On 05/19/2023, I completed an unannounced inspection onsite at the New Beginnings Child Care & Academy #3 facility. Upon arrival I met with Licensee Designee, Vanecia Ayers. She informed me that the Program Director, Shaquita Jefferson was no longer with the center. We walked around the child care facility and I observed all six classrooms. The kindergarten classroom which serves children 5 years of age had 8 children present and 1 child care staff member. The Pre- K classroom which serves children who are 4-years of age had 11 children present and 1 child care staff member. The Preschool room, which serves children 3 - 4 year olds, had 8 children present and 1 child care staff member. The Toddler 1/2 classroom which serves children 2 years of age had 8 children present and 1 '/2-3 child care staff member. The tiny tots classroom which serves children 18 months old — 2 year olds had 3 children present and 1 child care staff member. The infant 1/2 room had 5 children present and 2 child care staff members. Each classroom was in ratio based on the age range of the children in each classroom. Ms. Ayers informed me that they recently had to let a staff member go so they have been short staffed. They have two individuals who usually work at another location who are onsite filling in. While onsite I interviewed CCSM 1, CCSM 2, CCSM 3, and CCSM 4. They all stated that the classrooms have not been out of ratio. CCSM 2 stated that they often will split children up or move them to another classroom to avoid them from being out of ratio. During the onsite inspection, I requested a copy of the attendance records, initially Ms. Ayers was unable to provide a copy to me. However, on 05/23/2023, she emailed me a copy of the center's attendance records. The records have all the children list together and does not show, which children are in each classroom. Also, the attendance records provided were not dated, therefore, I was unable to determine if the center was within the required ratio by looking at the attendance records. On 05/30/2023, I called Child A's Father, Child B's Mother, Child C Mother, Child D's Mother, and Child E's Mother. Child D's Mother hung up on me. Child A's Father, Child B's Mother and Child C's Mother had no concerns regarding the number of staff members in each classroom. Child E's Mother said that she doesn't have any concerns but did state that sometimes her children come home injured, and teachers are not able to tell her what happened. She is wondering now if it had to do with there not being enough staff members in the classroom with the children. 3

On 05/19/2023, upon arrival the children were being served lunch. The children were eating Macaroni and cheese with fruit and green beans. while onsite I did observe an old menu that was posted just inside the main entrance of the building. The menu posted was from April 2023 and there was no other current menu for the month of May posted. On 05/23/2023, Ms. Ayers emailed me a current menu. On the menu it said that on 05/19/2023, children were going to be 4 eating Meatballs with Gravy, Mash potatoes, buttered corn, and wheat rolls. There were no substitutions listed on the menu. On 05/30/2023, when I spoke to Child A's Father, Child B's Mother, Child C Mother, and Child E's Mother, they all stated that they had no concerns about the food or the menu. Child A's Father said that Child A is very picky and does not eat much so he always just feeds her when she gets home. Child B's Mother said that they do not get a menu, but they have seen it posted. Child E's Mother said that they often bring their lunch since Child E does not like the food that is served. On 06/22/2023, I called CCSM 1, CCSM 2, CCSM 3 and CCSM 4 to discuss meal and meal substitutions. CCSM 3's phone number was disconnected. I left a message for CCSM 1 and CCSM 4. I have not heard back from them at this time. did speak to CCSM 2. She stated that she is not sure how often the center substitutions are served since she does not look at the menu. The children do eat the same thing each week such as mac and cheese and she does not believe substitutions happen often. On 06/22/2023, I spoke to Ms. Ayers about meal substitutions. She said that the facility does not do meal substitutions often. Occasionally, they run out of something or do not have enough of it to serve the entire building so they will substitute it with something that they have enough of for the whole building. The day of the visit, they did not have enough meatballs for the entire building, so they made mac and cheese instead. Ms. Ayers also said that families are welcome to bring their own food as well, if it is nut free and seafood free.

