On 06/02/2023, I completed an on-site inspection at First Yogi's Kiddie Kare. I spoke with Chari Gray, program director, CCSM 1 and CCSM 2 regarding the allegations. The entire center was observed. In the infant room, there were two children, ages 6 weeks to 18 months, with two CCSMs. In the toddler room, there were three children, ages 18 months to 3 years, with one CCSM. In the preschool room, there were four children, ages 3 to 5 years, with one CCSM. Attendance sheets and child information cards were provided for review. According to Ms. Gray, she is the new program director at the child care center. She has been working at the center since February 2023. They have not had a parent complain that their child was pinched by a CCSM. They have not had incident of pinching at the center with the children. Ms. Gray stated that Ms. Whitlow- Tyus is rarely at the child center and she does not interact with the children or parents. The parents do not talk to Ms. Whitlow- Tyus about their concern with the child care center. Parents usually speak to CCSM 1 because she has been at the center the longest and all the parents knows her. If there is a concern a meeting is set up with Ms. Gray. Discipline is rarely used with the children. They talk to the children and have them sit down/ take a break based on the child's age. Ms. Gray stated that Child A is not enrolled at the center. Child A would be enrolled in there preschool room and there are currently eight children enrolled. According to CCSM 1, she has worked at the center since August 2022. She is the CCSM in the preschool room, the children are ages 3 to 5 years. She usually has '/2 six children daily. Child A is not enrolled in the preschool room. According to CCSM 1, they have not had a child by the name of Child A enrolled at the center since August 2022. No parent has discussed any pinching issue with her. According to CCSM 2, she has worked at the center for the past two months. She works in the toddler room and the preschool room when needed. Child A is not enrolled at the center in the toddler room or preschool room. On 06/28/2023, I spoke to Ms. Whitlow- Tyus regarding the allegations. She stated that does not interact with the children's parents. No parent has spoken to her about their child being pinched and she has not talked with any of the CCSM or Ms. Gray about the issue. If there are any concerns, the parents speak to Ms. Gray or CCSM 1. Ms. Whitlow- Tyus stated Child A is not enrolled at the center. On 06/28/2023, I spoke to Child B's (5-year-old, male) and Child C's (3-year-old, male) Mother and Child D's (4-year-old, female) Mother regarding the allegations. According to Child B and Child C's Mother, she has no concerns with the discipline used at the child care center. The CCSMs do not pinch the children. Child B is very talkative, and he tells when someone is mean to him. He has not had any concerns. 3 Child D's Mother stated that she has no concerns with the care that Child D receive at the child care center. At times, the CCSMs tone can be stern with the children but they are not pinched at the center. Child D's Mother stated CCSM 1 is a great with the children and they love her. On 06/02/2023, 06/16/2023 and 06/28/2023, I called the complainant and Child A's Mother. I left a message for the complainant and Child A's Mother. The voice mail for each of the telephone numbers are not for the listed person. To date the complainant or Child A's Mother has not contacted the department. On 06/29/2023, the March enrollment list and the daily attendance sheets for the preschool room from March, April and May 2023 were reviewed. Child A was not listed as an enrolled child, and he did not attend the center in March, April or May 2023.
It is believed that Child A (5-year-old, male) was pinch by a child care staff member (CCSM) at First Yogi's Kiddie Kare. Yolounda Whitlow- Tyus is refusing to provide any information about the incident.

Based on the interviews with the CCSMs, parents and the center observation, the center use appropriate discipline. Child A is not enrolled in the center and there is no evidence to show that CCSM are pinching children.

On 12/06/2021, I completed an onsite inspection. I interviewed, Yolounda Tyus-Whitlow, licensee designee. Ms. Whitlow said she received a telephone call from a parent who was upset that she received a call from the center to pick up her child at 2:00pm on 12/03/2021 due to it not being enough coverage. Ms. Whitlow apologized to the parent and asked her to please allow her to investigate the situation. The chart reflects the times which child care staff members were present on 12/03/2021. Child Care Staff Member T ...i .m .......e .... .I ..n ..... ........T ime Out Starla McCray 7:00am 4:00pm Shantia Biggs 9:00am 2:00pm Kierra Campbell 2:30pm 4:00pm I interviewed child care staff member Kierra Campbell. Ms. Kierra said she usually works from 12:00p.m. — 2:30p.m. daily. Ms. Kierra also assists with church duties, so she did not arrive on 12/03/2021 until 2:30pm. Child care staff member, Shantia Biggs was not present on the day of the onsite inspection. I interviewed child care staff member Starla McCray. Ms. Starla said when Ms. Shantia left at 2:00p.m. she had 15 children of mixed ages by herself. The children ranged from infants and toddlers, ages six weeks — two years, to school aged children. Ms. Kierra said she began calling parents to pick up their children so that she would not be out of ratio. The first two parents did not answer their phones. She finally reached a parent to pick up their child and they were very upset that they received the call. Ms. Starla said at 2:30 p.m., Ms. Kierra arrived, and they were in ratio. I had an exit conference with Ms. Whitlow, and she completed a corrective action plan on the center being out of ratio. Ms. Whitlow said whenever there is a problem with ratio of any kind, the staff will contact administration immediately and parents will be notified, and adjustments will be made. On 12/07/2021, I received an additional online complaint with a related allegation. I contacted the complainant. The complainant said she received a telephone call on 12/03/2021 to pick up her children due to the center being out of ratio. The complaint also said she has a difficult time reaching "The Boss." The complainant wishes to see more work come home and she is not happy with seeing new child care staff members. I explained to the complaint how being out of ratio is a licensing rule violation and how one of the possible solutions is calling parents who are available, 3 to pick up their children. I asked her if she had ever shared her concerns with the program director. She said yes, she recently met with the licensee and is looking forward to some positive adjustments. On 12/07/2021 I contacted Ms. Yolanda Whitlow regarding additional allegations. Ms. Whitlow expressed how she realizes the parents should be informed on what the children are learning daily. Ms. Whitlow said she is going to ensure staff is using their platform, ProCare to communicate with the parents. Ms. Whitlow said she is going to make a list of parents who have a more flexible schedule in the event they are out of ratio again, they won't have to call all parents. Ms. Whitlow also said she will be more accessible to the parents. Ms. Whitlow also informed me that the meeting she had with the parent resulted in a positive outcome.
