A childcare staff member (CCSM) grabbed Child A IM -j, leaving an oval shaped bruise on his right arms Ms. Warner said she is aware of the incident. She said on January 18, 2023, during overnight care, Child A was reportedly flipping off of his cot and climbing on tables. She said CCSM, grabbed Child A as he climbed on the table. When she grabbed him there was an injury that resembled a scratch, more than a bruise. Ms. Warner presented a photograph of Child A's injury. The injury in the picture appeared to be a circular/oval shaped scratch the was scabbing around the edges. Ms. Warner reported that she reviewed video footage of the incident, was suspended due to her not following their policy on lifting children and their policy on fingernail length. She does not believe that grabbed Child A out of anger or as a disciplinary measure. In the video, it appears that she reacted to prevent Child A from falling off of the table. The video is no longer available. The photograph is on file with the department. Child A is still enrolled in care. On February 8, 2023; stated that she works overnight with She was present on the night in question, but did not see the incident with ll A. ' reports she has worked at the center with for years. She has never seen providing inappropriate care or inappropriate discipline. On February 8, 2023; said she has worked at the childcare facility for 21 years and has worked with for 19 years. She has never observed ■ providing inappropriate care or inappropriate discipline. On February 9, 2023, l conducted a telephone interview with acknowledged grabbing Child A. She said around 8:30pm, Child A was flipping his cot over, climbing under and on top of the table. When he climbed on top of the table, she grabbed him trying to prevent him from harming himself. She admits that she grabbed him "the wrong way" and scratched him. She was not trying to hurt him., said she feels very bad and has apologized to Child A's Mother. She has since cut her nails down and will complete training. On February 9, 2023, l conducted a telephone interview with Child A's Mother. She said Child A told her that his teacher pinched him. She reviewed the incident on the video and does not have any further concerns. She believes the childcare handled this situation appropriately. She said that she hasn't seen and thinks that she was either suspended or fired. Child A is still enrolled in care. On February 14, 2023, Child B's Mother reported that Child B has been in care at Wonder Years for 3 years. Child B is in care overnight from 4:00pm until 2:00am. Child B's Mother does not have any concerns with the staff, or the care provided. On February 17, 2023, during the pre-disposition conference, said that there are no findings for her investigation. . APPLICABLE RULE R 400.8125 I Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times. ANALYSIS: ( Based on interviews and the admission by , there is evidence of inappropriate care resulting in an injury to Child A. CONCLUSION: I VIOLATION ESTABLISHED IV. On 11/09/2021, I spoke to Child A's Mother regarding the allegations. Child A has been attending Wonder Years Child Development Center since 09/07/2021. Child A was in the preschool classroom with Janet Adams and Bianca Wade. At enrollment, the child care center was informed of Child A's concerns (i.e., speech delay, braces on legs, and being evaluated for autism). Child A's Mother stated that she asked if they could handle him, and she was told yes. It appears that Child A's behavior has escalated in the last three weeks. There have been several issues (i.e., Child A has been injured and they require daily calls because they can't handle Child A) regarding the care that the child care center provided Child A. Three or four weeks ago, Child A stated, "Teacher hit me" and he kept saying it. Child A's Mother asked which teacher and she said specific names of the teachers at the center. Child A continued to say, "Teacher". Child A's Father told him to show him what the teacher did. He would not hit him so, Child A's Mother told him to hit mommy like the teacher hit you. Child A slapped Child A's Mother's face. Child A's parents were enraged because when she picked up Child A that day no one said anything about an incident occurring. The next day, Child A's Mother talked to LaShelle Warner on the phone about what Child A stated. She also went to the child care center to talk to them, and she was told no teacher would do that and if they did, that was cause for immediate termination. Ms. Warner said she would review the video footage from the previous day and get back to Child A's Mother. The next day she seen Ms. Warner and she said nothing. The following day, Ms. Warner said she had not gotten a chance to review the video footage because it would not let her rewind it to view. She then stated a tech guy would be out on Saturday and assured Child A's Mother that the feed would not be deleted, and she would watch it. According to Child A's Mother, no one ever got back with her regarding Child A stating that he was hit. Another incident occurred in October 2021. At pick up, Ms. Adams mention in passing that Child A had a rough day. Child A's Mother did not think much about it but when they got home, she seen that Child A was injured. He had a lump on his head and a gash. The next morning, the child care staff member at the center asked Child A's Mother what occurred to Child A's head. Child A's Mother stated that it occurred at the child care center, and she was unsure what happened. No incident report was provided to Child A's Mother regarding the incident. Then for the past two weeks, the child care center had Child A's Mother calling daily before nap time to speak to Child A about his behavior. When she spoke to Child A, she asked him to listen to his teacher, to use the potty and lay down for nap. On 11/08/2021, Child A's Mother missed the call time due to her being busy at work. Two calls were received from the child care center. Child A's Mother missed the first call at 11:55 3 a.m. Ms. Warner called back at 12:30 p.m. and she said, Child A was running around and throwing things in the office. Child A was laughing at them, and she wanted Child A's Mother to talk to him. Child A's Mother asked Ms. Warner to call Child A's Father. Child A `s Mother called Child A's Father, but he was on the phone with the child care center. Ms. Warner then called back and stated that today was his last day. Child A's Mother went to pick up Child A and her intentions was to get his belongings, pick up Child A and leave. But Child A was brought down, and he looked like he had peed on himself. She got loud and asked, "What happen?" Ms. Adams nonchalantly stated that he probably spilled some water. She was then told that there was video of Child A climbing on things and running through the school. Child A's Mother stated that she yelled, "then where is the video of the teacher hitting Child A?" She received no response, so she took Child A and left.
