Child care staff member Ms. Erica Morley stated program director Ms. Melissa Janetzke and school education manager Ms. Autumn Murphy were not nt in the building: however, she would be able to talk with us. Ms. Morley stated Ms. Kathy Brock was on OemporaryleaveFuunn til the internal investigation was completed by Tutor Time. On 06/1312022, eight kids were in care with two child care staff members. Child care staff member Ms. Laura Richardson told her through the kitchen window that is open to the classroom, she observed Ms. Kathy Brock pull a child by his arms and roughly sat children on their buttocks. Ms. Brock has been employed at Tutor Time approximatel About four years ago, a note was placed in her file regarding moving aRc i too roughly from one area to another. Since then, there have been no concerns regarding the care Ms. Brock provides to children. -oung On 06/16/2022, child care staff member Ms. Jessica Smith stated she worked with Ms. Brock in the classroom. On 06/13/2022, there were eight children present with two child care staff. It was a typical day with nothing unusual. Ms. Smith denied ever seeing Ms. Brock grab or pull a child. She has heard Ms. Brock yell across the classroom, "Stop that!" Ms. Smith has no concerns regarding Ms. Brock and the care 3 she provides to children. She is not aware of any concerns reported to administration. Ms. Brock is generally a person that uses a louder voice. She is organized and ready for teaching. She has positive interaction with parents. On 06/16/2022, child care staff member Ms. Laura Richardson stated she observed Ms. Brock grabbing Child D's arm when he dumped a basket of toys. Child D cried for a few minutes. She informed program director Ms. Janetzke when she arrived. Ms. Richardson said she does not want children hurt and has told Ms. Janetzke on several occasions Ms. Brock is too rough with the children. Ms. Brock is loud and stern with the children. She has expectations that children do what she wants right now. On 06/16/2022, child care staff member Ms. Shuyuan Snider stated she used to work with Ms. Brock. When asked if she had concerns with Ms. Brock and how she works with children, she responded, "Not really." Ms. Brock would talk very loud to the children. If she wanted them to do something, she would pull or take them by their arm. Ms. Snider stated she never reported concerns to the program director. On 06/16/2022, child care staff member Ms. Isabelle Sturgis stated Ms. Brock is easy to get along with. She has a routine for the children and provides a structured classroom For the most part, she is patient with children. Sometimes Ms. Brock gets irritated with the children, depending on what they are doing. If they are climbing, she will take them off of the furniture and set them down on their buttocks. On 06/16/2022, licensee designee Ms. Kerry Barr arrived at the center to meet with myself. Ms. Barr stated employees have various ways to reach out if they need assistance in the classroom. If there is an issue, staff can talk with program director, district manager, or call the hot line. Ms. Barr brought her computer to view the video recorded on 06/13/2022. The video does not have sound and is approximately four minutes in length. Following is a summary of the video from 06/13/2022: Child C is throwing toys. Ms. Brock walks over to Child C grabs his arm and pulls him forward to walk. Child C's body falls down to the floor. Ms. Brock continues walking and walks away from Child C. Ms. Brock moves through the center cleaning up toys. Child C stands up and begins to pick up toys. Child D enters the area that Child C cleaned up and dumps the toys on the floor. Ms. Brock grabs Child D's arm then Child D begins to clean up. After Child D begins to clean up Ms. Brock is observed to say something to Child D. On 06/28/2022, Ms. Brock stated on 06/13

On 07/01/2022, I conducted an unannounced on-site inspection. When I arrived at the center, I explained the allegation to child care staff member Ms. Alesseya Hall. Ms. Hall reported that her first day working at this center was Monday 06/27/2022. She provided me with her current address, telephone number 2 and a copy of her driver's license. All of the information she provided matched what is on file for her in the department's Child Care Background Check Program's comprehensive background check system. Ms. Hall said she was originally fingerprinted back in 2018 when she worked as a child care staff member for Marietta Chamberlin, a licensed child care home provider. I shared with Ms. Hall that it was reported she was fingerprinted using the name Alecia Hill. Ms. Hall said she had never used that name or any other name. She has only ever used her original name which is listed on her driver's license as Alesseya Eileen Hall. She had no idea why someone would claim she had been fingerprinted under a different name other than her own. She was not even sure how someone would do that since you have to show a photo just prior to being fingerprinted. On 07/01/2022, I interviewed program director Ms. Melissa Janetzke via telephone. She reported that Ms. Hall had just started working at the center and that all of her paperwork had been completed under the name of Alesseya Hall. She did not know of any person by the name of Alecia Hill. Ms. Janetzke