I interviewed the complainant on 12/20/2022. It was reported that Child A was seen in his highchair facing the window with his hands hogtied with scotch tape. The incident was reported to the director at the time, and no other information was provided. The incident allegedly happened sometime in early November 2022. During the onsite on 12/19/2022, I interviewed the Licensee Designee, Cheryl Robinson. She was informed of the allegation, and she stated that the incident did occur approximately 2 months prior. She stated that Child Staff Member, Makhia Whitehead, put scotch tape on Child A's hands. She was not present in the room at the time of the incident, but she did go into the room and observed that Child A's hands were tied with scotch tape. She was informed that Child A had been spitting 2 and throwing things, and CCSM, Ms. Whitehead tied his hands in an attempt to stop him. She said she did not inform Child A's Mother of the incident, but she did have a conversation with CCSM, Ms. Whitehead and explained to her that she could not do that again. Ms. Robinson reported that CCSM Ms. Shontay Smith was reportedly in the room and observed the whole incident but did not report it to her when it happened. She confronted Ms. Smith about the incident and not reporting it immediately, and they had a disagreement. Ms. Smith was later terminated from her employment. I spoke to CCSM, Ms. Whitehead. I asked if she remembered taping Child A's hands and she responded yes. I asked if she remembered why she did it, and she said no, but that she thought it was to stop him from doing something. I asked if she understood that she was not allowed to tie any child's hands, and she stated yes. I spoke to the complainant on 12/20/2022. She reported to Ms. Robinson that she saw Child A's hands hogtied with the tape. She doesn't know what else transpired. She was informed that Child A had been throwing things and maybe that was the reason Ms. Whitehead put the scotch tape on his hands. I interviewed CCSM, Maia Bragg while on site. She stated she walked into the preschool classroom at the same time Ms. Robinson walked in. She also saw the scotch tape on Child A's hands. She was told he had been tied that way for approximately 5 minutes. She documented the incident. I interviewed CCSM, Raeshonda Roberson. She stated she was present in and out of the room with Ms. Whitehead. She saw Child A had been spitting a lot and he was placed in a highchair. She stated Ms. Whitehead put a mask on Child A's face and he kept taking it off. She did not realize that Ms. Whitehead had also put scotch tape on Child A's hands until Ms. Robinson and Ms. Bragg walked into the room. I contacted Child A's Mother on 12/20/2021. She reported that she was not informed of the incident until 12/19/2021. She stated that Ms. Robinson called her and informed her that Child A had been placed in a highchair and tied with scotch tape by Ms. Whitehead. She said she had several questions because it appeared that this only happened to Child A. The incident "rubbed her the wrong way" because she has always felt some type of tension with staff members when she goes to the center. She feared that something was happening to Child A while at the center. She was informed that the incident occurred in November. Child A is still attending the center. 3

R 400.8101 · R 400.8101 Definitions: (g) "Child care aide" means an individual who is 17 years of age, who provides services and participates in child care activities in a child care center, who shall not have unsupervised access or provide unsupervised care or supervision of children, and who has satisfactorily completed at least 1 year of a vocational- occupational child care aide training program approved by the department.
On April 14, 2021, I initiated the investigation during an unannounced on-site visit. During the visit, I interviewed the program director Cheryl Robinson, and child care staff members Idria Robinson and Michael Whitehead. Child Care Aide 1 (CCA1) and Staff Member 2 (CCA2) were present and interviewed. Ms. Robinson reported that CCA 1 and 2 come to her center daily. She stated that she has custody of them. They come the facility to do their virtual schooling. She denied that they work at the center. She stated that sometimes they may participate in activities with the child care children but not as employees and they are never unsupervised. Child care staff members Idria Robinson and Michael Whitehead both reported that alleged CCA 1 and 2 are there doing their school work. They both reported that alleged CCA 1 and 2 are never alone with the children. Ms. Robinson and Mr. Whitehead denied that there are underaged staff members at the center. Alleged CCA1 reported that he does not work at the daycare center. He stated that he comes there every day and sits in a separate room to participate in school on his computer. Alleged CCA1 reported that neither him nor alleged CCA2 are ever unsupervised with the childcare children. He denied that he is working at the facility. Alleged CCA2 reported that she is not an employee of this childcare facility. She stated also stated that she comes their daily with Ms. Robinson and does her virtual learning from the center. Alleged CCA2 stated that whenever she plays with the children, a teacher is present. She said that she is never alone with the child care children. .................... ................................
