    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    I conducted an unannounced investigation on 01/23/2023. Upon my arrival I was buzzed into the building by Ms. Dina Tarhini, Child Care Staff Member. I was introduced to Ms. Eaten Fawzi, the Licensee and Program Director. I had previously spoken to Ms. Fawzi via telephone on 01/19/2023. She denied the allegation that any child had been able to escape the building at any time. She said that she spoke to her Licensing Consultant, Selika Johnson and informed her of an issue she was having with a disgruntled parent and that she had been threatened by the parent to ruin her daycare business. She assumed that the allegations were made by that person because the allegations were falsified. Ms. Fawzi said that Child A's Mother (3-year-old, female) arrived at the center the previous week screaming and yelling at her. Ms. Fawzi disclosed that she had previously made a 2 complaint to Department of Health and Human Services, due to Child A saying she was afraid to go home with her mother and scared of her mother. When Child A's Mother arrived at the center, Ms. Fawzi requested to speak to her regarding the concern. Child A's Mother became very upset and then accused Ms. Fawzi of hurting Child A and called the police to the center to accuse Ms. Fawzi of abuse. Ms. Fawzi provided the parent with two incident reports involving Child A hitting others and being very aggressive at the center. A Dearborn Heights Policer Officer, Badge #237 arrived at the center and spoke to both parties and informed Ms. Fawzi if she had any other issues to contact the department. Ms. Fawzi called the Police Station later that night to report the text messaged threats she had received from Child A's Mother. I did observe text messages from a number that was also identified on Child A's information card. The messages included threats to Ms. Fawzi, her children and the child care business. Child care staff member (CCSM), Hala Alhasnawi said that she is unaware of any incident regarding a child being able to leave the building. Her classroom is located to the immediate left of the entrance door. She said that there is no way a child could have exited the building without being noticed. CCSM, Dina Tarhini said that the alleged incident never happened. Ms. Tarhini's desk is located directly in front of the exit door. She has to buzz everyone into and out of the building. The door does not open on the inside unless she hits the release button. The complainant did not leave a name or phone number. The email address that was provided was not a valid email address. There were additional allegations made, that were not addressed as there was not enough information provided when the complaint was filed. I contacted the Dearborn Police Department on 01/26/2023. I was informed by the records division that there was only a general information report written for the incident at the center. On 01/26/2023, I attempted to contacted Child A's Mother on three separate phone calls. The phone would ring and hang up. I was not able to leave a message. On 01/31/2023, I attempted to call Child A's Mother, again there was no answer, and I was unable to leave a voice mail message. The allegations of an unknown child receiving markings without the parents receiving an accident report and that a classroom is out of ratio, with the CCSM to child ratio being 1:10 was not investigated due to no identifying information being provided about which child or which classroom. On 01/31/2023, additional information was received by the department in the form of another complaint. Some of the same allegations, but no identifying information. In addition, it was alleged that the center is never cleaned or sanitize, however, I observed the facility to be clean 3 and in good repair during my onsite visit. The allegations also have been previously reported and investigated by another consultant and no violations were found.

    R 400.8182 · R 400.8182 Ratio and group size requirements. (3) In each room or well-defined space, the maximum group size and ratio of child care staff members to children, including children related to a staff member or the licensee, must be as shown in Table 4: a) Infants and toddlers, birth until 30 months of age; child care staff member to child ratio 1:4 with a maximum group size of 12.

    On 12/16/2021 and 01/04/2022, I conducted unannounced investigations and interviewed licensee Mrs. Faten Fawzi and child care staff members (CCSMs). There were no children present during the 12/16/2021 onsite but CCSM, Rana Barry denied the allegation and stated they don't have that many 2 infants and there's always enough staff. She works with the infants and allowed me to inspect the room. She also called the licensee and handed me the telephone. Mrs. Fawzi immediately denied the allegation and stated there is always enough staff and there is never that many children in either of the rooms. Parents are not allowed in the classrooms due to the current pandemic so it's not possible for any of them to accurately comment on ratio. There's typically more staff on duty than she needs. There would never be a CCSM working with 8-10 children especially infant and toddlers, without assistance. Enough CCSMs are scheduled daily and despite the low attendance during the recent holiday she continued to maintain a full staff. It's believed a former CCSM "keeps making up stories" and made the complaint out of spite. Mrs. Fawzi is surprised the allegation was made and states it's easy to prove as false by providing attendance records for me to review. On 12/16/2021 and 01/04/2022, I requested and received children and CCSMs attendance records for 11/29/2021 through 12/10/2021. The documents reveal there had never been eight -10 children in the infant or toddler room during the dates I reviewed. Further, neither room have more than 6 children enrolled. The toddler room has six while the infant room has five. Staff timecards show there are two staff persons on duty regularly, in either room, even when there are no more than three- four children present. On 01/03/2022, I called Child A's Mother, Child B's Mother, Child C's Mother, Child D's Mother and Child E's Mother. As of this entry, only Child A's Mother has returned my call. Child A's Mother loves the facility and has never seen eight-10 children with one CCSM, and she has used the facility for over a year. There is always adequate staffing. Child A (16-month-old, male) is in the infant room and is always well-cared for. Due to the current pandemic, there is limited access to the classroom, but parents can observe children and staff through a window. On 01/04/2022, I conducted a follow-up onsite inspection and spoke to CCSMs Sabrina Pinkston and Rana Barry. They were present in the infant room with four infants. They consistently work in the room and have never had more than five - six children and neither of them have ever worked alone. The reviewed attendance records support their statements. Child care staff members, Mrs. Jihan Elsayed and Mrs. Maissa Ahmad were in the toddler room with six children. They have never cared for eight-10 children and there is always two staff on duty. The reviewed attendance records support the statements. Complainant did not provide contact information so I'm unable to determine when the alleged ratio complaint was an issue. 3
