On 12/10/2021, I completed an unannounced inspection interviewed Theresa Holloway, Program Director. Ms. Holloway stated t"se of ed in were placed on administrative leave until further notice and until she had contact 4 with She stated that the child care staff would be on leave until further notice due tot e policy and procedures for the child care center. Ms. Holloway stated that she was not aware of Child A being injured on 11/24/2021. She said she did not witness Child A being injured and had not seen a bruise on Child A ear. There was not an incident report completed on 11/24/2021. When she spoke with Cassandra Tahnoose, Child Care Staff Member, Antoinae Ellis, Child Care Staff Member, and Candace Martinez, Child Care Staff Member they all stated that they were not aware of Child A being injured at the child care center and had not noticed an injury or bruise on ■ ear. Ms. Holloway said there were 7 children enrolled in the Toddler 1 classroom and there were 4 children with 3 child care staff members in attendance on 11/24/2021 throughout the day. The attendance records were reviewed and confirmed the attendance on 11/24/2021. Ms. Holloway provided child information cards for the four children who were in attendance on 11/24/2021. Holloway provided 17 incident reports for Child A. The dates ranged from The incident reports were reviewed at the child care center. ®rev"ie"we t e incident report from 11/01/2021 that indicated that Child A scratched 0 face while he was napping. The other reports described various minor injuries/incidents and whether first aid was required. The incident reports had Child A parent's signature and date that the document was signed. Ms. Holloway provided a copy of the incident report that was completed on 12/03/2021 after she received MW notification via email from Child A's parents that Child A was they discovered a bruise on• ear on Ms. Holloway provided a copy of the written statements from Cassandra Tahnoose, Antoinae Ellis, and Candace Martinez. All the statements indicated that they were contacted by Ms. Holloway regarding an unreported incident that occurred in the Toddler 1 classroom on 11/24/2021. They all responded that they were not aware of an incident or an injury to a Child A's ear in the classroom. Ms. Holloway stated that she was not aware if any of the above child care staff members had any written reprimands or concerns since they have been employed with the company. She stated that she would check with the supervisor to ensure that this information could be shared and me. She stated that she would provide an update as soon as she was informed. showed me a photo of the mark on Child A's ear and the mark on his Rcheecck . The mark on his ear was very small and the mark on his cheek was light. 5 On 12/10/2021, I completed separate telephone interviews with Cassandra Tahnoose, Antoinae Ellis, and Candace Martinez. The allegations were discussed with the child care staff members and they all stated that they were not aware of any incident that occurred in the classroom, and they did not observe an injury or bruise on Child A's ear on 11/24/2021. The incident report indicated that Child A's last day was and that he did not have any injuries on that day or the previous days. On 12/10/2021, I completed a telephone interview with Child B (1-year-old, Ra ) MMother. She stated that she did not have any concerns with the care that Child A received at the child care center. Child B's Mother stated that when Child B is injured, she receives a telephone call and an incident report. She also stated that she was concerned that she must drop off and pick up Child B at the front door and she has never seen the classroom that Child B is in. On 06/22/2021, I discussed the situation with Program Director, Ouida Jackson and Child A's Mother. The school never reported anything to her about the incident. She is concerned about improper supervision due to Child A reporting, in the past, that Child B was constantly hitting her. As a result, they were not permitted to play together without direct supervision. If Child B was able to touch her inappropriately, the staff was not providing supervision. Child A did not immediately tell her mother about the incident but mentioned it to her "later in the evening" after they arrived home from the center. She simply stated Child B touched her in her private area. Child A's Mother asked her what happened and was told, "We were in the computer area, sitting Indian style and playing meditation with our eyes closed. I felt someone touch me in my private and I opened my eyes and told him to stop." I told him I was going to tell and he asked me not to and he won't do it again." Child A refers to her vagina as her private area. She alleges the touch was over her clothing. Child A did not mention the incident to her teachers and did not report any adults were around when it occurred. Child A's Mother immediately contacted the school and reported the incident. The teachers, nor the program director knew anything about it but would investigate immediately. Child A's Mother has not had any problems or concerns with the facility and believes Child A liked the facility and did very well there. She did on occasion report Child B hit her. Child A is doing well but will not be returning to the facility. On 06/22/2021, Program Director Ouida Jackson stated she immediately began investigating the allegation after it was reported to her. She has no reason to believe anything took place based on statements from all staff members present. There were eight children in attendance the day of the incident. Supervision is ongoing at the facility especially where children have had issues in the past. In the past, Child A has accused Child B of hitting her. As a result, the supervision is increased when the two of them are present. On 06/24/2021, I contacted Child B's Mother. The school contacted her about the allegation when they learned of it. She immediately talked to Child B about it. He denied touching her in the manner alleged but stated, "She hit me and I gave her a karate chop." She's uncertain if Child B is referring to past events when mentioning the "karate chop" since the two of them no longer play together. Child B's Mother has talked to him about hitting but realize children often hit while playing, but he has never been accused of touching anyone in their "private area." The accusation surprised her. She doesn't know where he would get something like that from, at four years old, and is concerned maybe he was touched by someone inappropriately. 3 On 06/22/2021, I requested and received written statements from all staff having contact with the children the day of the alleged incident. On 06/28/2021, I conducted an unannounced investigation at the facility and inspected the space where the alleged incident took place. Child A and B's classroom is in the rear of the building. It has a small adjacent room, called the computer room. It has a separate entrance and a large window allowing teachers to observe children when using the space. The facility does not allow more than two children in the room at any given time. On 07/01/2021, I interviewed Child Care Staff Member (CCSM) Kiaira Little and Nichelle Reed. I also reviewed a written statement from CCSM, Valerie Fletcher. According to Ms. Little, she was with Child A and Child B from 06:00 a.m. to 03:00 p.m., except during her lunch hour of 11:39 to 12:39. She is adamant the incident did not take place during the time the children were with her. They did not have any direct interaction with each other due to prior allegations of hitting. Caregiver, Phyliss Long, denied hitting child. The assistant caregiver stated she has never seen Ms. Long hit any of the children. There were no marks or bruises observed on child. Child A's parent stated Child A stated "it did not hurt", when asked to demonstrate what happened.
