    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 12/28/2022, I interviewed Child A's Mother who said the center sent an indecent and embarrassing picture of Child A through the centers' communication system. On 12/28/2022, I interviewed Nina Hodge over the phone. She stated she did send pictures to only Child A's Mother through their communication system, Brightwheel. The picture was sent directly to the parent. There is no mass correspondence for all parents unless there is a group mailing. She said she was only trying to provide evidence of the change in the child's health status, she was not trying to embarrass Child A. She said Child A's Mother often refutes that Child A has diarrhea. I did not ask for a copy of the picture but encouraged her to always take "decent and tactful pictures". She added that she has permission to photograph Child A in her file. 2 On 12/28/2022 I conducted attempted an unannounced on-site inspection, but the center was closed for the Christmas holiday until 01/04/2023. On 01/07/2023, I conducted an onsite inspection. I observed the Brightwheel system computer system and its operation. Based on my observation of the system the center is able to send pictures of Child A's directly to his parent. While at the center I viewed the private post sent to Child A's Mother on 12/23/2022 on the center's computer. The picture was only sent to Child A's Mother and no other parents received it. I consulted Ms. Hodge to exercise caution when taking pictures of children's genitalia, as it could possibly present some legal issues, if the photos are taking out of context. On 01/12/2023. I spoke with Child A's Mother and explained how the communication system worked. Although she was not fully convinced, she still felt "like they were wrong for that". I again stated there is no evidence of inappropriate care but that I did talk to them about being decent in their photography practices.