provided me with a copy of Ms. Hall's Michigan Child Care Background Check Consent and Disclosure form and a copy of her 1-9 Employment Eligibility. The information provided on Ms. Hall's Consent and Disclosure form matched the information that had already been reviewed. Although the 1-9 Employment Eligibility form did not provide a complete driver's license number or social security number for Ms. Hall, the portion of those numbers it did provide matched what had already been reviewed. The 1-9 form provided the center with a Case Verification Number and stated, "A status of `Employment Authorized' has been received on this employee for the 1-9 employment eligibility check. This is a final status indicating that this employee has the legal right to work in the USA." Ms. Janetzke further reported that she had no reason to believe Ms. Hall was not who she said she was or that she had been fingerprinted under a different name. On 07/07/2022, I interviewed the program director, Ms. Miranda Carter, from Little Scholars North Campus child care center, where Ms. Alesseya Hall worked prior to coming to Tutor Time Learning Center. She reported that she had only worked with Ms. Hall for a few weeks, but during that time, she had always used her current name. She was unaware of anyone named Alecia Hill. Ms. Carter provided me with a copy of Ms. Hall's Michigan Child Care Background Check Consent and Disclosure form. All of the information Ms. Hall provided on the form for Little Scholars North Campus child care center matched what she had provided to Tutor Time Learning Center. On 07/07/2022, a search of the Michigan Child Care Background Check Program for the comprehensive background check of licensed child care providers in the State of Michigan did not provide a result for anyone named Alecia Hill. The search for Alesseya Hall showed that she had been originally fingerprinted on 07/14/2018 under the license number DG190293475, she had been connected to at one time to license number DC190315717 Little Scholars North Campus and she is currently connected to Tutor Time Child Care Learning Center DC190250253. For all three 3 centers, her name was stated as Alesseya Hall, her driver's license number and her address were all the same. There were no listed aliases.

On 06/01/2022 I arrived at center and informed program director Ms. Melissa Janetzke of the allegations. Ms. Janetzke stated Child A (male, 19 months) enrolled at the center 04/18/2022. The parents informed the center upon enrollment that Child A bites and was disenrolled from another child care center. Ms. Janetzke said given his age, it is developmentally appropriate behavior. Child A has bitten multiple people. When he first enrolled at the center, he would bite a couple of times a day and then it increased. With interventions, Child A's biting has decreased to one or two times per day. During the week of 05/23/2022, Child A bit one time; however, when he returned from a long weekend, he bit two times. Incident reports have been written each time Child A has bitten. Child A's parents receive an incident report and the child that is bitten receives an incident report. Child A is not verbal and he does not demonstrate any cues prior to biting. Child A will reach over and bite. Child care staff are watching him and teaching pro-social behavior. Child care staff in Toddler 2 were informed Child A may bite and were provided support strategies. The center does not have extra staff available to work in Toddler 2. Parents with children enrolled in the class received information explaining biting as developmentally appropriate and strategies the center is working on to stop the behavior. During class time, child care staff members read books on biting and also use pictures with "Billy Bite Box." Child A's parents have been asked to bring in more teethers. On 06/01/2022, I observed in Toddler 2 from 10:49 AM until 12:05 PM. Twelve children were present with three child care staff members. 10:49 AM Children were gathered in a group listening to a social story about biting. After the story children participated in feeding "Billy Bite Box." Children were given a picture and had to decide whether it was a food Billy could bite or not a food and Billy should not bite it. 10:57 AM Child A had a turn feeding Billy but wanted a second turn. He was told he had a turn and it was time to sit and listen. He was sitting on the rug, turned, and hit a child next to him. Child care staff member Ms. Betty Austin told him, "No thank you. Hands to yourself." Child A attempted to bite Ms. Austin. A few minutes later, he attempted to bite another child but was stopped by a staff member. During free choice, Child A was pretending to cook with oven mitts and began swatting a child. 