R 400.1911 · 1 R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.
On August 2, 2022, licensee, Gwendolyn Shivers submitted an incident report to the department with the above allegations. On August 2, 2022, I spoke with Child A's Mother. She explained that Child A was enrolled in the child care center from September 2021- November 2021 and June 2022- July 2022. Child A's Mother stated on Saturday, September 30,2022, she was talking with Child A and getting him ready for bed. She said she always has a conversation with him about how his week was at the child care home. Child A told his mother that Child B went under his bottom (using the pinching motion with his hands), between his legs, and she was laughing. He told her the story three times. Child A's Mother said Child A told her twice and told his grandmother once. The first time, Child A said Ms. Shivers was outside when it happened and the second time, he said that Ms. Shivers was upstairs. On August 23, 2022, I completed an unannounced onsite inspection. I spoke with Ms. Shivers. She said Child A attended the child care home two times per week from June 2022- July 2022. Child A did not attend the child care home after the alleged incident happened. Child A's Mother told her that the incident happened in the basement. Ms. Shivers said that she reviewed the camera footage from 06/07/2022 — 07/13/2022, the video footage did not show Child B near Child A. When she reported to Child A's Mother that she did not see anything of concern on the video footage. Child A's Mother told her that she did not want to take any further action. Ms. Shivers said she has never received allegations regarding Child B or any other child touching another child in an inappropriate manner. Ms. Shivers said children are never left alone, and they are always supervised. The children do not go to the bathroom without supervision. Ms. Shivers notified Child B's Mother about the allegations. On August 23, 2022, I spoke with Child B's Mother. She said Ms. Shivers notified her of the allegations after she was informed. Child B's Mother said that when she asked Child B if she plays with Child A, she told her that she does not like boys. Child B's Mother stated that Child A has attended the child care home since she was 8 months old. She has never had any concerns with Child B's care and Child B has never had these types of allegations reported in the past.
Child B (4-year-old female) touched Child A (4-year-old male) while in the basement of the child care home. 2
