On 4/5/2023, I conducted an unannounced inspection to the child care center. I interviewed program director, Shila Rivers. She stated that cellphones are allowed in the classrooms, but they cannot be used until staff are on break. It has not been brought to her attention regarding this allegation. On 5/17/2023, I interviewed CCSM 1. She stated that cellphones are used for emergencies only. Staff are not on their phones ignoring the children. Lessons plans are implemented, and the children are tended to. On 5/17/2023, I interviewed CCSM 2. The allegation is not true. Staff must sign a no phone policy with the program director before hire and each year after that. Staff are not using their phones in the classrooms. On 5/17/2023, I interviewed CCSM 3. The staff are engaged with the children while she is working in the room. No one uses their phones in the classroom. On 5/23/2023, I interviewed Child A's (1-year-old male) Mother. She has not observed staff ignoring the children or have concerns. On 5/23/2023, I interviewed Child B's (1-year-old male) Mother. She has not observed staff ignoring the children or have concerns. During my inspection, I did not observe staff on their cellphones. The staff were attentive to the children.

On 4/5/2023, Ms. Rivers stated there is a white board used to log the diaper changes and transferred to the Kindercare app. Parents can view their child's diaper changes and communicate with staff if something is not documented in a timely manner. 3 On 5/17/2023, I interviewed CCSM 1. Diapers are logged on the tablet after each diaper change. All staff are responsible for documenting diaper changes. On 5/17/2023, I interviewed CCSM 2. Diapers are changed within the first hour of arrival. The children are changed every two hours or as needed and documented on the app. On 5/17/2023, I interviewed CCSM 3. She stated that diapers are documented for each child. They might not be documented immediately sometimes because they must get a bottle or lie a child down. On 5/23/2023, I interviewed Child A's Mother and Child B's Mother. They do not have any concerns about diaper change documentation. During my inspection, I reviewed the Kindercare application which showed the current times of diaper changes for the infants in care. All logs were current and up to date.

On 4/5/2023, Ms. Rivers stated she has a full staff and no issues with ratio. Ms. Rivers assist in classrooms if needed. On 5/17/2023, I interviewed CCSM 1. There is no issue with ratio in the infant room. On 5/17/2023, I interviewed CCSM 2. She stated there are only four children in her room and she does not have issues with ratio. On 5/17/2023, I interviewed CCSM 3. She stated there is enough staff and she has not observed the infant rooms out of ratio. 4 On 5/23/2023, I interviewed Child A's Mother and Child B's Mother. They have not observed CCSM to child ratio not being maintained in infants. During my inspection, I observed ratio in infant A and infant B. The ratio in infant A was 5:2 and 7:2 in infant B. I reviewed sign in sheets for week 4/3/2023 through 4/5/2023. In infant A, on 4/3/2023 and 4/4/2023, the CCSM to child ratio was 6:2. On 4/5/2023, the CCSM to child ratio was 5:2. In infant B, on 4/3/2023 and 4/4/2023, the CCSM to child ratio was 8:2. On 4/5/2023, the CCSM to child ratio was 7:2.

On 07/28/2022, an unannounced investigation was conducted at the KinderCare Learning Center. I inspected the facility and interviewed child care staff member (CCSM) 1 regarding the allegation. CCSM 1 denied the incident happened as explained by Child A's Mother and stated "there's more to the story" than she has reported. Child A was not released to anyone not on the emergency card completed at enrollment. All staff is aware to check picture identification and emergency cards when an unknown person arrives to pick up a child. In addition, it is CCSM 1's practice to call the parent to ensure the card is up-to-date and the identified person is approved to pick up the child. On 05/27/2022, CCSM 1 left for the day at approximately 4:45 PM. It was a Friday before a long holiday weekend. On 07/26/2022, the facility self-reported Child A's Mother was angry and posted information on social media regarding Child A sitting in feces all day. On 07/28/2022, I interviewed CCSM 1. She denied Child A had sat in feces all day and that she smelled of "shit" as Child A's Mother had stated to her. The incident happened shortly before Child A's Mother arrived to pick her up. Staff cleaned her and immediately notified Child A's Mother. According to CCSM 1, all staff are "good" about checking the children and changing diapers or pullups as needed per the diapering policy. She believes, the feces on the inner linings of the dress was accidentally missed, but not ignored. Child A is potty trained, but staff still monitor her in the bathroom and assist when needed. Monitoring her toileting is how CCSMs learned that there were times Child A had been sent to the facility without underwear. On 04/06/2022 and 06/15/2022, CCSM 1 called Child A's Mother and informed her of Child A not having spare underwear. She was told, "Leave her bare underneath because using pull-ups would set her back." CCSM 1 was present when Child A's Mother arrived and states she expressed no problem or concerns when she entered the building and went to the classroom. Within a short time, she left with Child A without incident. CCSM 1 does not know the exact time, but she then returned and begin filming and repeatedly yelling, "She A smells