R 400.1908 · R 400.1908 Capacity. (1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home.
On 04/06/2023, I conducted an onsite visit to the child care home. There were six child care children present at the time of my arrival. I observed the attendance sign-in sheets from 12/18/2022 thru 01/28/2023, as it was the time frame that was reported to be over the allowed capacity. During the timeframe, there were 10 children present from the hours of 9:00 pm to 10:15 pm, and from 10:15pm to 1:00 am, there were 7 children present. Ms. Guider reviewed the attendance with me and was able to identify which children were present during the hours that caused her to be out of compliance. She stated that she had been aware of the issue and had asked the mother to change the drop off hours. The fourth child in question only attended the daycare home during a four-week time frame before and after the holiday. One of mother's was having a problem with getting the hours switched to a later time, and she chose to work with her to allow her time to find an alternative plan, which took about six weeks. The mother eventually found help and was able to drop her three children off later. Once the change was made this brought the capacity back into compliance with only having 6 children present at any given time. There was also an assistant childcare staff member present in the home during the hours the 10 children were present. The licensee was very remorseful for her actions and stated that she understood the violation and under no circumstances would she do it again to help a parent. I also observed random attendance sheets from 01/29-2023- 03/31/2023, and there were no discrepancies found. I spoke to the complaint source on 4/10/2023. She provided me with a spreadsheet of the billed hours during the specific time frame. She said it was for 10 children for the late-night shift at the home. She found no discrepancies other than the ones for the timeframe of 12/18/2022 through 01/28/2023. I made attempts to call the Child A, Child B and Child C's Mother, there was no answer. I have not received a return call to date.