11:17 AM Child A was sitting on the rug with six friends and Ms. Austin. He had a puppet and began hitting Ms. Austin with a puppet. Ms. Austin modeled gentle hands. Child A began to hit his friend's back. Ms. Austin picked Child A up in her arms. A child care staff member began reading a story on the rug. Child A sat in Ms. Austin's lap. 11:33 AM Child A stood up and pushed another child. then began hitting children on the head with books. The books are picked up and put away. 4 11:37 AM The classroom door opened up and lunch arrived. One child care staff member began to wash the tables with soapy water and a paper towel. Children got very excited and immediately sat at the tables before washing their hands. Children were called one at a time to wash their hands and then returned to their seats. One child care staff member washed children's hands, a second staff member sat in a chair holding up an iPad playing a story, and the third child care staff member prepared the plates. I exited the classroom and returned to the office and spoke with Ms. Janetzke regarding my observations. Ms. Janetzke stated the center is working on a family partnership plan for Child A. They met with Child A's parents and discussed strategies to help Child A. At the next parent conference, they will discuss what is working and what is not working. When I arrived on 05/18/2022, program director Ms. Melissa Janetzke was out of the building for a short errand. I was directed to talk with lead pre-K teacher Ms. Erica Morley who was in the kitchen preparing lunch. I informed Ms. Morley of the allegations. She stated the center had three rounds of a stomach bug. The first round was a quick 24 hour stomach bug. The second round lasted three to five days for children and any staff that had it. That was approximately two to three weeks ago. The third round is currently going on with just three children out of the center while sick. During the second round, Child A (male, 1 year) was diagnosed with Rotavirus. His parents informed the center. Generally, when children are sick with a communicable disease, parents are notified through Brightwheel, a sign is posted on the classroom door, and also on the front door of the building. Ms. Morley was unsure if parents were notified of Rotavirus. Ill children can return when they are symptom free for 24 hours without medication or if they obtain a signed note from their physician. Ms. Morley said each night at closing, toys, shelves, and 2 everything in the classroom is disinfected. When a child is sick while in care, as soon as the child departs the center, the area is cleaned and sanitized. Any toys and furniture the child has touched is cleaned and sanitized. Personal items of the child is put in bags and sent home. The child is cleaned up and put in clean clothes when needed. On 05/18/2022 ,child care staff member for Toddler 1, Ms. Danielle Klages, stated the center received a message from Child A's Mom on Sunday, April 24, 2022. Over the weekend, Child A was diagnosed with Rotavirus and would be absent from care for the week. Around that time a few children had a stomach bug. Children were out from one to three days. Some part-time children like Child A, remained out all week. Ms. Klages stated to her knowledge, only Child A was diagnosed with Rotavirus. Child A was not at the center when they were informed; however, when a child is present in care and sent home, the area and all the objects the child touched is cleaned and sanitized immediately. Ms. Klages did not notify parents in Toddler 1 of the communicable disease and is unsure if parents were notified by the administrators at the center. Generally parents are notified by administration through Brightwheel and signs on the classroom door and front door. On 05/18/2022, program director Ms. Melissa Janetzke stated Child A was the only child diagnosed with Rotavirus. Other children were out with diarrhea, vomiting, and/or low-grade fevers. Many returned to care after 24 hours. On April 24, 2022, Ms. Janetzke received a message through Bright Wheel from Child A's Mom that said Child A was sick all weekend and would not be in care for the week. On April 25, 2022, Ms. Janetzke said she received a second message through Brightwheel stating that Child A was diagnosed with Rotavirus. Child A is part-time and was present in care on April 19, 2022, and April 21, 2022. Child A returned to care on May 2, 2022. On May 1, 2022, Ms. Janetzke said she sent a message out on Brightwheel informing the parents a stomach bug was present in the building. She said she did not inform parents of Rotavirus the previous week because she did not know it was a communicable disease or that it was on the communicable disease list. She said she knows now and will be more diligent. Ms. Janetzke said the building follows regular cleaning and disinfecting in each room. If a child is sick in one room and they have a sibling in a different room, they increase cleaning in the sibling's classroom as well. When a child is in care and becomes ill, the child is separated from the group, remaining in the classroom supervised, until the parent picks the child up. Tutor Time Learning Center, LLC has a written procedure for contacting parents after a serious accident, illness, or injury. The policy states, "A parent/guardian must be notified immediately or a soon as practicable". Tutor Time Learning Center, LLC has a written procedure for contacting parents after a serious accident, illness or injury. The policy states, "A parent/guardian must be notified immediately or a soon as practicable". On 07/23/2020 Ms. Dejeagher did not notice any injury or scratch to Child A's face; therefore, Child A's Guardian was not notified. Upon finding out that there may have been a scratch on Child A's nose from falling off the scooter, Ms. Dejeagher completed an incident report.

