On 04/15/2022, I interviewed the complainant. The complainant reported that on one occasion when child care staff member Mr. Ian Austin was working in the Pedal Room and was changing Child G's (20-month-old, female) diaper. He appeared to take more time than needed to wipe Child G's bottom. He was observed picking her up and repeatedly pulling up her pants and then kissing her on the cheek. On a separate occasion, when Mr. Austin was in the Lyric Room, the complainant stated she had seen him kiss Child E (12-month-old, male) on the cheek after changing his diaper. The complainant was also told by child care staff member Ms. Joselyn McBride that one time when Mr. Austin entered the Infant Room he went over to Child H (2-month-old, female) picked her up and smelled her. The complainant further reported that she had seen Mr. Austin holding Child C (7- month-old, male) and kiss him on his cheek. She did not believe Mr. Austin was scheduled to work in the Infant Room at this time and had entered the room and interacted with the infants on his own time. On 04/15/2022, when I arrived on-site, I explained the allegations to program director Ms. Sarah Schumacher. She reported that Mr. Austin works in the kitchen, on the bus, and as a child care staff member filling in for staff members when they are scheduled to take a break. She said she had been informed last week by a child care staff member who thought she had seen Mr. Austin kiss Child E and Child G on their cheeks. When Ms. Schumacher spoke to Mr. Austin about the allegation, he told her that he did not kiss a child. He was upset about being accused of something 3 he said he did not do. She further reported that he has worked with the agency, at a different location for approximately four years and had only been at this location for approximately 2-3 months. She did not have any concerns regarding Mr. Austin and has never observed him to have any inappropriate interactions with the child care children. Ms. Schumacher expressed that Mr. Austin is very thorough and self- conscious of his work and his interactions with the children. Once he has been shown a procedure or technique for completing a task, he will follow the instructions consistently. He often takes his time when attending to the children and completing tasks, such as diapering. Because he takes his time with this task, she could understand why it may appear as though he is lingering. When holding a child, with his face within close proximity of a child, she said she could understand how it may appear as though he is sniffing a baby or kissing a baby. Ms. Schumacher provided a Team Member's Observation Report dated 04/05/2022, a Warning Notice that was discussed with Mr. Austin on 04/05/2022, a Coaching Training Meeting note dated 08/16/2018 and the Appropriate Physical Contact Policy & Procedure for the center. Ms. Schumacher explained the agencies process for handling potential policy violations with staff members. The documents below are a result of the internal investigation done by the agency. The allegations were reviewed with Mr. Austin. In addition, the expectations and the center's policies were reviewed with Mr. Austin. The agency did not find that Mr. Austin had any inappropriate contact with children in care. As a precautionary measure, he was provided with some coaching and one-on-one consultation from Ms. Schumacher. The Team Member Observation Report, which was completed by an employee stated the following: "Before lunch I noticed that Ian was in the bathroom changing kids. After he was done changing I saw him sniffing their necks and kissing [them on the cheek] two kids (Child E and Child G). After seeing that I immediately felt uncomfortable and went directly to Sarah [Ms. Schumacher] and Ms. Emily Kelly." The Warning Notice stated the following: "Description of incident: Ian was observed to have kissed a child's cheek. Child care staff member Mr. Ian Austin was observed changing a child's diaper for an extended amount of time, sniffing children on the neck, and kissing them on the face and cheeks.

On 06/16/2021, while outside, child care staff member Olivia Serr sent Child A (34-month-old male) into the building to use the classroom bathroom without adult supervision while she remained on the playground. On 06/18/202, an additional allegation was received. On 06/17/2021, Child A's Mother noticed bruising on Child A's back. The bruising is on both sides of his back and looked consistent with grab marks from being picked up forcefully. There was also bruising on the tailbone area. On 06/30/2021, an additional allegation was received. Child A's Mother reported that Child A had been allowed to urinate in his clothes and was sent home in wet clothes. On 06/30/2021, an additional allegation was received. Child A's Mother reported that the child care staff members were rationing Child A's food. On 07/06/2021, an additional allegation was received. Child A's Father reported that he had witnessed, while watching the center's live stream, Child A running around the classroom with a spray bottle.