On 10/12/2022, the program director, Shaquita Jefferson reported to the department that Shanique Murray hit Child A and Child B on the head. On 10/14/2022, I spoke with Child B Mother's . I discussed the allegations with Child B's Mother. Child B does not have any marks or bruises. She said she does not have any problems or concerns with the teachers at the child care center. I spoke with Child A's Mother. I spoke with Child A's Mother. She was aware of the incident that was reported regarding Child A being hit by Shanique Murray. Child A's Mother said when she picked Child A up on 10/04/2022, she could see dried-up tears on Child A's face. Child A's Mother said Child A told her that she was crying because her teacher smacked her on her head for being bad and going in the hallway. According to Child A's Mother, Child A repeated the same information twice. On 10/24/2022, I completed an unannounced onsite inspection. I arrived at 2:00 p.m. and departed at 3:30 p.m. I spoke with Shaquita Jefferson, program director. She said she received a call from one of the CCSMs who reported that Child A's Mother said Ms. Murray hit Child A on her head. Ms. Jefferson immediately reported the information that she received to Vanecia Ayers, licensee designee. Ms. Ayers came to the child care center, and they met with Shanique Murray. Ms. Murray was terminated due to the video footage that was reviewed by Ms. Jefferson and Ms. Ayers. According to Ms. Jefferson on the same day, she overheard Child B tell his mother that Ms. Murray hit him. Ms. Jefferson reported that Child B's Mother brushed it off. Ms. Murray reviewed the video footage and observed Ms. Murray hit Child B on his head. Ms. Jefferson said Ms. Murray walked by and Child B him on his head. There were no marks or bruises on Child B. LaTonya Moore, CCSM was in the classroom cleaning up at the time that M. Murray hit Child B. Her back was turned, and she did not witness the incident. Ms. Murray hit Child B on the right side of his head. Ms. Jefferson did not observe Child A being hit on the head when she reviewed the video footage. Ms. Jefferson said Child A and Child B are still enrolled at the center. On 10/24/2022, I spoke with LaTonya Moore, CCSM. She said she works in the classroom with Ms. Murray. She has never witnessed Ms. Murray hit any child on the head. Child B told his mother that Ms. Murray hit him on his head. Ms. Moore said she did not witness Child B being hit on his head by Ms. Murray. She stated that Child B was never crying on the date that he reported to his mother that Ms. Murray hit him on the head. On 10/24/2022, I attempted to interview Shanique Murray, CCSM. I was unable to leave a voicemail message. On 01/17/2023, I spoke with Ms. Murray. She said she did not hit Child A or Child B. She stated that she was cleaning Child B's nose. We spoke about her being terminated from the child care center due to the incident with 3 her hitting Child B on his head being viewed on the video footage. Ms. Murray continued to deny the allegations and did not acknowledge that she hit Child A or Child B. On 01/18/2023, I spoke with Vanecia Ayers. She said she was notified by Ms. Jefferson that Child A reported to her mother that Ms. Murray hit her on her head. Ms. Jefferson told her that she reviewed the footage and witnessed Ms. Murray hit Child B on the head.

On 03/09/2022, 1 completed an unannounced onsite Rnspec Won Ra"ewengginnninnag!Rl Rare and Academy #3. We interviewed program director Shaquita Jefferson, licensee designee Vanecia Ayers, child care staff members (CCSMs) Shanique Murray, Markitta Richardson, Chanta Tatum, and Child A. CCSM, Ms. Murray stated that she is Child A's teacher. On 03104/2022 at about 2:30 or 2:35 p.m. Child A woke up from his nap and asked to go to the bathroom. When Child A returned Ms. Murray realized that he may have wet himself and provided him his spare clothing to change. Child A was sent to the bathroom by himself both times. Ms. Murray noticed that after sending him to change his clothes he had been gone a long time. Ms. Murray went to check on Child A, she did not enter the bathroom but remained in the doorway of the bathroom. She noticed that he was crying but had changed his pants. Child A was asked why he was crying, and he did not provide a response. Child A came out of the bathroom went back to class and had his afternoon snack. Ms. Murray did not see any blood or bruising on Child A's face during snack time. Child A did not inform her of any injuries or blood. Ms. Murray was not there when Child A was picked up. Program director, Ms. Jefferson states that on 03/04/2022 after 5:00 p.m. Child A's Mother left a voicemail stating that she had a concern. On 03/07/2022 Child A's Mother and Father came