alleaation'- 10 on 08/10/2020, Ms. Williams reported that on 08/0612020 all the school-age children were asked to write down 25 nice words to help them remember to use nice words when speaking to each other. Ms. Dejeagher spoke to Child A's Guardian when she *ilckeder up that day and told her that Child A had said that she Ms. Williams provided two incident reports that were date ; both Ms. Dejeagher had completed. Both reports had been signed and dated by Ms. Williams and Child A's Guardian on 08107/2020. Ms. Williams said the signature dates were incorrect because Child A was not in attendance on 08/07/2020, the correct signature dates should have been 0810612020. The incident reports stated: Incident Report #1. The times the incidents were reported to Child A's o Guardian via Brightwheel were 10:30 a.m. and 4:17 p.m. "Child A tripped over a child that was sitting on the floor; she fell and had a red mark at 10:30 and at 4:17 she had a bruise when I [Ms. Dejeagher] looked at it. Incident Report #2. The time the incident occurred was 4:00 p.m. "Child A o was having a rough time with saying nice words, so we had her sit down and write some nice words. Her response was 'I [Ms. Dejeagher] talked to her and asked her why she said aWanw not to say it." The incident was reported to Child A's Guardian at 6:01 p.m. on 08/07/2020 [the correct date should have been 08/06/2020]. On 08/10/2020, Ms. Murphey reported that the week before 08/06/2020, Ms. Dejeagher had a group of children who were calling each other names. Ms. Dejeagher had spoken to Ms. Williams to ask her for some ideas about what to do. 11 Ms. Williams had suggested to her to have the children write positive words they could say to each other and so that is what Ms. Dejeagher had ail the children do. On 08/13/2020, Ms. Dejeagher reported that on 08/0612020 she had been having problems with the school-age children saying lots of negative things. She asked Ms. Williams for guidance and she told her to have the children say 10-15 words to each other and have them write the words. The activity was done with all the school-age children in attendance and Child A had chosen to write the words. Child A told her that she could not think of any nice words to write so Ms. Dejeagher tried to help her. Child A then said, "I don't want to do this. " lbs. Dejeagher said she then took Child A off to the side and asked Merwy she had said she Child A told her it was because she did not want to write the words. She said she tried to find management to ask them what to do. When she finally found Ms. Murphy, she completed the incident report. She remained with Child A for the rest of the day, never left her unsupervised and after they had discussed the activity, Child A seemed fine with the activity. "I think she was frustrated because she couldn't come up with the words". Ms. Dejeagher said that Child A made the statement about somewhere between 4:00 p.m., after she had sent a message o 1 s uardian via Brightwheel, and prior to 6:00 p.m., when Child A was picked-up for the day. She shared the incident report with Child A's Guardian when she arrived to pick Child A up at the center around 6:00 p.m. Child A's Guardian seemed more upset that she was unsure of what to do about it, as opposed to not having been notified right away. Child A's Guardian went on to tell her that Child A has said it at home as well and that Child A goes to a counselor.; however, she does not feel like the counseling is working. This was the first time Ms. lie ea her had ever had a child say anything in reference to and she was unsure of who to tell or how to report it. On 06/08/2020, Child A (7-year-old female) had a black eye and was in pain. Child A's Guardian was not notified of the black eye. P1 On 08/10/2020 and I interviewed program director Ms. Tonya Williams. Ms.Pi ams reported that she was not at the center on 06/08/2020 when Child A's Guardian picked up Child A. Child A's Mother noticed Child A had a black eye at that time. It was Ms. William's understanding that Child A had collided with another child at the center when playing outside and the child care staff member had not noticed the black eye at the time of the collision. An incident report was provided. It was completed by child care staff member Ms. Shelby Nichoson on 06/08/2020. It stated that child care staff members Ms. Nichoson and Ms. Erika Morely were present at the time of the incident. The report CI was signed and dated by Ms. Williams on 06/08/2020 and by Child A's Guardian on 06109/2020. The incident report stated the following: Child A & a group of friends were playing tag on the playground. Another teacher called over & said that two kids had ran into each other. I [Ms. Nichoson] went over to the two kids and they were upset saying they had ran into each other. I [Ms. Nichoson] asked them if they were okay. After a few seconds, Child A stated she was okay & continued playing. At pick up Ms. Autumn [Ms. Autumn Murphy, school education manager] stood near the bathroom while Child A dressed herself in her swimsuit. Ms. Autumn assisted Child A with her top but did not notice any marks at that time.': On 08/1012020 and I interviewed Ms. Nichoson. Ms. Nichoson reported that on 06/08/2020, Child A had been playing outside, just prior to being picked up for the day, when she ran into another child. She said she had not noticed any bruising at the time of the incident. She recalled that Ms. Morely, had also been outside at the time and together they had completed an incident report the next day. She said that ever since the COVID-19 shutdown, Ms. Williams and Ms. Murphy are the only two child care staff members who have been walking the children out to meet their parents when they are picked up from the