On 5/03/2023, I conducted a telephone interview with Licensee Designee, Waymond Hayes. I informed Mr. Waymond Hayes of the allegations. He denied the allegations and stated that CCSM 1 has been with the facility for a long time. CCSM 1 has a reputation for being stern with the kids, but also liked by them. There are some other CCSMs that do not like CCSM1, and he thinks the allegations were made to start problems. He denied that there have been any previous investigations regarding CCSM 1, as alleged in the complaint. 2 I conducted an unannounced visit to the center on 5/8/2023. I interviewed CCSM1 while at the center. She was informed of the allegations. She denied the allegations and said that they were not true. She was informed that the complainant reported that she dragged a female student to the bathroom. She said she does not take children to bathroom, and there is no reason she would have to drag a child. All her children in her room are very well behaved, and they know the routine. She also said there were cameras in the room, and if there was a concern that management should play them back to see if the allegations were true. She continued to state that she is strict, and she may be loud, but she never puts her finger in any kids face. CCSM 1 thinks that someone is out to get her at the center. She said some staff members not being happy and wanted others to get in trouble, and she was the target. She did make another CCSM mad recently and thinks this is a form of retaliation. CCSM 2 was interviewed on site. She is the assistant in the classroom with CCSM 1. She reported that she has never seen any harmful interaction with the children and CCSM 1. She denied the allegations and stated that the children are very well behaved in the classroom. She stated CCSM 1 is stern with the children and has their respect. She also stated that CCSM 1 would never harm any of the children. She said that she has never seen CCSM 1 put a finger in any children's face. None of the children are afraid of CCM 1 and they love her. During the onsite inspection, I was assisted by Mr. Jordan Ervin, the education manager. He stated that he has never seen CCSM 1 hit or be rough with any children. He stated that CCSM 1 is stern, she is known for playing the "Mom Role". I provided him with the dates that were reported for the alleged incidents so that he could review the cameras in the classroom for any inappropriate interaction between CCSM 1 and the children. He reported back that after reviewing the footages from the two dates given, at no time was there any inappropriate activity between CCSM 1 and any of the children. The classroom that CCSM 1 is assigned to is away from other classrooms in the building, as it located on an opposite wing. There is a set of doors that you must enter and a short hallway to get to the classroom. There is no way for any other staff member to see or observed any interaction inside the classroom except for the teachers in the room and the camera that is in the room. There was no child identified in the complaint or time of day provided for when the alleged incident occurred. The complainant stated that no child was injured nor was there a safety risk observed. On 6/1/2023, I called Child A's (5-year-old, female) Mother. She stated she has had no concerns about the care that either of the children are receiving. She stated that if there was a problem, the children would tell her. 3 •

On 04/25/2023, Child Care Staff Member (CCSM) 1 was observed grabbing a child by the back of her shirt and dragging her into the bathroom and on 04/27/2023, CCSM 1 was yelling at male child with her finger close to the child's face.

(5) Lead caregivers shall meet 1 of the following qualifications shown in Table 3: Education Coursework in Early Hours of Experience Childhood Education, Child development, or a Child-Related Field. a) Bachelor's degree or N/A N/A higher in early childhood development, or a child- related field.
On January 14, 2022, I initiated this investigation via telephone with the complainant who reiterated the information in the intake. She stated that there are lead caregivers working at the facility without the proper educational qualifications. On January 18, 2022, during an unannounced on-site inspection, Juan Ruiz identified himself as the Great Start Readiness Program (GSRP) program coordinator. The program director, Dr. Waymond Hayes was not present. Mr. Ruiz denied the allegations. He said that all lead teachers have at least a bachelor's 2 degree. Mr. Ruiz contacted Mallory Daziah in their human resources department who agreed to email transcripts for each of the lead caregivers. During the inspection, I interviewed lead caregivers LaQuinta Benn, Chinenye Brye, and Donna Horton. On January 18, 2022, LaQuinta Benn identified herself as lead caregiver in the 3 t05-year-old class. Ms. Benn said she has a bachelor's degree in Early Childhood. She is not aware of any lead caregiver working without the educational qualifications as required by the child care licensing rules. On January 18, 2022, Chinenye Brye identified herself as lead caregiver in the Early Headstart, lto2-year-old classroom. Ms. Brye said that she has a master's degree in Early Childhood Education and is currently in a PhD program. She is not aware of any lead caregivers working without the educational qualifications as required by the child care licensing rules. On January 18, 2022, Donna Horton identified herself as the lead caregiver in the GSRP, 4-year-old classroom. Ms. Horton said that she has two bachelor's degrees. One is in Art and the other in Early Childhood Education. Ms. Horton is also High Scope certified. She is not aware of any lead caregivers working without the educational qualifications as required by the child care licensing rules. On January 19, 2022, Dr. Hayes denied the allegations. He said his program must follow GSRP, Headstart and CCLB rules and regulations. Therefore, many of his staff's educational qualifications are above child care rules requirements. On January 19, 2022, and February 24, 2022, I reviewed the transcripts of each teacher. Each transcript showed that each teacher has the required educational and training qualifications.
