R 400.1934 · R 400.1934 Heating; ventilation; lighting; radon. (1) Each room that is used by children in care must have adequate ventilation and be maintained at a safe and comfortable temperature so children do not become overheated, chilled, or cold. Both of the following apply: (a) The temperature must be not less than 65 degrees Fahrenheit at a point 2 feet above the floor.
The temperature of the home was at a safe and comfortable temperature at 71 degrees.

(1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home.
On 08/12/2022, I completed an unannounced onsite inspection at Alice Harvey group child care home. I arrived at 12:15 p.m. and there were 26 children, ages 7 months to 10 years, present with Ms. Harvey and two child care 2 staff members (CCSM) at the group child care home. The two CCSM was Essie Boatwright and Demaria Catlin. According to Ms. Harvey, four of the 26 children were related to her, and the other 22 children were child care children. The four children that were related to Ms. Harvey were 4 years and under. Ms. Harvey stated that she usually does not have that many children. Ms. Harvey was asked to call the children parents and have them picked up as she is licensed for 12 children. I stayed at the home of Ms. Harvey until the facility was in compliance with the group child care home license capacity and ratio. Fifteen children were picked up by 4:24 p.m. Ms. Harvey had 11 children with three CCSM. According to CCSM, Devon Williams, Ms. Harvey provides good care to the children. She does not want to see the children left at home alone or getting hurt. She would rather provide care to the children if they need it. He has never seen Ms. Harvey have more children than she is licensed for. During the inspection, the majority of the 26 children were in the living room. The toddlers were in highchairs. The infants were being held by the CCSM or in infant seats. The children watched a movie and then Ms. Harvey read them a couple of stories. Ten children went to the bathroom, prior to lunch to use the restroom and washed their hands. The tables and chairs were set up in the dining room for the children to eat. Fourteen children were fed lunch at 1:45 p.m. The remaining 8 children had to wait because there was not seat for them. The other four children were infants and they sat in highchairs. The children were served pizza and water for lunch. They were not provided a vegetable or fruit with their meal. Some children were pick up during lunch, there was 15 children left at the group child care home. The children were laid down for nap time at 3:23 p.m. Twelve children were laid down on cots to sleep. Two toddlers were falling asleep while sitting in the highchairs and one infant was sleep in an infant seat/swing. I reviewed the daily attendance, children and CCSM records. All of the daily attendance records reviewed were not dated. It was unclear how many children were present on each day. Ms. Harvey provided me with 22 child information cards for the 26 children that was present. There were 4 child information cards missing. Six CCSM records were reviewed. In Ms. Boatwright's file, there was documentation of safe sleep training and 2018 Michigan Department of Health and Human Services (MDHHS) clearance. In Ms. Catlin's file, the assistant caregiver certification form was there. Ms. Catlin completed the top portion of the form and sign the written statements regarding abuse and neglect. In Monique Hayes file, there was updated CPR/ First Aid and signed consent and disclosure. In Essie Harvey's file, there was an eligibility letter, signed consent and disclosure form and negative TB on file. In Paula Holloway file, there was a negative TB, eligibility letter, signed consent and disclosure, updated CPR/ First Aid on file and documentation of safe sleep training. In Devon Williams file, there was 001, negative TB and eligibility letter on file. 3 On 09/29/2022, I completed an unannounced onsite inspection at Alice Harvey's group child care home. There were 11 children present with two CCSM. On 10/13/2022, I spoke to CCSM, Monique Hayes. She stated that she works in the mornings at the child care home when needed. She has not seen the child care home over capacity. Ms. Harvey usually has six to 12 children at the home each day. On 10/13/2022, I spoke to Child A's (2-year-old, female) Mother, Child B (3-year-old, female) and C's (3-year-old, male) Mother and Child D's (5-year-old, female) Mother regarding the allegations. On 08/12/2022, Ms. Harvey's group child care home was out of ratio. There were 26 children present with three child care staff members. There should have been five CCSM present.

'; r ► : INVESTIGATION: On 08/12/2022, the children's records, and daily attendance was reviewed. During the onsite inspection, there were 26 children present. Ms. Harvey had 22 child information cards and four were missing. Ms. Harvey had a large stack of daily attendance sheets. They were reviewed and all of the daily attendance sheets were not dated. It was unclear how many children were present at Ms. Harvey's group child care home on each day.
