Child A was one of the children who wanted me to specifically call. I told Child A's Mother the nature of my call. I asked her if she could ask her son if he had ever seen a teacher at his school hit one of his friends. She told me that Child A was asleep. She told me she would call me back later once she had the opportunity to ask him. On 12/16/2021, I contacted Child B's, (3-year-old male) Mother. I told Child B's Mother the nature of my call. I asked her to ask Child B if he has ever seen a teacher at his school hit one of his friends. Child B's Mother agreed to speak with Child B and call me back. She later returned my call and said Child B told her that Ms. Ware hit Child D. On 12/16/2021, I contacted Child C's, (3-year-old female) Mother. When I called Child C's Mother, she was driving, and Child C was in the back seat of the car. I told Child C's Mother the nature of my call. I asked Child C's Mother to please ask Child C if she had ever seen a teacher at her school hit one of her friends. Child C's Mother said, "Hey Child C, have you ever seen a teacher at your school hit one of your friends?" Child C said, "yes." I asked what teacher hit one of her friends. Child C said, "Ms. Ware." On 12/16/2021, I contacted Ms. Parker and we conferenced in Ms. Edwards, licensee designee, on a three-way call to have our exit conference. Because the center will be closed beginning 12/17/2021 until 01/13/2022, I asked Ms. Edwards to submit a Corrective Action Plan via email for the violation that is being cited in this investigation. I also request the contact information for Child D. On 12/16/2021, I contacted Child D's, (3-year-old male) Mother and I told her the nature of my call. I asked Child D's Mother to please ask Child D if he had ever seen a teacher at his school hit one of his friends. Child D said, "yes." When asked by his mother which teacher, Child D said, "Ms. Ware." I called Ms. Edwards and attempted to conference in Ms. Shirley on a three-way call. There was no answer. On 12/17/2021, I received a telephone call from Child A's Mother. She said she was very upset by the conversation she had last night. She, Child A's Father, and Child A's Grandmother asked Child A if any teachers at the school hit any of his friends. Child A said yes and told them a story about a time he got into trouble because he would not put down a toy. She said Child A was trying to tell the family the details of the incident. She believes this was the same time the center called to talk to her because he laid down on the floor and would not get up. From what she could gathered from the story, she remembers the incident very well. I received a call back from Ms. Shirley. I discussed my findings and wanted to allow her the opportunity to provide any additional information before closing my 5 investigation. Ms. Ware continued to deny using prohibited discipline with the children at the child care facility. On Friday, 12/17/2021, I received a Corrective Action Plan via email from Ms. Edwards. Ms. Edwards reported that Ms. Ware will receive disciplinary action. APPLICABLE RULE 1 R 400.8140 Discipline. (2) All of the following means of punishment are prohibited: (a) Hitting, spanking, shaking, biting, pinching, or inflicting other forms of corporal punishment. ANALYSIS: Child Care Staff Member Shirley Ware was observed spanking and hitting children's hands and the backs of their heads. Hitting and spanking are prohibited means of punishment. CONCLUSION: I VIOLATION ESTABLISHED IV. RECOMMENDATION I recommend no change in the license status. 12/21/2
