On 6/13/2023, the department received an anonymous complaint that the childcare center had placed a large play structure over concrete in the parking lot. The complainant was concerned that the children could be injured on the structure. On 6/14/2023, I conducted an unannounced inspection at the center. I interviewed the licensee deaignee, Ann Turnley. She stated she had just purchased the structure and was in the process of installing it on 6/13/2023. The area was not finished and not ready for children. The area was taped off. The workers had just put mulch on the ground. She had about 10-12 inches of mulch down. They had installed fencing 2 around the area. They had not finished building the border around the mulch. Ms Turnley stated the play structure was a commercial Little Tykes designed for children ages 4 and older. It was designed to sit on top of the mulch. She was under the impression she did not need a playground inspection as the structure was not in ground but sat on top of the mulch. Due to the size of the structure, I requested Ms. Turnley get a playground inspection and provided her with the names of playground inspectors. On 7/25/32023, Ms. Turnley informed me that the structure was not approved by the playground inspector as it was over concrete even though she had mulch down. The structure has since been dismantled and sold. The children from the center were never allowed to use it.

On 05/17/2022 I made a telephone call to the complainant regarding the allegations. The complainant said she was told by Ms. Tiffany that Ms. Turnley hits the children on their backsides. On 05/18/2022 I completed an onsite inspection. I explained the allegations to program director, Anna Turnley. Ms. Turnley said she does not hit the children. She said she does not spank the children on their backsides, nor would she ever do that. While onsite, I interviewed Ms. Tiffany regarding the allegations. Ms. Tiffany said she has never seen Ms. Turnley hit any of the children. said she did not tell the complainant that she saw Ms. Turnley hit any of the children. Ms. Tiffany said she believes the complainant is upset that she could not work at the center due to her background and is making up the allegations as a result. On 05/19/2022, I contacted child care staff member, Dell Henderson. I asked Ms. Dell if she had ever seen Ms. Turnley hit or spank the children. Ms. Dell said she has never seen Ms. Turnley hit or spank the children. Ms. Dell said she is at the center every day and would have known if Ms. Turnley hit the children. 5 ith- to discuss

On 05/25/2022, I completed an onsite inspection regarding the allegations. When I arrived onsite, I asked Ms. Turnley if she served old food. Ms. Turnley said, "absolutely not." She took me into the kitchen and opened the refrigerator. There was milk, butter, and juice inside. There were no containers of leftover food inside the refrigerator. Her freezer had frozen sausage sandwiches, chicken strips, lasagna, burgers, and chicken. Ms. Turnley also had a pantry of snacks in the kitchen. There was a menu posted of weekly meals for breakfast, lunch, and snacks. Ms. Turnley provided me with receipts that she had from her most recent grocery shopping trip, four days prior to my onsite inspection. Tiffany Brunson was present. I asked Ms. Tiffany if the center served leftover food. Ms. Tiffany said the center follows the menu that is posted, and they have a different meal every day. On 05/25/2022, during my onsite inspection, the menu matched what was served for breakfast. ..........

The freezer and pantry had different food items that had been recently bought. There is no evidence based on my observation that Ms. Turnley is serving leftover food.

On 01/15/2021, l spoke with Child A's year-old, ) Mother on the telephone. She reported that on 01/13/202 wen she ice the children up from the child care center. Ms. Anna Turnley, Licensee her regarding money that Child A's Mother owed her. According to Child A's Mother, a chair fell on Child A when Ms. Tumley was putting them out of the child care center. She reported that Ms. Turnley was snatching the children up and pushing all of them out of the child care center. On 01/ 25/2021 1 spoke with - We scheduled an unannounced onsite inspection for 01/26/2021. On 01/26/2021, I attempted to complete an unannounced inspection with ■ . The child care center was closed. On 01/27/2021, I completed an unannounced inspection with I spoke e with Ms. Tumley, she explained that Child A Mother enrolled her children on She was told to contact to ensure enrollment and payment. s. Turnley explained that on 1, she received a call from Child A's Mother. Child A's Mother gave Ms. Turnley an updated work schedule. When Child A Mother arrived to pick up her children, Ms. Turnley spoke with Child A's Mother in private. She explained that when she told Child A Mother that her was not open, she became verbally aggressive and threatened Ms. Rurney. According to Ms. Turnley Child A's Mother was upset about being asked for money. Ms. Tumley denied that there was a between her and Child A's Mother. She explained that she asked Child A's Mother to leave because she was using profanity in regard to being ask to pay for child care services for her, children. She reported that she did not physically touch any of the children and a U chair did not fall on any of the children. Ms. Turnley told us that Child E -year- 3 old, ) is her . She denied spanking any children in her home or tearing Child E'sRoaRs. ey reported that she would never harm any child. Ms. Turnley told us that the children did not return to the child care center after . She reported that the next day Child A's Mother called and the child care center down. On 03/08/2021, 1 spoke with Child E's Mother. She told me that Child A has never had any marks or bruises while was being cared for by Ms. Turnley. She ■ explained that Child E had a tear on coat however she believes it was done by another child. According to Child E's other, Ms. Turnley is a great caregiver, and she has never had any concerns with the care that her children has received. On 03/08/2021 and 03/09/2021, I attempted to complete a telephone interview with Child F's Mother. I left a voicemail message for Child F's Mother. On 0311012021, I spoke with Child F's Mother. She reported that she has never had any concerns with the care that Child F has received at the child care center.