to the center in the morning and were confrontational with Ms. Jefferson. They alleged that Child A had his lip busted by his teacher. Ms. Jefferson had a conference with the parents and Ms. Murray. Child A was asked to describe the incident and he was not able to put it into his own words. Child A's Mother and Father asked him questions and he was only able to provide yes or no responses or repeat what his mother or father stated. Ms. Murray provided the same information Dreviousiv stated, to Ms. Jefferson. As result of the conference CCSM, Ms. Richardson said she leaves everyday about 2:00 p.m. She was there on 03/04/2022 but, did not see or hear anything with Ms. Murray and Child A. Ms. Richardson's room is directly across from the bathroom. She does not have Child A in her class and doesn't have any regular interactions with him. CCSM, Ms. Tatum said she did not hear or see Ms. Murray with Child A although her class is also directly across from the bathroom. Ms. Tatum dismissed Child A on 03/04/2022 to his father. Child A is with Ms. Tatum at the very end of the day when classes merge. Child A appeared to be fine that afternoon and did not complain of any injuries. Ms. Tatum did not see his lipbecause he kept his mask on while in her room. Licensee designee, Ms. Ayers was phoned on 03/07/2022 by Ms. Jefferson and informed of the parent meeting that was taking place. Ms. Ayers asked to speak to Child A's Mother and told her that she would investigate the allegations further and be in touch with her. Ms. Ayers spoke with Child A's Mother on 03/08/2022 and informed her of the investigation that she had completed. The investigation consisted of taking statements from CCSM's, attempting to view video camera footage unsuccessfully, and deciding on how to proceed with Ms. Murray. Child A's Mother was informed that because Ms. Murray allowed Child A to go to the bathroom alone Ms. Murray would be written up. Ms. Ayers was not able to find any concrete evidence to impose any additional disciplinary action on Ms. Murray. Ms. Ayers offered to move Child A to another classroom since Child A would be turning, m old within the next month. Child A's Mother agreed to that transition. Child ,s other has who also attend the center and were in attendance on 03108/2022. Child A u" rned on 03109/2022. Ms. Ayers states that Ms. Murray has been with the center for years and is very calm and patient with the children. On 03/09/2022, I conducted an unannounced inspection at New Beginnings Child Care and Academy #3. During the inspection the program director, Ms. Jefferson, and licensee designee Ms. Vanecia Ayers, stated that during the parent meeting on 03/07/2022 Child A's Mother and Father alleged that Ms. Murray pushed Child A. They did not report the incident to the department. I am the consultant for the facility and did not receive any notifications. I provided technical assistance to both Ms. Ayers and Ms. Jefferson. I informed them that any time there is an allegation of inappropriate contact the department is to be notified within 24 hours of the allegation. Ms. Ayers requested that Ms. Jefferson be sent to rules training as she is a new program director. Ms. Jefferson has been referred to new rules training.

On Thursday, 06/10/2021 at 3:00pm, I received an online complaint that New Beginnings Child Care & Academy #3 has too many children for one teacher and therefore, is out of ratio. On Tuesday, 06/15/2021 I made an unannounced visit to New Beginnings Child Care & Academy. I arrived at 8:03 am and was greeted by Child Care Staff Member 1 (CCSM 1). I introduced myself and explained the nature of my visit. CCSM1 had three children in the latchkey classroom. I asked him if I could see Mrs. Brenda Atterberry, program director. He said she was not there at the time. I asked him if I could speak with the person who was in charge. He directed me to speak with Child Care Staff Member 2 (CCSM2). I walked down to the classroom where CCSM 2 was supervising children. I introduced myself to CCSM2 and explained the nature of my visit. She informed me that Ms. Atterberry, was out of town due to a loss in her family. I observed CCSM2 in a classroom with 16 children ages 1 to 6 years. Below is the list of children and 1/2 their ages who were supervised by CCSM2 on 06/15/2021. I told her that she was extremely out of ratio. She said, "yes, someone is coming soon." There were 10 children eating breakfast, while six children watched television. At 8:20am, Child Care Staff Member 3 (CCSM3) arrived. She brought another child, (Child Q, a 1-year-old male) with her. CCSM2 and CCSM3 both asked if they were within ratio now that CCSM3 had arrived. I provided Technical Assistance to both CCSM2 and CCSM3 on R400.8182(7) and