(13) Smoking and vaping must not occur in or during both of the following: (a) In the child care center or on real property that is under the control of the center and upon which the center is located. (b) On field trips and in vehicles when children are present.

    On 07/19/2022. I completed an unannounced onsite inspection uanquill Id A's Mother and CCSM, Ms. Linda Parker. I spoke with Ms. Adams and Ms. Stewart regarding the child care staff members employed at the child care center, children's records, video footage, and a safety plan for Child A. They both denied that CCSMs bring liquor and hookah inside the center. They stated that there were two CCSMs terminated, and they believe that these false allegations came from one or both previous staff. A sample of the child information cards were reviewed and scanned. I discussed the video footage with Ms. Adams, she stated that she would need a specific date and she would be able to provide us with the footage from the specified date. A specific date was not provided K in the complaint received by the department. Ms. Parker denied any drugs or alcohol being at the center or any staff bringing any inappropriate items to the center. On 07/19/2022, I spoke with Child A's Mother. She was not aware of any CCSM bringing liquor or hookah to the child care center. She denied ever seeing any of the CCSM's that appeared to be under the influence at the child care center. On 07/22/2022, I spoke with via phone. We scheduled an unannounced joint onsite inspection tor On 07/26/2022, I conducted another unannounced inspection at the M We interviewed Ms. Adams, Ms. Stewart, Mr. Crawford, Ms. cJoennetes,"an iner.They denied ever seeing any of the CCSM's with liquor or hookah. They also denied observing any CCSM that appeared to be under the influence. Ms. Adams, Ms. Stewart, and Mr. Crawford stated that if an employee used liquor of hookah at the child care center they would be terminated. The center has a no smoking and no vaping sign posted in the center.

    On 07/19/2022, I spoke with Child A's Mother. She reported that Child A started attending Creative Academics Center in 2021. Linda Parker has always been his teacher. Ms. Parker has complained about Child A's behavior in the classroom. Ms. Parker has reported that Child A sometimes acts out by hitting other children and refusing to listen or follow directions. According to Child A Mother, Child A has been suspended from the child care center and she was provided with documentation and explanations as to why Child A was suspended. She stated Ms. Parker has called her and told her that Child A was not behaving. Every time she received a call from the child care center regarding Child A's behavior, they provided an explanation. Child A's Mother stated the last time she received a call about Child A behavior was approximately one month ago. Child A's Mother said when Child A first started at the child care center, she had some concerns. Child A felt Ms. Parker was mean because she has a stern voice. Child A was having transitional issues because he was new to the center. She stated she has never observed Ms. Parker hit Child A or any of the children. Child A has never told her that Ms. Parker hit him. Child A's Mother said in the past Child A had a puffy eye and she thought it was allergies she gave him medication and the next day it was gone. Child A has had scratches that appeared to be from playing, Child A plays a lot, so the scratches were not concerning. There were no injuries or bruises. Child A would tell her if anyone was abusing him because he is a voiceful child. On 07/19/2022, I interviewed Linda Parker, CCSM. Ms. Parker denied the allegations. Ms. Parker was upset and kept her head "no" before the interview started. She stated she has been employed at the center for years. She said she has never physically abused or hurt any children. She said s e arrives at the Center at 6am and leaves at 4:30pm Monday- Friday. She has been Child A teacher for almost one year. ea ment 5 Ms. Parker said she has called Child A's Mother regarding his behavior because he kicks, hits staff and other children and does not listen to staff. She has not called Child A's Mother in a while due to his behavior. Ms. Parker said Ms. Adams and Ms. Steward are always aware of any phone calls made to Child A's Mother. She said when any child misbehaves, she sends the children to time out or tell them to have a seat. She stated whenever she goes in the bathroom with the children, she helps them wipe their butt or wash their hands which is daily. Ms. Parker denied ever hitting or popping Child A or any other children. She reported Ms. Birdy is the cook and prepares the food. She re orted she has talked to MDHHS in the past but has never been under investigation. because she suspects someone who got fired from center is making false allegations against her. She was informed by ■ and licensing worker that the RS is never disclosed. She was very upset and stated she has done nothing wrong but love the children and even buys them gifts. A safety plan was created. Ms. Parker agreed not to have any interactions with Child A until given further information by licensing. She agreed not to use any physical force to discipline the children. She agreed to use positive reinforcements and time out methods to discipline the children. She agreed not use any drugs or alcohol and to report any abuse or neglect. On 08/16/2022, I spoke with Ms. Adams regarding the safety plan being maintained with Child A being placed in the classroom with Ms. Parker and that another CCSM should be present. I spoke with Ms. Adams regarding Ms. Parker's aggressive demeanor and verbal outburst during her interview. Consultation was provided by I. We recommended that Ms. Parker attend training specifically related to addressing Ms. Parker's aggressive demeanor. On 08/16/2022, I spoke with Child D's Father and Child E's Mother.     On 07/19/2022, I spoke with Child A's Mother she denied any concerns about the food at the center. Child A has never complained about the food at the child care center. On 07/19/2022, I spoke with Ms. Parker. She stated that the food is never served cold to the children. Ms. Bertha Robinson prepares the food. She told us that Ms. Adams sometimes helps Ms. Bertha prepare the plates for the children. During the onsite inspection I observed the Child A eating dinner, the food was observed to be warm. On 07/26/2022, I spoke with Ms. Adams, Ms. Stewart, Mr. Crawford, Ms. Jones, and Ms. Minter. They all denied that the food is served cold to the children. I observed the children eating chicken nuggets, fries, and pineapples, the food was observed to be warm. Ms. Parker was preparing the meals and serving the food in the absence of Ms. Robinson. She reported that she checked the temperature before placing the food on the plates.

