    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 3/30/2021, I spoke with Child A's mother. She was notified of the incident when it occurred and believes it was completely innocent. Child A's mother stated the facility did a great job handling the incident and that Child B and his parents have been great also. Child B was just trying to hug Child A. Child A's mother has no concerns about the quality of supervision at the facility. 3 On 3/31/2021, I spoke with licensee designee, Stephanie Stover. She stated that on 3/25/2021, caregiver, Yasmeen Molina was on the playground with eight children. Ms. Molina was completing a name to face "sweep". She started with Child A and B. They were on the top of a play structure. Ms. Molina continued down her list observing the other children. Suddenly another teacher came running from the inside of the school yelling and pointing at Child A and Child B. Ms. Molina looked at them again and saw Child B laying on Child A at the top of the play structure. The children stopped immediately when they heard yelling. Ms. Stover stated that Ms. Molina and the school principal, Mr. Attee, talked to Child A and Child B and it was apparent the children did not know it was inappropriate. According to Ms. Stover, Child A and Child B could tell the adults were concerned and that made them scared that they would get into trouble. Child B explained that he just wanted to "hug his friend". Ms. Stover did go over to the school later and Child A confided to her that she did tell Child B to stop three times and that he is her friend. Ms. Stover explained to Child A that they were not in trouble. Child A's parents spoke to Child A, and Child B's parents spoke to Child B about what kind of behavior is allowed with friends. On 4/12/2021, I observed the program at the center and spoke with caregiver, Yasmeen Molina. Ms. Molina stated that Child A and Child B often play just the two of them as they are the youngest in care. They are good children that never get in trouble. She had never seen them behaving inappropriately and had no prior concerns with them and has had no issues since. I observed both Child A and Child B. They were interacting with each other and other children in a typical and appropriate manner. Ms. Molina stated that on 3/25/2021, she had eight students outside in the afternoon. They had been outside for less than 30 minutes. She was counting children and keeping track of where each of them were. Child A and B were on one structure, and the other six children were on another structure. Ms. Molina had just done a name to face sweep and she said immediately after, a teacher from inside the school saw out of a window Child B lay on Child A. The teacher ran out and brought attention to it. Ms. Molina observed Child A laying on her stomach with her shirt pulled up. Child B was laying on Child A's back with his hands on her back. It all happened so quickly. Child A and Child B were startled and Child A said, "he just wanted a hug". Ms. Molina said it was obvious they did not know what they were doing was wrong. Consultation was given to Ms. Molina on maybe limiting the children to one area of the playground at a time to reduce the amount of space she must supervise. 4
