On 0512612023, 1 spoke to the complaint regarding the allegations.. The complaint stated that there is a mother and daughter that runs the child care home. They provide unsafe conditions for a child care home. The children were allowed to play in the front yard, all last summer. The front yard is not fenced in and the children would play in front of the home, down the street and in the driveway of the home. Several times the children would run into the street to get the ball. Vehicles drive up and down the street very fast and it is unsafe. Two weeks ago, the children were playing with the beach ball and the ball rolled to the bottom of the driveway. The child care staff member (CCSM) told a child to go and get the ball. The complaint has observed children climbing in and out of the front window of the home. The windows are on the main level of the home but are high enough the children could hurt themselves if they fall. On 05126/2023, 1 completed an unannounced inspection at Books and Nooks Kiddie Care Academy. I spoke to Jahlisa Anderson and CCSM 1. There were seven children present, five child care children and two children of the licensee, with the two CCSMs. The attendance records and child information cards were reviewed. According to Ms. Anderson the children are properly supervised at the child care home, There is always a CCSM with the children. The children play in the backyard. The toys (i.e., scooters and balls, etc.) remain in the fenced backyard. She stated the children do play in the front but not for long. They take the children and let them play in the front when it is close to picked up time. lbs. Anderson also stated that in the mornings there is approximately three children present with CCSM 1. She leaves to drop her daughter off at school and then returns to the home. Regarding the children climbing, hanging or standing on the window, Ms. Anderson reported being unaware of the incident until showed er pictures. Ms. Anderson stated the children in the photo were her children and not child care children. The pictures were from the 2021 summer and she was not licensed for child care at that time. She was unaware they were climbing in and out her son's bedroom window. She has spoken to her children regarding this being a safety issue. The pictures were received from the complainant and reviewed. I was unable to determine when and what time the photos were taken, as there was not date stamp on the pictures. I could not determine if the incident with the children climbing in and out of the window occurred during child care hours or if Ms. Anderson had a child care license at that time. According to CCSM 1, the children are always supervised. The children usually play in the back yard. At times the children are taken to the front yard, during pick up 4 times and when they get the children ice cream off the ice cream truck. While the children are in the front, waiting for parents, they play games like red light, green light. They do not have the children playing with balls. There has not been incident with the children running in the street to get a ball. CCSM 1 stated that Ms. Anderson's son, is 13 years old and he plays with his friends from the neighborhood. At times they play football and basketball in the yard. Per a forensic interview was conducted with Child A, Child B (4A earmo e Child C (4'%% year old, female) on 05/25/2023. erne are Child A reported child care is at his home. He reported that the children come over every morning. They eat breakfast, do schoolwork, eat lunch, play outside, and play with toys. He stated the kids do not run in the street and he did not remember a police chase. Child A was shown the picture of two kids near the window. He reported that he was the one standing outside of the window and confirmed that he was helping his brother out of the window. He reported that it was the bedroom window. Child B and Child C stated that they play outside in the backward with the toys. They do

