Child A's Mother said on 08/03/2023, she went to the facility and talked with Ms. Austin about what her daughter told her happened on 08/02/2023. Child A's Mother admitted she was very upset when she talked to Ms. Austin. She said Ms. Austin asked her what her last name was. She said she told Ms. Austin, "Instead of worrying about my last name, you need to worry about me jumping over this counter whooping your ass." Child A's Mother said she was upset because she felt Ms. Austin was not being truthful about what happened to Child A. She said on 08/02/2023, Ms. Austin told her daughter that she was told Child A did not get hurt when he fell but Child A's Mother said she believes Child A did get hurt when he tripped because he is disabled. Child A's Mother said licensee designee, Pageant Atterberry came in when she was talking to Ms. Austin, calmed her down, and told her she would do a thorough investigation after viewing the video footage. Child A's Mother said she spoke with Ms. Atterberry later that day and Ms. Atterberry told her that the video camera showed that Child A hit his head when he tripped up the stairs and he was screaming and hollering. She said Ms. Atterberry advised her to take him to the hospital to get checked out. Child A's Mother said, "I will drive my car through the door of the center if I need to, to make sure they take care of my baby!" On 08/03/2023, Child A's Mother said, she took the advice of Ms. Atterberry and took Child A to Henry Ford Fairlane Emergency room. On 08/08/2023, I completed an onsite inspection at the facility. I met with Ms. Austin and Ms. Atterberry. Ms. Austin said on 08/02/2023, she was informed by child care staff member 2 that as her class was walking up the stairs, Child A, tripped up the stairs. Another class was walking down the stairs at the same time. Ms. Austin said CCSM 2 said Child A landed on his side when he fell, and she checked for bruises and to see if Child A was injured. She said he did not hit his head. Ms. Austin said CCSM 2 then completed an incident report and informed her of what happened. Ms. Austin said the incident report was on her desk with other notes that needed to go home to parents. Although the center has this practice with all communications going home, Child A's sister was asked by CCSM 2 at pick up time to go into the office to sign the incident report. After Child A's sister signed the report, Ms. Austin made a copy and gave Child A's sister a copy of the incident report. Ms. Austin said she was not surprised at Child A's Mother's demeanor on 08/03/2023. She said she has come to the facility irate before and often uses profanity. 3 I spoke with Ms. Atterberry about what Child A's Mother claims she told her about the video. Ms. Atterberry denies telling Child A's Mother that Child A hit his head but admits she told Child A's Mother that if she was concerned and wanted to be certain that Child A was okay, she should take him to the hospital to get him checked out. On May 15, 2023, I conducted an unannounced onsite inspection at New Beginnings Child Care and Academy. I interviewed program director Brandee Ray and CCSM1. Ms. Ray was interviewed and said Child A's Mother told her that Child B "tickled her baby private" referring to Child A's vagina. Child B's Mother was contacted and made aware of the matter. Ms. Ray said she spoke with CCSM2 about the incident, and CCSM2 told her that she did not see Child B touch Child A. Child A was switched from CCSM2 classroom to CCSM1 classroom at Child A's Mother request and a precautionary measure, for both children. She did not want to minimize the situation or accuse Child B of doing something he did not do. Child B was suspended from school while management investigated the allegation and he scheduled changed part-time. Ms. Ray said CCSM2 does not work there anymore. CCSM1 was interviewed, and she said Child A came to her class in late April or the beginning of May. She could not recall the exact date Child A came to her classroom, nor did she not know the reasoning behind the change. After being in class for approximately two weeks she stopped coming. Child A's last day in her classroom was May 9, 2023. She denied that any incidents occurred with Child A while in her class. On July 11, 2023, I conducted a telephone interview with Child A's Mother, and she said Child A does not attend the program anymore. She removed Child A from the program because another child touched Child A inappropriately. She reported her concerns of Child A being touch inappropriately and the program director Brandee Ray assured her that the matter would be addressed. Ms. Ray switched Child A's classroom to CCSM1's and told her that Child B would be suspended. After being in CCSM1's class for week Child A came home with a button missing from her dress. She spoke with CCSM1 about the missing button but eventually disenrolled Child A from the program. On July 11, 2023, I conducted a telephone interview with Child C's Mother, and she said her child does not attend New Beginnings Head Start anymore. She said she liked the program, but it became too expensive, and she found another program for her daughter with better accommodations. Overall, she liked the staff and programing and did not have any concerns about her child's wellbeing when she attended. On July 11, 2023, I conducted a telephone interview with Child D's Mother, and she said her child attends New Beginnings Head Start. She said she like the facility and staff and has not had any concerns about her child's care while in the program. On July 13, 2023, I conducted a telephone interview with CCSM2. CCSM2 said she does not work at New Beginning Child Care and Academy anymore and she did not 3 want to discuss the complaint. She refused to answer of my questions regarding the matter. On July 14, 2023, I conducted a telephone interview with Child B's Mother, and she said Brandee Ray made her aware of the allegations against Child B. She said Child B is aware of "private areas" and he denied touching Child A. She said Child B was never suspended for school, but she did not reduce him to part-time because it made sense for her family to do so financially. On 02/17/2023, I interviewed Child A's Mother over the phone. She said she dropped Child A off in his classroom and later found him standing alone in the hallway. She believed the child care staff members (CCSM) did not know his whereabouts. On 02/17/2023, I conducted an on-site inspection at the facility. I interviewed CCSM 4. She said walked Child A's Mother around the building after dropping him to his classroom on his first day in care. She said shortly after