On 05/19/2023, the department received an incident report from licensee designee Rama Alhoussani with the above allegations. I arrived on site at the center on 5/30/2023 and conducted an unannounced visit. I interviewed Rama Alhoussani, the licensee designee. She said she was made aware of the allegations and looked at the video surveillance in the classroom. She said that nothing ever happened in the room and there was no previous incidents of the alleged behavior displayed by Child B (5-year-old male). She said that Child A's 3 Mother arrived at the school and stated that Child A (5-year-old, female) informed her that during nap time, Child B tickled her butt. Ms. Alhoussani said she, nor staff were ever informed that it was being alleged that Child B had inserted his finger in Child A's butt, until after Child A's Father came back to the center the following day. I reviewed the surveillance video while at the center on 5/31/2023. I observed Child A and Child B interacting during nap time. Child B was observed crawling over to Child A's cot 3 separate times. On the second trip, Child B pulled Child A's pants down and immediately returned to his cot. On the third trip to Child A's cot, Child B was seen pulling down Child A's pants with his left hand and inserting his right hand into her pants and removing his hand quickly. It could not be determined if Child B inserted his finger into Child A's butt. I interviewed CCSM1 while on site. She stated that during nap time on the date in question, she was at the table working on her laptop. She had 5, 4-5-year-old children. She said she normally gets up and walk around but did not on that day. She thought all the children were asleep, so she decided to look for activities for them to do. Nap time was from 12:35 pm to 1:35 pm. She admitted to having an ear pod in her ear, and she did not see or hear Child A and Child B. Child A's cot is positioned behind a bookshelf. She stated that at 1:35 pm she woke up all the children, and nothing was reported to her at the time. She spoke to Child A's Mother the following day when she (Child A's Mother) notified the center of the incident. She informed Child A's Mother, that Child A usually tells her everything that happens especially when it is someone else. Child A often tells the other children what they are supposed to be doing, but the incident was never mentioned. I observed the classroom. The teacher sits at a table by the door, and the cots are situated near the bookshelves. There are 2 cots that are not visible to the teacher while she is sitting at the table. I interviewed Child A's Mother on 5/30/2023. She reported that Child A reluctantly told her of the incident when they arrived home the same day after the incident occurred, 5/17/2023. She said Child A stated that Child B inserted his finger into her butt during nap time. She said Child A has never been around or exposed to anything like this, and for it to happen to a child, then something is not right and added that a child that does that type of thing must be exposed to that type of behavior. Child A's Mother stated that when she watched the video, she observed Child A going "limp" after Child B assaulted her with his finger. She went on to say Child A couldn't move and it was like she was dead. She thinks Child A is traumatized from the incident. She felt they were being dismissed and the center was not taking the situation seriously. Child A was not taken to be seen by a medical professional concerning this matter. I interviewed Child A's Father on 6/14/2023. He said went to the center to discuss the matter because it was not being taken seriously. He said that he was told that it was just Child A's imagination, and the children were just playing. He said CCSM 1 4 informed him that the kids were only playing and Child B tickled Child A while playing. He asked to see the video footage from the day of the incident. During the video, he noticed Child B pulled down Child A's pants

On 03/16/2021 I interviewed Child A's mother over the phone. On 03/11/2021, when she picked up Child A she was told he had spit on "Mrs. Kay" On the way home Child A who told her "Mrs. Kay" hit him and his friend on their butts because they were being bad. She has had no prior complaints regarding inappropriate discipline in the past. Child A no longer attends the center. On 03/17/2021 I conducted an onsite inspection. I interviewed the assistant director, Noura Alhoussani, who said Child A was in the preschool classroom with lead teacher, Kahijah Jaber also known as "Mrs. K." She said she was present at the center when the spitting incident occurred. She denied any knowledge or belief that Mrs. Jaber used any inappropriate discipline including hitting a child. She denied any 2 concerns about Mrs. Jaber's ability to provide appropriate care and discipline stating that she has been with the center for more than 20 years. While at the center, I interviewed childcare staff member, Kahija Jaber. She stated she is covering the preschool classroom temporally while the center is seeking a permanent replacement for Rachel Tuter. Mrs. Jaber has been serving as the lead teacher in the preschool classroom for almost two months. She denied any use of inappropriate discipline following the spitting incident or any other time. She said Child A spit in her face on purpose while she was leaned in talking to him. She then had another childcare staff member come to cover the classroom while she left to "clean up." She said she washed her face, got a face shield, and new mask. She denied concerns about her ability to supervise or discipline children. She reported having over a 20-year work history at this center and their other location. She has a signed child abuse and neglect statement of file, is qualified as a lead teacher, has no disciplinary records on file, and is eligible to work with children based on the results of her fingerprint screening. While at the childcare center I viewed the video footage in the preschool classroom 3 minutes before and when Mrs. Jaber returned to the classroom 4 minutes after the spitting incident. Upon her return she had on a face shield and again began supervising the children in the room. At no time did she hit Child A or any other child. On 04/08/2021 I interviewed Child B's (4-year-old male) mother, Child C's (1 year old male) mother, and Child D's (4-year-old male) mother over the phone. No parent had any concerns about the care their children receive at the center. On 04/30/2021 I held an exit conference over the phone with the director, Mrs. Rabah, informing her there was no evidence of the use of inappropriate discipline by Mrs. Jaber.