center. Therefore, she never spoke to Child A's Guardian about her running into another child on the playground. ":I think we [Ms. Morely and myself] told Ms. Williams and Ms. Murphy about her running into another child." Ms. Nichoson was unsure if they had mentioned it to Child A's Guardian when she had picked her up for the day. On 081/0/202 and I interviewed Ms. Morely. She stated that she could not recall any specific incident where Child A had collided with another child on the playground and had gotten a black eye. Child A has skinned her knee before when playing outside, but she was not the child care staff member who had taken care of it for her. She said she may have helped Ms. Nichoson complete the incident report, but she was not certain. On 09/09/2020, 1 interviewed Child G's Mother. She reported that the face-to-face interactions with the child care staff members has been limited since the COVID-19 i1 shutdown. Most of the time the communication at the center has been with the individual who is working at the front desk or with the assigned child care staff member via Bright Wheel. "I think they do a pretty good job." When there is an issue, "they answer in a timely fashion." On 09/09/2020 I interviewed Child H's Mother. She reported that she has never noticed any injuries or been informed of any injures to Child H (8-year-old, female) from time Child H was in care at the center.; therefore, the center has not contacted her about any incidents. She feels like the center keeps her informed. She stated, "Some teachers [child care staff members] are better than others". On 09/09/2020 I interviewed Child I and J's Mother. She reported that most of the time the center has notified her when Child I (8-year-old, male) and Child J (8-year- old, male) have had a scratch or been hit by another child. There was one incid On 0712312020, Child A's Guardian noticed a scratch on Child A's face. She was not notified of the scratch. On 08/10/2020, Ms. Williams stated that it was her understanding that on 07/2312020 Child A had said that she had fallen off a scooter. When Child A's Guardian picked her up from the center at the end of the day, she had noticed a scratch on Child A's face. When Ms. Williams talked to Ms. Murphy about the scratch Ms. Murphy had commented that she did not know what had happened. On 08/10/2020, Murphey reported that on 07/23/2020 child care staff member, Ms. Hannah Dejeagher had been outside on the playground when Child A had gotten injured while playing on a scooter. Ms. Dejeagher reported to her that she had not seen any marks on Child A's face at the time of the incident. An incident report dated 07/24/2020 was signed and dated by Ms. Murphy and Child A's Guardian on 07/24/2020; the person who completed the form was not identified. The incident report stated the incident took place on 07/23/2020 at 5:00 p.m.. The report stated: `:Child A fell on the playground yesterday and scraped her elbow. At pick- up Child A's Guardian noticed a scratch on her face and a red mark on her cheek. Cried. At pick-up Child A stated she fell of [off] a scooter and hit her face on the ground." On 08/10/2020, Ms. Nichoson and Ms. Morely both reported they were not working with the school age children on 07/23/2020. On 08/13/2020, Ms. Dejeagher reported that on 07/23/2020 Child A had been outside running on the bike track when she got caught up and fell. She had started to cry and when she helped her stand up, she noticed she had a scrape on her elbow. She cleaned up the scrape and placed a band-aid on it. Child A returned to playing outside. Ms. Dejeagher left approximately ten minutes later to go home and was not present at the center when Child A was picked up by Child A's Guardian. "I let the other staff member know about the incident. I never notified Child A's Guardian. The next day Child A's Guardian asked why she was not notified. Child A's Guardian was upset and asked me to call her before I go home. Child A's Guardian said she had a scratch by her nose....I never noticed that. Ms. Murphy asked me to do an incident form and an observation form." On 09/11/2020 I interviewed Child A's Guardian. Child A's Guardian reported that when she had picked Child A up from the center on 07/23/2020 and she was buckling her into her car seat, she noticed Child A had a scrape on her face. Child A told her that she had fallen off a scooter and had scratched her face. Child A's Guardian went directly back into the center and asked Ms. Murphy if she knew what had happened. Ms. Murphy told her she did not know what had happened and that she would have to talk to Child A's teacher. Child A's Guardian called Ms. Conroy again and Ms. Conroy told her that the center would be doing some more training. Child A's Guardian confirmed that she signed and dated an incident report the next day, 07/24/2020. She further reported that she knows children get hurt when attending child care, but Child A had previously received a black eye when she had bumped heads with another child. None of the child care staff members had noticed the black eye and Child A's Guardian was not notified. She stated, "If it is a head injury, I'm supposed to be notified. I'm noticing these marks and no one is noticing the injuries on my kid." Child A's Guardian provided pictures she had taken of the scrape she had noticed that day on Child A's face. On 09/17/2020 I interviewed Ms. Murphy. Ms. Murphy reported that on the 07/23/2020 she had walked Child A from the outdoor playground to the front of the center to meet Child A's Guardian at the end of the day. They had just walked out of the center when Child A's Guardian came back inside. Child A's Guardian said she had noticed a mark on Child A's face and she wanted to know what had happened.
