroom, then left the line to retrieve his gloves after his name was called. Ms. Morgan said when she took Child A outside after finding him looking out the window, the other children were lined up outside and CCSM 1 and CCSM 2 had not yet completed the second attendance count. CCSM 1 stepped away from the line of children because Child B ran away from the line. Ms. Morgan said both CCSM 1 and CCSM 2 looked surprised that Child A was in the classroom and not with the line of children outside. Ms. Morgan said the time Child A's classroom went outside on 3/9/2023 was a little more hectic that usual. Ms. Morgan said there was another classroom outside who ran over their assigned outdoor play time. This caused two classrooms to be transitioning at the same time which is not typical of the daily schedule. Ms. Morgan said she has never had any concerns with CCSM 1 or CCSM 2 providing adequate supervision of the children. Ms. Morgan said she re-trained the CCSMs on the policy for taking attendance during transition times. Ms. Morgan said she reminded all the CCSMs of the importance of sticking with their daily schedules to avoid m chaotic situations. Ms. Morgan believes Child A was left unattended one minute or less. Ms. Morgan informed Child A's parents of the incident the same day. Ms. Morgan spoke to Child A's Father during pick-up time. Child A's Father told Ms. Morgan he appreciates that Ms. Morgan is taking the situation seriously and he trusts that Ms. Morgan and the CCSMs will make the appropriate changes to assure the situation does not happen again. Ms. Morgan's office is located on the same side of the child care center as Child A's classroom. Ms. Morgan's desk faces a large window that looks out towards a classroom located immediately outside Ms. Morgan's office. Child A's classroom from that classroom is located on the farther side of the building right outside Ms. Morgan's office. The two classrooms are separated by a half wall. Ms. Morgan can see across the entire half of the center from her office except for the area of Child A's classroom that is obstructed by the half wall. Ms. Mo

Ms. Morgan said Child A's Mother reported she was standing in a classroom that is adjacent to Child A's classroom, separated by a half wall. Child A's Mother was attempting to remain out of Child A's sight so Child A would not try to leave her room to go to where Child A's Mother was standing. Child A's Mother observed Child A wake from a nap, then go over to sit on a "back jack' chair. Child A's Mother described a "back jack" chair as a seat that sits flush with the floor and has a back rest for child care staff members (CCSMs) so they can comfortably sit on the floor with the children during nap time. Child A's Mother said while Child A was sitting on the chair, she observed CCSM 1 grab Child A by her forearm and move Child A over about one foot to the side of the chair. Child A's Mother said she could not tell if CCSM 1 raised Child A completely off the floor as her sight was obstructed by the half wall. Ms. Morgan said Child A's Mother has expressed concerns regarding the way CCSM 1 speaks about Child A. Ms. Morgan said CCSM 1 has made comments to Child A's Mother in a joking manner such as "thank God you're here to pick up your little devil." Ms. Morgan said she believes CCSM 1's comments are meant to be in a joking manner, but Child A's Mother does not find the comments funny. Ms. Morgan spoke to CCSM 1 about the comments and believes the concern was addressed. Ms. Morgan has not had any concerns with CCSM 1's interactions with children in the past. CCSM 1 was placed on temporary administrative leave. If CCSM 1 returns to the center, Ms. Morgan will provide her with additional training on appropriate child guidance. Ms. Morgan said she will provide this training to all the CCSMs as a refresher. After Child A's Mother reported her concern, Child A went to Ms. Morgan's office. Ms. Morgan did not see any marks on Child A and Child A did not complain of any pain or discomfort. Ms. Morgan said CCSM 2 iss only CCSM currently present at the center who works with CCSM 1 in Child A's Classroom. and I interviewed Child A"s Mother. Child A's Mother said she was standing in the classroom that is adjacent to Child A's classroom and divided by a half wall. She observed Child A walk over the to a "back jack" chair to sit. Child A's Mother said Child A appeared to be happy and not causing any problems in the chair. Child A's Mother did not hear CCSM 1 give Child A any verbal directions to move off the chair. Child A's Mother observed CCSM 1 walk over to Child A and grab her by the forearm where she lifted Child A by her forearm and moved her over about a foot from the chair. CCSM 1 said she could not see if CCSM 1 lifted Child A off the ground. Child A cried for a little while after the incident. Child A's Mother said she does not believe Child A was crying because she was hurt, she believes Child A was crying because she wanted to remain on the chair. Child A's Mother said she has never observed any other concerning interactions between CCSM 1 and Child A or any other children. CCSM 1 has made comments to Child A's Mother regarding Child A that Child A's Mother interpreted as rude. However, the comments were directed towards Child A's Mother, not Child A directly. Child A's Mother does not believe it was CCSM 1's intention to hurt Child A. Child A's Mother believes CCSM 1 could have just verbally asked Child A to move off the chair. Child A's Mother believes CCSM 1 physically moving Child A from the chair was not necessary. She does not have a problem with CCSM 1 returning to the child care center to work in Child A's classroom. and I interviewed CCSM 2. CCSM 2 said she has worked in a classroom with CCSM 1 for almost a year. CCSM 2 said she was not present when the incident between CCSM 1 and Child A occurred.