On 03/25/2022, I interviewed the complainant. On 03/18/2022, child care staff member Ms. Nicollete Robeck was working in the infant room. Ms. Robeck appeared to be frustrated with Child A. "She roughly picked her up out of a bouncer by her upper arms. She said, `You're pissing me off." Then she walked quickly [over] to the tummy time mat and let go of her and she fell onto her back, maybe six inches. Far enough that it was concerning. Ms. Robeck walked away." Child A shot her legs and arms up and out and started to cry even louder. The complainant did not see any visual marks or bruises on Child A. Ms. Robeck was rude to the adults in the room and dismissive to the children until she left a short time later. This was the only time the complainant said she had witnessed Ms. Robeck acting in this manner, "Normally she just walks away." On 03/25/2022, I conducted an unannounced on-site inspection. I informed the program director Ms. Sarah Schumacher of the allegations. She stated that on 03/21/2022, a child care staff member had brought it to her attention that they were concerned about Ms. Robeck being overwhelmed and frustrated. Ms. Shoemaker had not yet interviewed Ms. Robeck regarding the reported concerns. On 03/25/2022, child care staff member Ms. Sarnia Waqar reported that she had worked in the Infant Room on 03/18/2022. She had filled in for staff members when they took their breaks. She had not witnessed Ms. Robeck roughly picking Child A up out of a bouncer and then letting go of her over the tummy time mat. "She's [usually] very reserved when I'm in the room." On 03/25/2022, child care staff member Ms. Joselyn McBride reported that she had worked with Ms. Robeck in the Infant Room on 03/18/2022. She heard Ms. Robeck say "you're pissing me off," but she did not see who she had said it to because she was busy changing a diaper. She did witness Ms. Robeck picking Child A up roughly and then letting go of her on the tummy time mat. She also reported that she has witnessed Ms. Robeck get frustrated with the children and handling them more roughly than she would do. On 03/25/2022, child care staff member Ms. Tiffany Lovett reported that she had not been working in the Infant Room on 03/18/2022. She has witnessed Ms. Robeck rushing when she is picking up children and appears to get frustrated when there is a lot of crying in the room and the children need things. "She's not necessarily harming them, just in a hurry and not gentle." On 03/25/2022, child care staff member Ms. Susana Gallegos reported that she had been working in the Infant Room on 03/18/2022. She heard Ms. Robeck say to Child A, "You're pissing me off," then she snatched her out of the bouncer and roughly sat her down on the floor on the tummy time mat. Then she placed her on her back, letting go of her prior to laying her on the floor and "it wasn't gentle." Child A's head landed on the mat and her bottom was off the mat on the floor. Ms. Robeck was heard saying, "I can't. I can't. I can't right now." Ms. Gallegos said that she believed Ms. Robeck was trying to do multiple things at once when this happened and that it 4 was the first time that she had heard her swear out loud when speaking to the children. On 03/30/2022, child care staff member Ms. Emily Kelly, who works alongside of program director Ms. Schumacher, sent me two documents of employee conduct regarding Ms. Nicollette Roback. One of the notices, dated 10/21/2022, involved inappropriate verbal interactions, it stated the following: "Nicollete was observed using strong verbal tones and interactions with the children in her care. The expected behavior, action or policy and procedure stated: use a calm, nurturing tone at all times. When redirection is needed, utilize AppleTree's discipline policy for conflict resolution and redirection. The corrective measures listed were utilize discipline policy at all times." On 06/17/2021 licensing consultant Sharon VanOrd received an Incident Report from program director Sarah Schumacher. The Incident Report stated that on 06/16/2021 at approximately 4:30 p.m., the following occurred: "While the Adabelle class was outside, [child care staff member] Olivia [Serr] sent Child A into the classroom bathroom without adult supervision and she remained on the playground. Olivia [Serr] was terminated from her position as a result." On 06/25/2021 1 completed an on-site inspection. I obtained child information cards and attendance sheets for children and child care staff members. Program director Sarah Schumacher reported that the center has a life stream camera that does not record; therefore, there is no recorded footage of the incident. stated a child care staff member Emily Kelly called her on 06/1612021 and told her that the teacher had left Child A alone. She was told that child care staff member Olivia Serr said she had let Child A into the building because he needed to use the bathroom. The next day, 06/17/201, Child A's Mother talked to program director Sarah Schumacher about the incident. She asked Ms. Schumacher if Child A was just too hard for the child care staff members and if he was being neglected. Child A's Mother did not