of shit and had been sitting in it all day." She then lifted the dress to show the stained area. CCSM 1 repeatedly apologized for the incident. Child A's Mother ultimately went in the bathroom to change Child A's clothing and left the building. On 07/29/2022, I interviewed CCSM 4. She did not see any feces on Child A's dress or leg and would have changed her clothing had she known it was there. She would never knowingly let a child leave the facility in soiled clothing. In the past, CCSM 4 has been told by Child A's Mother not to use pull-ups so she knew not to use them but now feels "I'm damn if I do or don't." The day of the incident and at approximately 3:34 PM, Child A told her she had to use the bathroom. CCSM 4 and the six children present in her class were outside playing before parents arrived at discharge. She took the children back in the classroom and had them sit on the rug while Child A went in the adjacent bathroom. CCSM 4 positioned herself where she could monitor the children on the rug and Child A. Initially, Child A did not want CCSM 4 to watch her, but she did anyway. After about two minutes, she asked Child A if she needed help and she replied, "Yes." CCSM 4 went in the bathroom and immediately saw Child A had removed her underwear. When asked why she removed them, Child A "hunched her shoulders." CCSM 4 put on gloves and picked them up. At that time, she saw the feces and asked if she was sick. Child A told her "No." She had her stand up and they both held up the dress while CCSM 4 used baby wipes to clean her buttocks. Child A was having difficulty maneuvering the dress as it was "costume like" and had lots of tulle. CCSM 4 noticed there was no urine or feces in the toilet. She assumed Child A could not get the dress up in time and had an accident on her way to the bathroom. After cleaning Child A, she looked for underwear but found she had none. There were additional clothing and pull-ups but Child A's Mother is adamant about her no longer wearing them so she "left her bare." CCSM 4 helped Child A wash her hands and cleaned the area. Using the KinderCare app, she texted Child A's Mother about the accident and informed her of Child A not having on underwear. CCSM 4 was relieved for the day at approximately 4:10PM., and she left the building. As of this report, she is no longer working for the agency. During the onsite inspection, I observed the bathroom to have a diapering policy, disposable gloves, baby wipes, diapers and pull-ups. Child A was allowed to be at the center without anything covering her private areas until her mother arrived. On 11/18/2021, I interviewed Child A's Mother. On 11/17/2021, the day in question, Child A's Mother was in the office meeting with program director, Hollie Bentley. Child A's Mother heard Child A's (three-year-old male) name being yelled while in the office and immediately headed to his classroom. She wanted to know why she heard Child A's name being called two classrooms down from the office. Child A's Mother said child care staff member, Dejenne Toles, was working in the classroom alone. There was another staff member nearby cleaning up in another classroom. Child A's Mother was later made aware by a witness that Ms. Toles should have not been left unsupervised because she was recently hired, and fingerprints had not been cleared to work unsupervised. On 11/29/2021, I conducted an unannounced onsite inspection and interviewed Ms. Bentley. She said on 11/17/2021, around 6:00 p.m., Child A's Mother and a friend arrived to pick up Child A. While in the office, Child A's Mother heard Child A's name being called and stormed out of the office. His name was called along with "no", firm but not aggressive. Ms. Bentley followed behind them to the classroom. CCSM, Suhad Abed, was standing at the gate in the classroom gesturing for Ms. Bentley while holding Child B's hand. Child A was sitting at the table with a toy. Child A's Mother yelled asking what happened. She grabbed Child A by the hand and stated she was disenrolling him. She stated she should not hear Ms. Aded up front yelling his name. Ms. Abed was trying to explain what happened while Child A's Mother asked for Child A's belongings. Ms. Bentley stayed behind and asked Ms. Abed what happened. Ms. Abed explained, Child A and Child B were sitting at the table playing with toys. Child A hit Child B across the face. Ms. Abed observed what happened while she was vacuuming the floor. Ms. Abed called Child A's name. Ms. Toles was also in the classroom but not with the children. Her fingerprints were not cleared to work unsupervised, so she was in the classroom with Ms. Abed. 3 On 12/07/2021, I interviewed Ms. Abed. During the day in question, Ms. Abed stated that Ms. Toles was in the classroom with her. She was never left unsupervised. Ms. Abed was trying to get Child's A attention after he hit Child B across the face, she never yelled at Child A. On 12/28/2021, I interviewed Ms. Toles. She was not near Ms. Abed and Child A's Mother on the day in question. Child A's Mother never asked her anything regarding Child A's name being called. Ms. Toles never heard Ms. Abed yell at a child or Child A. On 1/4/2022, I interviewed Witness. Witness never observed Ms. Toles working alone. Witness denied speaking with Child A's Mother regarding Ms. Toles background check status. Witness stated that (CCSM's) are not allowed to work unsupervised. A review of the child care back ground check system shows that Ms. Toles was cleared to work unsupervised as on 11/09/2021.

