  On 3/21/2023 the department received an Incident Report that stated on 3/20/2023 while at home, Child A was caught by Child A's mother, with her pants down with another family member and they were touching each other. Child A's Mother said that Child A told her that she "got it from three girls at her school while they are in the bathroom". Child A had informed her mother that she reported the incident to Child Care Staff Member 1(CCSM) who was standing at the bathroom door and was told to go to the classroom. I conducted an on-site inspection at the facility on 3/28/2023. Anitra Jones, the Program Director was present. She said that CCSM1 informed her that Child A's Mother sent her a text on 03/17/2023 at 11:55 pm. CCSM1 did not respond to the text but informed her of the text when she arrived at work on 03/21/2023. On 3/21/2023, Child A's Mother came to the school at 3:00 pm to report to her what Child A told her over the weekend. They were not provided a time frame of when the alleged inappropriate contact may have occurred. Ms. Jones said she interviewed CCSM1 and other CCSMs to see if they were ever made aware of any allegations of inappropriate child-on-child contact. CCSM1 was unaware of any allegations, as well as the other CCSMs interviewed. I interviewed CCSM1 while on site. CCSM1 said that she is the lead teacher for Child A. She said she was initially informed that Child A said that all three girls took her into a stall and pulled her pants and touched her "Gina". Then she was later told that Child A said the incident happened on three different occasions with a different girl every time. CCSM1 said she always stands at the door when the girls go to the bathroom. There are only two stalls which means only two girls at a time is allowed in the bathroom. The doors to the stalls are left open while the girls use the toilet. There is no way that three girls went into one stall. I observed each stall in the bathroom, the stalls are very small, and it would only accommodate two small children at max. The door to the bathroom is extremely close to the stalls, which CCSM1 said she stands at the door looking into the bathroom while it is in use. CCSM1 denied that Child A told her about the alleged incident. CCSM1 reports that while the children are all in class, Child A is often told by other children "move over". Child A likes to invade other children's private space and likes to sit close to the children all the time. Child A is friends with all the children in the classroom. CCSM1 said that the text message she received from Child A's Mother asked her if the teachers go into the bathroom with the kids. She never responded to the text. Child A did not come to school on Monday, 3/21/2023, but arrived with Child A's Mother at 3:00 pm that day to address the allegation because CCSM1 never responded to the text. CCSM1 denied that Child A ever told her about an incident where someone had touched her in her private area in the bathroom. She denied ever dismissing the alleged incident, as she was never made aware of anything. I interviewed CCSM2 while on site. He said that he is the assistant teacher for CCSM1. He has never taken any of the girls to the bathroom. The girls are always 3 chaperoned by female staff members. He has never heard of any inappropriate activity between any of the children. CCSM1 reported that while in class, Child A is always touchy and friendly with the other children. I interviewed CCSM3 while on site. She reported that her classroom is next door to the bathroom. She has assisted with other children going to the bathroom if they need her assistance. She allows two kids to enter at a time, while she stands inside the bathroom door to see the stalls. She does not allow them to close the door. She has never seen or allowed any kids to share the same stall. She has never heard of any inappropriate activity with any of the children.