disclose what Sarah Schumacher's response was to her questions. Child A's Mother stated that she is concerned because there is only one child care staff member in the room and "nobody is being trained to care for different kids." On 06/30/2021, 1 interviewed program director Sarah Schumacher. She reported that she was not working on 06/16/2021 when Child A was sent inside the building by himself to use the bathroom. The center's protocol for using the bathroom while on the playground is for the child care staff member to either bring the entire group of children inside the building or, if there are enough adults present, one adult could come inside with the child while another adult could remain outside with the other children. She spoke with Child A's Mother on 06/17/2021 about the incident. Child A's Mother voiced her concern that she wanted to make sure all child care staff members understood the protocol for using the bathroom while on the playground. When Ms. Schumacher questioned child care staff member Olivia Serr about the incident, Ms. Serr told her, "They said I could do it." Ms. Serr did not reveal to her who "they" were. As a result of the incident, Ms. Serr's employment with the center was immediately terminated. On 06/30/2021 I interviewed child care staff member Jacob Graham. He reported that he was on the playground with a different group of children when Child A was sent into the building alone to use the bathroom. When he went inside the building to leave for the day, child care staff member Emily Kent was in the classroom with Child A and she asked him if he could help assist Child A in the bathroom, which he did. On 06/30/2021 I interviewed child care staff member Seirra Almazan. She reported that she did not have any information about the incident and had only heard what had happened. On 07/15/2021 I interviewed child care staff member Emily Kelly. She reported that she was the acting program director on the day that Child A was sent inside the building alone by Ms. Serr to use the bathroom. She was working at the front desk just prior to the incident occurring. Parents were coming to pick up children and Child A's class was outside on the playground. When she walked back to the classrooms sometime between 4:00 p.m. and 4:30 p.m., she heard crying in Child A's classroom. That's when she found Child A alone in the bathroom. His clothes were wet and she asked child care staff member Jacob Graham to help assist Child A with changing his clothes. When she spoke to Ms. Serr about the incident, Ms. Serr admitted she had sent Child A into the classroom alone to use the bathroom and believed he had been in the building for approximately two minutes, "She told

On 06/30/2021, Child A's Mother reported that on the morning of 06/17/2021 she helped Child A get dressed. She helped take his pajamas off and there were no injuries present. After she picked Child A up from the center, she noticed that he had trouble getting into his car seat. She thought his behavior was from being sleepy. She arrived home and waited for Emma Ogline to arrive. Together the three of them went to Rotary Park in Lansing to walk around the boardwalk and the sand. Child A was always in their presence and did not fall or have any accidents or injuries while at the park. When they arrived home after the park, she started to get Child A ready for a bath around 10:00 p.m. It was at this time that she noticed bruising on both sides of Child A's back and a single bruise on his tailbone. She was immediately concerned about the injuries and wasn't sure where they had come from or why they were present. She asked Child A to tell her what had happened. She asked if a student had hurt him. Child A responded with a no. She asked if a child care staff member hurt him. After crying and hesitating to answer, he replied with a yes. On 06/18/2021, she reached out to program director Sarah Schumacher and notified her of Child A's injuries. Ms. Schumacher was unaware of the injuries and was unable to provide any explanation as to how they had occurred. Child A's Mother took Child A to Urgent Care on 06/18/2021. Child A did not return to the center after she discovered the bruising and she has since withdrawn him from the center. On 06/30/2021, program director Sarah Schumacher reported that she had received an email from Child A's Mother regarding the bruises on his back. She spoke with the child care staff members at the center and asked them if they had any idea as to how Child A could have obtained the injuries. No one reported having any knowledge of the injuries or how they could have occurred. She further reported that Child A did not return to the center after his bruising was discovered by his mother. On 06/30/2021, child care staff member Seirra Almazan reported she was the lead caregiver for Child A on 06/17/2021. Center attendance records show that Child A was in attendance on this day from . and Ms. Almazan was present at the center from 9:00 a.m. to p.m. an p.m. to 6:00 p.m. Ms. Almazan reported that she was responsible for Child A and the other children in the classroom for most of the day, except for when she was on her