On 11/18/2021, I interviewed Child A's Mother. Child A's Mother stated that Child A is placed in time out by Ms. Bentley more than anyone else. The last two months Ms. Bentley called Child A's Mother almost every afternoon regarding Child A's behavior. Child A's Mother stated in the past (CCSM's) or the previous program director never called about his behavior. Ms. Bentley only calls Child A's Mother once the A.M. (CCSM's) leaves for the day. Ms. Bentley calls because Child A is violent in the afternoon and Child A's Mother would have to come and pick him up. It was alleged that Child A kicked Ms. Hazime once in the afternoon, but an incident report was never provided to Child A's Mother. Recently, Child A was placed in time out by Ms. Bentley with nothing to do at the table. Child A was asked to get up from the table and join the rest of the class. Ms. Bentley told 4 him to sit back down because he misbehaved. It was explained to Child A's Mother that Child A is not supposed to sit at the table without anything to do. However, Ms. Bentley wanted Child A to sit longer because he hit someone. On 11/29/2021, I interviewed Ms. Bentley. She stated that Child A was having challenges with behavior in the class towards students and teachers. She has made several phone calls to Child A's Mother and has sent him home twice. She felt like they were on the same page. One day she was walking through the pre-kindergarten room to gather a child for a parent. Child A was punching a child, so she told him to go find something to do. She did not follow through to see where Child A went. (CCSM) Brittany Buchanan walked pass the room and told Child A to join the children on the carpet. Ms. Bentley heard Ms. Buchanan tell Child A to go back and listen to the story. She came to the room and informed her that Child A was not using "nice hands" and was not ready to re-join the group. Child A went to the table on his own. Ms. Buchanan told her that he could not sit without anything to do at the table. Ms. Bentley realized she failed to go back and follow up after she assisted the parent. On 11/17/2021, Child A's Mother and godmother arrived to pick up and asked if they could speak with her regarding his behavior. Child A's Mother felt he was being placed in time out quite often. She ended up withdrawing Child A from the center after hearing his name being called while she was in the office. Ms. Bentley provided Child A's godmother with an explanation of what happened while she waited up front for the rest of his belongings. On 12/6/2021, I interviewed (CCSM) Teresa Lampkin. She stated there were issues with Child A's behavior. Within the first week of Ms. Bentley working, Child A kicked and hit her. The following day, Ms. Bentley told Ms. Lampkin what happened. Ms. Lampkin started noticing changes in Child A's behavior with her during the morning. Child A was spitting and calling the other children names. Ms. Buchanan mentioned to Ms. Lampkin that Child A had been spending time with other family members. Around Halloween, his behavior worsened due to him watching scary movies and acting out in class. Most of this behavior occurred in the evening after she left so she did not talk to Child A's Mother about it. Ms. Bentley told Ms. Lampkin that she only called Child A's Mother twice about his behavior. Child A's Mother felt there was no structure in the evening. Ms. Lampkin stated that Ms. Bentley was not singling Child A out. Ms. Abed is very soft spoken and if she raised her voice, it was only to prevent a child from hurting another child. On 12/7/2021, I interviewed Ms. Abed. Child A hit a Child B in the face for no reason. She called out Child A's name and "no" while Child B walked away from the table crying. Child A's Mother came to the classroom asking why Child A's name was yelled. Ms. Abed never talked to Child A's Mother. She gathered his belongings and left.
