Based on the interviews of parents and staff Teacher 1 provided inappropriate care when she has gabbed Child A's face as a form of redirection. Additionally, staff failed to provide appropriate supervision to Child A when Child A soiled himself and remained soiled for multiple hours without staff being aware.

Based on the on-site inspection, and interviews with PD, CCSM and parents, there is no evidence of improper care and supervision. Each staff followed the center's policy for serious incidents and accidents.

On 03/12/2021, I spoke the Witness. The Witness told me that there are tripping hazards in the toddler play area, there is unleveled pavement, and spaces between the grass and sidewalks. According to the Witness the most recent incident was a 5-year-old. The name of the child was unknown. The Witness reported that the program director is aware of the above concerns. On 03/17/2021, I completed an onsite inspection. I spoke with Ms. Sarah Davey, Program Director. She explained that the holes that needed to be refilled were reported to property manager. Ms. Davey told me that the child care center has a maintenance log that is kept for the repairs that need attention. Ms. Davey told me that no children have been hurt due to the holes on the playground. She explained that orange cones are used to separate the playground. If there is an area of concern the cones are placed there for safety purposes. Ms. Davey stated that the orange cones are used to separate the playground and to define boundaries on the playground. Ms. Amanda Mclaughlin and I walked through the outdoor play area. I did not observe the outdoor playground area during the onsite inspection. I did not observe any tripping hazards or uneven pavement. There were holes in the grass in the garden where the children do not play. On 03/18/2021, I received an email from Ms. Davey, Program Director. I received photos of the playground area and sidewalk in the outdoor play area. The photos showed the playground area that the Witness reported there were areas that were not safe for the children. I received incidents from 11/2020-03/2021. The incident reports did not confirm that children were being injured due to tripping hazards, uneven payment, holes and space between the grass and sidewalks. The incident reports did not confirm that children had accidents/incidents that left the child bloody and scratched knees. I received the maintenance logs that showed the dates that maintenance repairs were requested. Ms. Davey forwarded an email dated 03/18/2021,the email was addressed to the Beaumont Property Management Company. The email confirmed the request made by Ms. Davey on November 19, 2020 to have the holes in the garden area refilled and the woodchips to be refilled. According to the email the request was not fulfilled due to budget issues. In the email Ms. Davey reports that she filled the holes with dirt at the time of the request and would like to resubmit the request for the repairs. The management company responded back and informed Ms. Davey that the request is approved, and she would inform her when she has scheduled date for the vendor to come out. 4 On 03/22/2021, I spoke with the Witness. It was reported that the ground was still elevated and was concerned about the safety of the children. I spoke with Ms. Davey, I told her that I received a call regarding concerns for the safety of the children due to the ground being uneven. I requested photos of the walkway near the toddler classroom area. On 03/23/2021, Ms. Davey sent the photos from the toddler playground area. The photos included the pavement area where the children walk out of the toddler classroom door. The photos confirmed the areas of the playground that Ms. Davey told me needs wood chips to be added as well as the garden areas that needs dirt to be added. On 05/04/2021, I spoke with Ms. Davey, Program Director, Ms. Suzette Schimm, Child Care Staff Member, Ms. Katherine Stone, Child Care Staff Member, Ms. Dana Fennessey, Child Care Staff Member, Ms. Maureen Whittaker, Child Care Staff Member, and Ms. Danielle Camardese, Child Care Staff Member. They all told me that the children are always supervised when they are in the outdoor play area. They stated that they have never witnessed a child injure themselves because of tripping hazards, uneven pavement, or space between the grass and the sidewalk in the outdoor area.