they found Child A in the hallway outside of the cafeteria in the basement alone. Child A was supposed to be 2 with CCSM1 who had stepped into the cafeteria. She spoke with CCSM1 who stated she just stepped into the cafeteria with Child A, but he stepped back into the hallway. CCSM 4 denied that inappropriate supervision was a true infraction at this time. While at the center I interviewed CCSM1. She denied Child A was in any harm or was not being supervised. She walked him in the cafeteria and had him to wait while she opened a can of apples in the cafeteria kitchen. When she came into the hallway Child A was with Ms. White and his mother. Child A stepped back into the hallway on his own. CCSM1 said she had only taken him with her because it was his first day getting acclimated to the staff, other children, and the building. CCSM1 said she is properly trained in the centers policy regarding supervision and denied any history of inappropriate supervision. There were no other CCSMs or witnesses to interview regarding this matter. On 03/02/2023, I interviewed randomly selected preschool parents over the phone. Child B's Mother and Child C's Mother had no concerns regarding the services they were being provided by the child care center. No parent spoke of inappropriate care or supervision. On 05/10/2023, I held an exit conference with Pageant Atterberry. I explained that it was inappropriate to leave Child A unattended in the cafeteria while CCSM1 went into the kitchen. Child A should have been taken him into the kitchen so he would have not had the opportunity to leave the cafeteria. I told her the center would be cited for inappropriate supervision and a corrective action plan to address the noncompliance. She was receptive to the findings.

On 02/27/2023 Child A's Mother said when dropping Child A off to the preschool classroom, she observed two children (names unknown) sitting in highchairs. She took a tour of the center and returned back to that same classroom 3 to see the same children still seated in highchairs. She believes it had been at least 30 minutes. I interviewed CCSM 4 regarding this matter while at the center. She denied children are left in restraining place spaces or highchairs for an extended amount of time. Young children that are not able to sit at the table are placed in highchairs or feeding table for feeding. On occasion they may also sit in highchair during playtime. After feedings children are removed from the chairs and hands are washed. Loose play equipment during playtime may be placed on tables for child use during playtime if they are seated. I interviewed CCSM1, CCSM2, and CCSM3 while at the center. They all denied the children are left in highchairs for an extended amount of time. When asked the maximum amount time a child can be in restraining equipment no CCSM knew it was 30 minutes. All three guessed amounts less than 30 minutes. CCSM1 works in the preschool classrooms she stated some use feeding tables for 10 to 15 minutes. When I asked about how long it takes for them to eat, she adjusted the timeframe and changed her initial response. She then said they are seated until they are done eating and then removed. She said rarely do they use seats during play time. I asked if she was aware of the maximum amount of time a child will be on restraining equipment and she did not know for sure. I let her know that 30 minutes is the maximum amount of time, and she denied that a child is left in equipment for any longer than that amount of time. CCSM2 and CCSM3 work in the toddler rooms. They said the children don't like to be seated too long anyway. They were both aware that there should regular movement in confining equipment. During the exit conference, Ms. Atterberry explained that this classroom is for children 2 to 3 years old. On 01/26/2023, I interviewed the assistant director, Vela White. She identified Child A (2-year-old male) as the child that wears a chain or necklace. She stated that his guardian has placed an Air Tag (tracking device) necklace on him and it is tucked in his shirt and hangs well below his chest. She explained that with it tucked in his shirt, it is not a choking hazard. I shared with her that the necklace obviously is not always tucked into his shirt, because someone saw it and then expressed the concern. She believes whether tucked in or not it is not a choking hazard. She has asked child care staff members (CCSM) to keep the device tucked away. Child A has some physical limitations and is under heighten supervision by his CCSMs. Ms. White and I walked to the stairwell to observe the 2 pathway, in which the children must travel to get downstairs to the cafeteria. There are 14 steps down, followed by five steps around the corner. She said Child A's guardian is aware of the layout of the building and has asked that he navigate it unassisted as a means of physical therapy. A CCSM typically stands behind or next to him as he goes up and down the stairs to ensure his well-being. She added that he typically can keep up with the class and is not in distress once he makes it up or down the stairs. On that same day Child A's Mother was leaving with Child A for a medical appointment. I observed Child A walking out down the hallway, so I greeted his mother. On 04/20/2023 I interviewed Child A's Mother and Child B's (2-year-old male) Mother over the phone. I left a voicemail message for Child C's (4-year-old male) Mother requesting a return call. I reminded Child A's Mother that we met previously at the center and that I had a few questions for her. She said she has put the necklace on him for safety reasons. She wants to always know his whereabouts. She denied it is a choking hazard and add that he wears it all the time without incident. She would not have him to where anything that could be harmful to him. Child A attends occupational therapy and benefits from regular exercise. She is aware of the travel route to the lower level and is not concerned. Child A is working on stability and muscle development, so the walk helps. Child B's Mother said her son has been attending the center for about 4 months. She recently gave birth and is planning to send the baby to the center. She denied any concerns regarding care, ratio, and services provided by the center. On 04/20/2023, I held an exit conference with the director, Pageant Atterberry. We discussed the allegations and my investigation. I told her that I was recommending no change in the status of the license based on my inspection and interviews. She wanted it noted that since the complaint she has banned the necklace that was previously being worn by Child A.