explain that when there are children of mixed ages in the same room or well-defined space, then the ratio and group size is determined by the age of the youngest child. At 9:00 am Child Care Staff Member 4 (CCSM4), Child Care Staff Member 5 (CCSM5), and Child Care Staff Member 6 (CCSM6) arrived. At that time, I greeted and introduced myself to each of them. After approximately 10 minutes of them settling in, they split up the children into their respective classrooms. Below is a chart of each classroom that was in operation by 9:10am. I left New Beginnings Child Care & Academy #3 at 9:20am. On 06/17/2021 I made an unannounced visit onsite to New Beginnings Child Care & Academy at approximately 8:13am. I was greeted by CCSM1. He had three school aged children present. I asked if Mrs. Atterberry was present and he told me she was not. I asked if I could walk down to CCSM2's classroom. When I arrived at her classroom, she had eight preschoolers. After briefly speaking with her, I went to each classroom to count the child to staff ratio. Below are the number of children in each classroom. I got about 2 miles away and my phone rang. I had received a call from Mrs. Atterberry, program director. Mrs. Atterberry had arrived at the center and was told that I had just left. On 06/15/2021 I made an unannounced visit to New Beginnings Child Care & Academy # 3. I arrived at 8:03 am and was greeted by CCSM 1. He was supervising three latchkey children. I walked down to the toddler classroom where CCSM2 was supervising 16 children. CCSM2 divided the class by allowing 10 children to have their breakfast at the tables while six children watched television. At 8:20 am, CCSM3 arrived. She assisted CCSM2 with supervising breakfast. After breakfast, some of the children were allowed to have free choice with blocks and other floor equipment. At 9:00 am, CCSM4, CCSM5, and CCSM6 arrived, and all children were placed in their respective classrooms. I observed all children being supervised by child care staff members. On 06/17/2021 I made an unannounced visit to New Beginnings Child Care & Academy #3. There were 22 children and five child care staff members present. All children were in their classrooms being supervised by child care staff members.

On 06/15/2021, I made an unannounced visit to New Beginnings Child Care & Academy # 3. CCSM 1 was masked and there were three latchkey children present, all wearing masks. The children's masks were worn properly over their nose and mouth. In the infant/toddler classroom there were 16 children present. All children who were two years old and older were wearing masks. CCSM 2 was wearing a mask. Periodically, children had to be reminded by CCSM 2 to put their masks over their nose and mouth. When CCSM 3, CCSM 4, and CCSM 5 arrived at 9:00am, they were all wearing masks over their nose and mouth.

On 12/02/2021, I attempted to contact the complainant, however, there was no answer. A message was left and to date, I have not received a return call. On 11/30/2020, I conducted an unannounced inspection to the child care facility. interviewed child care staff members, Jasmine Parham, Pollen Atterberry, Jackie 2 Humphrey, and Lanasha Moore. I also interviewed licensee, Brenda Atterberry by phone, while at the facility. All child care staff member denied the allegations. The child care staff members said that the sick policy for the center has been revised and is stricter due to the COVID 19 pandemic. Children are not allowed to stay in the center if the have a running nose that is green in color and parents are called to pick up the children if they become ill while at the center. Ms. Humphrey said if children are ill they are kept away from other children until their parents arrive. Ms. Atterberry said the allegations are false. She also stated that the center's sick policy prevents children from coming to the center ill and if they are ill their parents are called. Ms. Atterberry said she believes a parent made this complaint because she recently prevented a child from coming into the center because he had green mucus coming from his nose. The parent was upset because she could not leave her children are the center. On 01/11/2021, I interviewed Child A's (3-year-old male) Mother and Child B's (1- year-old male) Mother. Both parents denied having any concerns related to the allegations. Child A's parents reports she has pulled her children out of the program because she did not like how her children were treated, however, she did not provide any details. Child B's Mother said the staff have bad attitudes. During the onsite inspection, I reviewed the center's illness policy. The policy indicates that sick children will be kept separately from the group and parents will be notified.