lunch break. Child care staff member Tatum Weiss was present from 2:35 p.m. until 3:20 p.m. The children in her classroom and another classroom joined together into one room toward the end of the day, when the children started to be picked up by their parents. The child care staff member for the other classroom was Mr. Graham. Ms. Almazan stated that she could not understand how Child A could have received the injuries while at child care. Child A is a very vocal child, which means if he falls, he would ask for help or cry. If he ever seemed to be in pain, he would hold the spot that he was complaining about. Earlier in the day, he had been riding a bike outside and had hit his knee. His knee was a bit red and he was upset about it and was holding his knee. Other than hitting his knee, she could not recall anything that had happened during the day that would have caused the injuries. She recalled that at the end of the day, Child A had been upset with another child for using a toy that he liked. Mr. Graham was the caregiver who assisted Child A with resolving the issue. She observed Child A sitting on Mr. Graham's lap, facing away from him. When she asked him if everything was okay, he confirmed that it was. He told her that Child A needed to apologize to the other child. During this time, Ms. Almazan she did not observe anything concerning with Mr. Graham and the manner in which he was interacting with Child A. On 06/30/2021, child care staff member Tatum Weiss reported that on 06/17/2021 she worked

On 06/30/2021Child A's Mother reported that Child A has come home with "skid marks" in his underwear, "which means that he wasn't wiped after bathroom time in the daycare." She also stated that child care staff member Nicollete Gimore told her that she lets him wet himself daily at nap time because she couldn't get his Pull-Up on. When it was water day, which takes place in the morning at 9:00 a.m., he had three accidents and was still in his water shoes and water clothes when she picked him up from the center at the end of the day. Child A's Mother was unable to provide any specific information or documentation to support the allegations of Child A urinating in his clothes on a daily basis. On 06/30/2021, program director Sarah Schumacher reported that she knew Child A had Pull-Ups at the center to be used during nap time. Child A's Mother mentioned to her on 06/17/2021 that Child A had been having accidents at the center. She told her that he had had three accidents one day and that he stayed in his water clothes all day. Ms. Schumacher was unable to provide any specific information in regard to Child A's Mother's concerns, as she is not one of Child A's daily caregivers. The daily activity sheets for Child A should reflect how often he is wet and how often he is changed. In an email sent to Ms. Schumacher from Child A's Mother on 06/17/2021, Child A's Mother stated, "...he was left in his water clothes yesterday, 12 had three accidents yesterday when he has been fully potty trained for nearly a year." A review of the daily activity sheets completed by the child care staff members on 06/16/2021 do not mention that he had three accidents. The only statement regarding bathroom use was after nap time. The statement reads, "Child A was dry and went on the potty." On 06/30/2021, child care staff member Seirra Almazan reported that Child A is potty-trained and goes to the bathroom on his own at home. When he is at the center, he seems shy about going to the bathroom alone. When he was in the bathroom alone, he would start sobbing and crying. If he accidently urinated in his clothes, he wouldn't want to put his dry clothes on. She stated, "When he gets very shy and nervous about using the bathroom, he would get upset and would just pee." On 07/15/2021, Emily Kelly reported that child care staff member Nicollete Gilmore had told her that Child A was having difficulty with wearing the Pull-Ups. "He did have accidents. He had clothes and would be changed." On 07/15/2021, child care staff member Nicollete Gilmore reported that Child A was potty trained, except at nap time. Child A's Mother brought Pull-Ups in for him to use during nap time. She stated, "At first he didn't want to nap and he told his mom that he didn't want the Pull-Up on." She spoke to Child A's Mother and told her that he wouldn't put his Pull-Up on for her. "He had an accident maybe once a day." Ms. Gilmore further reported that she would never leave a child in wet clothes. On 07/15/2021, Child B's Mother reported that Child B has never come home in wet clothes, as the child care staff members changed her clothes pretty regularly. When attending the center, Child B was in the process of potty-training and was doing well. On 07/15/2021, Child C and D's Mother reported that Child C has sensitive skin and had issues with diapering. Three out of five days, she had concerns about Child C's diaper not being changed in a timely fashion. When he was picked up from the center between 5:30 p.m. and 6:00 p.m., he would have had a bowel movement in his diaper. It could be easily smelled upon pick up and there was a concern as to how long he had been left in the soiled diaper. Child C and D's Mother stated that she has voiced her concerns to Ms. Schumacher and things improved temporarily. She believes the high turnover rate of child care staff members and lack of consistency has probably contributed to the situation. On 07/16/2021, child care staff member Seirra Gilmore reported