On 01/26/2023, Mrs. Brown responded to an email asking the history of the facility as it relates to ratio compliance. She said the center has had some turnover but tries to maintain ratio. On 01/26/2023, I interviewed the Assistant Program Director (APD) while at the center. She denied that ratio is a daily concern. She stated that in the morning the toddler, preschool and pre-kindergarten class is mixed in the gymnasium and again at mealtimes. The large group may only look out of ratio, but they are not. During that time the staff maintains within the ratio requirements, often with her participation. I reminded her that the ratio is based on the age of the youngest child when the children are in a mixed group. In that instance there must be at least one childcare staff member to every eight children. Ms. White says she is aware of that ratio rule. During the inspection, I observed the center to be compliant with ratio once the children were settled in their classrooms. I saw intentional movement of children which is appropriate between the classrooms with children of the same age and age- appropriate equipment. There were two CCSMs with seven children in the Tiny Tots 1 classroom. I observe one CCSM with eight children (2-3 years old) in the Tiny Tots 2 classroom. I observed two childcare staff members with seven children in the pre- K. I observed one childcare staff member with for infants. Ms. White stated that the infants do not intermingle with the older children when they are in the gymnasium. I observed the large mixed age group of children down in the basement in the cafeteria finishing a meal. All the CCSMs, and the children traveled upstairs to their respective classrooms. While in a mixed group in basement they were within ratio. While at the center, I interviewed CCSM 1, CCSM 2, CCSM 3, CCSM 4, CCSM 5, CCSM 6. CCSM 7 and CCSM 8. I spoke with each of them reminding them of their need to maintain ratio in the classroom or when combined. Tracey CCSM 5 in the infant classroom and said they do not intermingle with the other classes. All childcare staff members were aware of ratio requirements and denied that ratio is a problem. Some said it can be difficult when another CCSMs calls off, quits, or doesn't show up for work. CCSM 8 said she lets management know if she needs help. On 02/17/2023, I conducted an unannounced follow-up inspection. The center was again in compliance with ratio requirements in the infant/toddler and preschool classrooms.

On 6/23/2022, I interviewed Child A's Guardian by telephone. She stated when she would pick up Child A she would be wet and dehydrated. She stated the center did not have any air conditioning and was extremely hot. She made the decision to remove Child A from the center because she felt they were not doing anything to make the center more comfortable. I attempted an on-site inspection on 6/24/2022 and 7/2/2022. I was unable to gain entry into the building on these dates. After conferring with the consultant, I found out I was at the wrong door. I also attempted to call the center while at the door but no one answered either phone numbers. On 7/6/2022, Brandon Robinson (licensing consultant) and myself conducted an inspection at the center. We observed the infant toddler classroom. The children were napping. The shades were drawn and there were fans on throughout the classroom. The rooms were not overly heated. We interviewed Ms. Pageant Atterberry. She stated the air conditioning unit for that part of the building was out and the church was in the process of getting it replaced. She provided documentation from the church of a proposal from the company to replace the air conditioning unit. She stated they were taking measures to keep the children cool. The hallways and gym were not affected by the unit that needed to be replaced and they take the children there. We interviewed CCSMs Tracy Taylor and Jasmine Ross. Both of them stated the rooms were not overly hot even though the air does not work. They keep the children cool and hydrated. There was cold water jugs and cups in the classroom. They also use the gym and hallways where it is cooler. On 7/8/2022, I interviewed Child B's Father. He stated he had not been in the center for a couple of weeks, but when he had been there, he did not notice the center being extremely hot. I attempted to contact Child C's Mother. I did not hear back from her. On 8/3/2022, I returned to the center. The air conditioning had not been installed. The infants and toddlers had been moved to the other side of the building. This side was air conditioned and the children could easily be kept cool. On 8/13/2022, I received notice from Ms. Atterberry that the air conditioner had been installed and the children were returned to their classroom.
