On 04/06/2023, Paris Howard licensing consultant received an incident report from program director Pamela Krolik. The incident report stated that on 04/06/2023, Child A and Child B was fighting over the bathroom stall and Child B put his finger in Child A's butt. On 04/07/2023, Ms. Howard spoke to Child A's Mother regarding the incident. Child A's Mother stated that Child A felt he was inappropriately touched and if there had been better supervision then maybe the incident would not have occurred. On 04/11/023, I completed an on-site inspection at Earhart Elementary- Middle School. I spoke to ACCESS 21 Century staff members, Ms. Krolik (Program Director), and child care staff members (CCSMs), CCSM 1 and CCSM 2 regarding the allegations. I also spoke to Urban Neighborhood Initiative (UNI) staff members, Shacheli Gomez (Site Director) and Christine Bell (Executive Director), regarding the allegations. Cafeteria and the bathroom were observed. The bathroom is located across from the cafeteria. The cafeteria walls are windows and the entrance to the bathroom can be seen from the cafeteria. There were 24 children, ages 5 to 12 years, with two CCSMs. According to Ms. Krolik, there is two CCSMs that works at the Earhart site. CCSMs like to take the children to the bathroom but most of the time they cannot. On 04/06/2023, there were five children in the bathroom with no child care staff member. Ms. Krolik was not at the center when the incident occurred, but she was notified of the incident. According to Mrs. Krolik, Child A and Child B wanted the same bathroom stall. Child B got into the bathroom stall first and close the door. Child C (10-year-old, male) pushed Child A into the bathroom stall with Child B. Child A and Child B began to fight. Child A fell to the ground, and he was pushed out of the stall. Child B used two hands to push Child A out of the stall on his butt. Child A pants was not down. Child A and Child B continued to fight, and they spilled out into the hallway. CCSM 1 stopped Child A and Child B from fighting. According to Ms. Krolik, Child B and Child C does not attend the ACCESS 21 Century program. They attend UNI after school program. There was a language barrier as Child B is bilingual and has limited English. Ms. Krolik spoke to the Ms. Gomez about the incident. Ms. Gomez would not provide any information about Child B and Child C to Ms. Krolik. Ms. Krolik also informed Child A's Mother of the incident in the bathroom. Child A's Mother was not upset and Child A return to the afterschool program. According to CCSM 1, she usually sends one child to the bathroom at a time to ensure the children are not playing in the bathroom. On 04/06/2023, she sent Child A to the bathroom and there were other students waiting for him to return. She was unaware that there were other children in the bathroom. A child got up and walk 3 towards the bathroom and then he called CCSM 1 's name. She turned and looked towards the bathroom, and she saw two boys fighting. Child A was hitting Child B. CCSM 1 did not know who Child B was. She went over and told them to stop. However, Child A continue to hit Child B. They finally stopped and she asked them what was going on. Child A stated Child B put his finger in my butt. Child B admitted that he stuck his finger in Child A's butt. CCSM 1 reported the incident to Ms. Krolik and to the assistant principal, Julia Pitts. Child A and Child B was interviewed, they found out that Child A's pants were never pull it down. It is believed that Child B touched Child A's butt when he was pushing him out of the bathroom stall. According to CCSM 2, she was present the day of the incident. However, she was working with the children and did not see Child A fighting. She was informed afterwards of what occurred between Child A and Child B. According to Ms. Gomez, Child B and Child C attends the UNI after school program. Child B and Child C are best friends, and they play around a lot. The children were with
On 04/06/2023, Child A (8-year-old, male) and Child B (11-year- old, male) was unsupervised, and they were fighting in the bathroom. During the altercation, Child B put his finger in Child A's butt.