On 06/30/2021, Child A's Mother reported that prior to enrolling Child A, she told the center that he was a picky eater. For three days he wouldn't eat and Ms. Almazon told her that Child A doesn't eat lunch. She began bringing in food for him to eat, "but they were rationing his food." After she spoke to the center, they still didn't give him his lunch. She stated, "it's convenient for them. They were giving him their lunch and he wasn't eating it and they weren't getting him the lunch brought in." Child A's Mother could not provide specific details as to when or how often this was occurring. On 06/30/2021, program director Sarah Schumacher reported that when Child A first began attending at the center he was not eating and Child A's Mother was concerned that he wasn't eating. At first the arrangement was to provide Child A with the food that the center was serving and, if he didn't eat that, then there were extra snacks that could be provided to him. Child A's Mother then started to bring in food for him and it was Ms. Schumacher's understanding that it would only be provided if he didn't eat what the center was serving. After a follow-up discussion with Child A's Mother, the center started providing both the center food and the food that was brought in from home. Child A was always offered food at meal and snack times. On 06/30/2021, child care staff member Seirra Almazan reported that if Child A's Mother dropped him off at the center, he wouldn't eat. A plate of food was always made for him. She stated, "If he didn't eat at lunch, we would save it for after nap. Everyone would make sure that he was eating and would offer him more food throughout the day." On 07/15/2021, child care staff member Emily Kelly reported that she knew Child A could be a picky eater. Child A's Mother was bringing in lunches for him every day. 14 He would be offered a small plate of the center's meal and his lunchbox meal and he would pick from both. On 07/15/2021,child care staff member Nicollete Gilmore reported that Child A ate the food prepared and served by the center, as well as the food he brought from home. "He didn't want to eat what we served. I would pick things out of his lunch box and leave some for snack." She could not recall a time when he was never offered food and stated he could always have more. On 07/15/2021, Child B's Mother reported that Child B eats better at the center than she does at home. She has observed children, via the center's live stream, during lunch time, and stated, "Children were always offered food". On 07/15/2021, Child C and D's Mother reported that she did not have any concerns with what or how often Child C and D were eating when attending the center. She stated, "Our reports are consistent and they seem to be eating well". On 07/15/2021, child care staff member Olivia Serr reported that Child A had been eating lunch that was provided by both the center and home. On 07/16/2021, child care staff member Seirra Gilmore reported that Child A was a very picky eater and he often would not eat the food the center provided. His parents always provided food and there was always a plate of food made for him. She stated, "Sometimes he chose not to eat because he would want specific things." On 07/16/2021, Child E's Mother reported that the only information she has to go on regarding how much Child E (32-month-old female) eats when attending the center are the daily activity reports. She reported, "She [Child E] never seems to be hungry."

On 07/06/2021, reported that he was concerned with the supervision provided at RecMenter PecaMuse he had witnessed Child A, on the center's live stream, running around the room with a spray bottle. On 07/15/2021, child care staff member Emily Kelly reported that she had no knowledge of Child A running around the room with a spray bottle. When she worked in a classroom, she would have some of the children help with cleaning the tables. They would be given either the spray bottle that contained the soap and water or the spray bottle that just contained the clean water. On 07/15/2021, child care staff member Nicollete Gilmore reported that she had never witnessed Child A playing with the spray bottles. The spray bottles in the room are stored out of reach of the child care children. On 07/15/2021, Child B's Mother reported that it is often hard to see details when viewing the live stream. She had observed it often, a handful of times throughout the day, and has never observed anything alarming. On 07/15/2021C hild C and D's Mother reported that she watches the live stream consistently. She has never questioned anything that she has observed and she has not seen any cleaning supplies, such as a spray bottle. On 07/15/2021, child care staff member Olivia Serr reported that she has never seen Child A running around with a spray bottle.