    On 09/20/2021, I interviewed Complainant. On 09/17/2021, she went to the facility to pick up a relative and Mrs. Adams asked if they could talk about an issue involving another family member. When she refused to discuss it, Mrs. Adams became upset, and a verbal argument ensued. Mrs. Adams began cussing and calling out her name; she also threatened to hit her. Complainant stated that she tried to ignore Mrs. Adams but she continued to "yell and be disrespectful." Complainant admits to becoming angry and began yelling and cussing back at her. As she walked out the door and toward her car, Mrs. Adams followed her outside continuing the argument. At one point, Mrs. Adams stated they could meet on the corner of the building and fight. Complainant had a small child with her and there were several children inside the facility, but it did not prevent Mrs. Adams' behavior. According to Complainant, there are cameras in the building and will confirm her allegation. On 09/21/2021, I received a call from Child A (1-year-old male) & B's (3-year-old male) Mother. She went to the center and requested items left by her children as she had found another facility for them to attend. Mrs. Adams had an attitude about an incident involving another family member and wanted to talk to her about it. She refused and instead wanted to talk about Mrs. Adams threatening to report her for child neglect. Mrs. Adams denied the allegation, became upset and began yelling. Child A&B's Mother admits to yelling back at her, but was "surprised" Mrs. Adams was "acting like that" in front of the kids in the building. Child A&B's Mother admits her children would sometimes arrive at the facility dirty but she did not like Mrs. Adams threatening to report her for child neglect. On 09/21/2021, I received information from Witness who observed an incident on 09/17/2021 at Creative Academics Child Care. It occurred sometime between 4 and 5 in the afternoon. Witness was on his cellular and heard some arguing. He allowed the person on the telephone to listen as it unfolded. As Witness left the barber shop, directly across the street from the facility, some yelling and "inappropriate language" caught his attention. Witness looked in the direction of the voices and observed a woman walking from the facility toward a car with a small child. Witness assumes it was a parent. She was being followed by someone from the building. He heard the person following the parent say, "Bitch, I'll whoop your ass." The parent then called the person following her a "Bitch" and they continued to argue. The person who came from inside the building continued to follow the parent to her car and argue, threatening to fight. Witness heard the parent say, "I'm not about to fight you in front of children." The parent got into her car and left. Prior to the parent pulling away, Witness saw another person take a picture of the license plate. On 09/21/2021, I conducted an onsite inspection at the facility. I observed two 4 cameras at the main entrance. One was directly inside the foyer, and another was outside. Licensee designee, Mrs. Antonia Adams was not present, but I left my card. I later sent her an email notifying her of the complaint and requested written statements from all staff who were present. Prior to leaving, I observed a barber shop, The Final Kut, directly across the street from the facility. It was close enough where a person could easily see and hear a confrontation. On 09/28/2021, I received written statements from child care staff members (CCSM's), Rayawn Harm, Janquil Stewart, Linda Parker and Brandi Jones. Mrs. Adams also provided a written statement. On 10/04/2021, I interviewed the staff members. All of the staff members denied hearing Mrs. Adams cussing or threatening to fight anyone. They report she was the victim of being cussed at and being threatened with violence. Mrs. Adams denies cussing at a parent, threatening to fight or even following anyone out of the building. She al

    R. 400.8155 Child accidents and incidents; child and staff illness (5) A center shall have a written policy detailing when children, staff and volunteers will be excluded from the center due to illness.

    Mrs. Adams stated no person at the facility has COVID 19 or any communicable disease. No child or staff is allowed at the facility if ill. She has never received a complaint from a parent regarding an ill staff person. Child A&B's Mother complained to another staff member of a staff coughing, but no child or staff have A contracted anything as a result. If anyone arrives showing signs of a communicable illness, they are immediately sent home. There's a strict policy in place regarding staff or children being sent home if showing signs of illness. She is aware of a CCSM having an occasional cough, but it's not due to a communicable disease. I asked CCSM Linda Parker, Brandi Jones and Janquil Jones about the exclusion policy regarding illness. They are familiar with the procedures and Mrs. Adams enforces them. She would never allow anyone to work while ill. Ms. Parker, Ms. Stewart and Ms. Jones deny anyone is allowed to work, or play, at the facility with a communicable disease. They have no knowledge of anyone exhibiting COVID symptoms. According to the CCSMs, Mrs. Adams would send them home right away. CCSM 1 admits to having an occasional chronic cough. She has a condition that is not contagious. She has worked at the facility for several years with it and it has nothing to do with a communicable disease.
