    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 02/08/2023, an incident report was received from licensee designee Amanda Mattea regarding the allegations. On 2/13/2023, I interviewed program director, Emma Zamm. She stated she was out of the room when the incident happened. The CCSM's in the classroom informed her that Child B crawled under the bathroom stall into the stall Child A was occupying. Child A screamed out and Child B ran away. When she arrived in the classroom, Child B was on his cot and Child A was with CCSM1. She took Child B to the principal's office and reported the incident. She spoke with Child A who told her Child B crawled under the stall, touched her private parts and said "pee-pee". Both Child A's Mother and Child B's Mother were contacted. Child B's Mother disenrolled him, stated they were going to wait until he goes to kindergarten to send him to school. There is a new baby in the home and Child B is having jealousy issues and regressing in his behaviors. Child A continues to attend the school. On 2/22/2023, I interviewed CCSM1 by telephone. She stated the children were at the table eating and she was at the table with them. Child A asked to go to the bathroom. The bathroom is in the classroom, the table they were at was right outside the bathroom. Child B did not ask but snuck into the bathroom. When he came out, CCSM1 asked him if he flushed. That's when he went back and opened the door to the stall that Child A was in. Child A yelled out "teacher" and said Child B tried to touch her, she hit him, and he ran out. CCSM1 stated Child B did not crawl under the stall but opened the door. She stated that since this incident they have changed the bathroom procedures. They are no longer using the bathroom inside the classroom. Instead, they take the boys and girls separately down the hall to the bathrooms. I interviewed CCSM2 by telephone. She was in the classroom helping with the cots as the children were finishing lunch. CCSM1 came over and told CCSM2 what happened in the bathroom. Initially Child B stated he did not do anything. He then recanted and said he touched Child A and she hit him, and he ran away. When program director Emma Zamm returned from lunch, she was informed what happened. Ms. Zamm took Child B to the principal office. CCSM2 also stated after this incident, they changed the bathroom procedure, and they no longer use the bathroom located in the classroom. On 3/15/2023, I conducted an inspection at the school. I observed the bathroom where the incident had taken place. The bathroom has been made inaccessible with the sand table and cots to block the door. Ms. Zamm explained Child A was in the first stall and Child B got down on his knees and crawled under the door. While at the school, Child A's Mother came to pick her up because she was having a bad day. Child A's Mother did not want to talk at the school but gave me her number. When I tried to make contact on 3/15/2023, it was the wrong number. 4