On 05/26/2023, I spoke to the complaint regarding the allegations. September or October 2022, the complaint heard Ms. Anderson have an argument with her son, and he left out the home. She told him to come back in. He didn't go back into the home and then she heard Ms. Anderson say, "get the fuck out and don't come back". Her son did not have on shoes and a neighbor called the police. Child A was let back in the home when the police arrived. He did not want to clean up. According to Ms. Anderson, there was an incident with her son last year. The incident did not occur during child care hours and no child care children was involved. Ms. Anderson's son did not want to clean his room. They got into an argument, and he stormed out of the home. She could not recall, cursing at him. She contacted her mother to ask her to come talk to her son. Someone in the neighborhood contacted the police. The police spoke to Ms. Anderson and her son. They told him he had to listen and clean up his room when his mother asked him too. Her son returned to the home after the incident. Per a forensic interview was conducted with Child A, Child Ron W '23. Child A stated he did not remember an adult yelling at him, or swearing at him, or him running without shoes down street. Child B and Child C stated that no one yells at them while at the child care home. Allegations regarding Child A were address by law enforcement when it occurred in 2022. The incident did not occur during child care hours and MDHHS did not complete an investigation for this incident in 2022. On 06/14/2023, Mrs. Ellington had a telephone conference with completed and closed eir investigation. The Child Care Organizations Act allows the Child Care Licensing Bureau the ability to utilize available information, including, but not limited to, any of the following: (a) Investigative report, such as a law enforcement report and a children's protective services report. (b) Medical report. (c) Public record. (d) Child care center, group child care home, or family child care home record. (e) Inspection of the child care center, group child care home, or family child care home, as well as criminal history information to determine whether an individual is conducive to the welfare of children. Based on my interview and review of allowable information, the Child Care Licensing Bureau finds that the disposition, temperament, condition, and actions of Ms. Anderson does promote the safety and well-being of children in a licensed child care setting. On 08/01/2022, I called Child A' Mother regarding the allegations. Child A attends Ms. Anderson's home child care four times per week from 5:30am — 8:00pm. On Thursday, 07/30/2022 Child A's Mother received a call from Ms. Anderson asking was she in route to pick up Child A. Child A's Mother said she was about 2-3 exits away. When she arrived, she saw Child A on the porch with a black garbage bag in her hands that contained all of her belongings and Child A proceeded to walk to the car. Child A told her mother that she was "being kicked out of the daycare." Ms. Anderson said, "Mom can I talk to you?" Ms. Anderson told Child A's Mother that Child A could no longer attend the facility because of the constant issues between Child A and Ms. Anderson's daughter. Additionally, she explained to Child A's Mother that Child A does not listen. When Child A and her mother got in the car to leave, Child A told her mother that Ms. Anderson's daughter put her belongings in the trash bag and threw the garbage bag at her in the presence of Ms. Anderson. Child A's Mother was upset and felt her daughter was humiliated by Ms. Anderson having her daughter put Child A's belongings in a garbage bag and having her stand outside on the porch to wait for her mother to arrive. On 08/01/2022, I arrived onsite with consultant, Brandon Robinson to conduct an unannounced onsite inspection. We interviewed Ms. Anderson about the allegation. Ms. Anderson said she was on the porch with Child A because it was pick-up time for all her children. She used a garbage bag because she needed a large bag for Child A's bedding. Ms. Anderson said it was not working out with Child A being enrolled at Books and Nooks Child Care Academy. Child A had become unmanageable and did not follow directions while in care. Child A's Mother did not disclose that Child A was seeing a therapist for her disruptive behaviors and her mother did not disclose this information upon enrolling Child A. Ms. Anderson said it was not her intent to humiliate Child A. Brandon Robinson and I interviewed child care staff assistant, Bernadette Anderson. Ms. Bernadette has observed Child A not listening and being disruptive daily. Ms. Bernadette is present daily and is usually the person supervising the children from 5:30a.m.-8:30a.m. She said Ms. Jahlisa Anderson supervises from 8:30a.m. - 11:59pm. Both Ms. Jahlisa and Ms. Bernadette has spoken to Child A's Mother throughout the summer about her not listening. On 09/29/2022, I contacted three random parents who had children enrolled in Books and Nooks Child Care Academy. I asked each of them if they had any concerns about Ms. Anderson. Each of them said they did not have any concerns about Ms. Anderson. 3

On 08/01/2022, while interviewing Child A's Mother, she said one day, she asked Ms. Anderson if she could use the bathroom. She said when she went inside, the bathroom, "the toilet seat was nasty." Child A's Mother said, "there was a need for a new toilet seat because the one she saw was not sanitary for kids." Child A's Mother said, "it looked like a dumpster threw up on her floor." On 08/01/2022 while Brandon Robinson and I conducted an onsite visit, I asked Ms. Anderson if we could do a walkthrough of the premises. I went in the bathroom. I observed that the toilet seat was not cleaned and sanitized for children's use. I brought it to Ms. Anderson's attention that the toilet seat needed to be cleaned. She said she would buy a new toilet seat. On 09/14/2022, I conducted another unannounced inspection. Child Care Assistant, Ms. Bernadette Anderson was present. Ms. Jahlisa Anderson was not present. I asked Ms. Bernadette if I could please see the bathroom as a follow up from the 08/01/2022 inspection. The bathroom had a new toilet seat and shower curtain. The bathroom was clean for children's use.

On 08/01/2022, while interviewing Child A's Mother, she recalled picking up Child A one day and Child A's eyes were red. Child A's Mother asked what happened to her eyes. Child A's Mother thought her daughter had pink eye. Child A told her mother she got make up in her eyes. She said the makeup belonged to Ms. Anderson's daughter. On 08/01/2022, while interviewing Ms. Anderson, I asked her about Child A getting make up in her eyes. Ms. Anderson was aware of the incident but said Child A went into her daughter's bedroom without her permission and took her daughter's make up. Ms. Anderson said Child A must have gone in her daughter's bedroom while she was using the bathroom. Ms. Anderson made mention of Child A's disruptive behaviors and how unmanageable she was. Ms. Anderson said Child A had been told several times not to enter unapproved areas of the home. The makeup was in Ms. Anderson's daughter's room and Child A should not have gone in without permission.

08/01/2022, Brandon and I conducted an onsite inspection. There was a damaged electrical socket in the living room of the home that was hanging out from the wall. The damaged socket was in a child use space. We brought it to the attention of Ms. Anderson. She said she would have it fixed. Upon going in the basement of the home to continue the walkthrough, Brandon observed the circuit breaker box dismantled from the wall and was on the floor, with exposed wires. Brandon brought it to Ms. Anderson's attention, and she said she would have it repaired. On 09/14/2022 during an unannounced inspection, I observed that the socket had been repaired. During my exit conference with Ms. Anderson on 09/30/2022 Ms. Anderson said the box had been repaired.
