- Violation
On 05/02/2023, I completed an unannounced onsite inspection. I arrived during nap time and observed CCSM 2 in the nap room with CCSM 9. During my observation both CCSM 2 and 9 appeared to be alert and were both sitting in an upward position. I spoke with CCSM 2 regarding the allegations. CCSM denied ever being asleep while working. She shared there is one child who sleeps better if staff lie next to him and 2 demonstrate lying down for rest/nap time. She shared this particular child likes to sit in staff members' laps, and if this occurs it disrupts other children's rest routine which results in multiple children wanting to sit in staff members' laps. To avoid this there has been multiple occasions when she's lay next to the child for a short time until the child is rested and asleep. The longest has been up to ten minutes. She denied ever falling asleep and shared she's always positioned to hear and see other children. In many instances, there's a second CCSM in the class room with her. CCSM 2 said, "I can see how someone who peaks into the room would think I was sleeping; however, I am alert and have never slept while at work. She denied that any one has ever brought concerns to her attention about this, including her supervisor, Bobby Robinson. I spoke with CCSM 9 regarding the allegations. She shared she works full time with CCSM 2 and is present during nap times. She denied ever observing CCSM 2 sleeping while caring for the children. She has never had concerns regarding her sleeping while caring for the children. She said she can confirm this because she has observed her patting children, sitting next to children and on some occasions, they will talk to one another. I spoke with CCSM 8. She shared she works in the infant/toddler room, almost daily. She denied ever observing CCSM 2 sleeping during nap time. She shared someone is always in the nap room whenever there is a child resting/sleeping. She worked in the nap room with CCSM 2 on several occasions and again confirmed she's never observed her resting, lying down or appearing to be asleep. On 05/02/2023, I spoke with CCSM 3. When asked about staff sleeping during nap time, she shared she's observed CCSM 2 with her knees pulled up and her head down. She couldn't confirm if she was sleeping but shared, she wasn't paying attention to the children. There was also a separate occasion when she observed CCSM 2 lying down between two children who were sleeping on their cots. Again, she couldn't specifically confirm if she was sleeping but she believed she was due to her not talking or moving. On 05/18/2023, I completed an unannounced onsite inspection in the infant/toddler classroom. I arrived during nap time and observed a total of three CCSMs and twelve children. In the nap room, I observed CCSM 9 who was alert and sitting in a chair. On 05/30/2023, I completed an unannounced onsite inspection in the infant/toddler classroom. When I arrived, I observed children in both the sleep room and the nap room. I observed two CCSM's in the sleep room, both sitting up and alert.

During this onsite I completed an unannounced inspection of all four classrooms, Infant/toddler, A107, A109 and A111. On 05/02/2023, I observed nine infant/toddlers and two CCSM's. I reviewed attendance records for the infant classroom, and a total of ten children were signed in with the tenth child being signed out at 10:50am, leaving prior to my arrival. She identified herself, CCSM 8 and CCSM 9. She shared CCSM 9 left for lunch at 11:40am. I arrived for the onsite at 11:45am. She shared her classroom is always in compliance with ratio when she's working and denied any knowledge of the room being out of ratio after she leaves around 2pm for the day. I specifically asked about maintaining ratio during staff lunch breaks. She shared she was under the belief that as long as at least two CCSM's are present, one staff could leave for a lunch break. She was not sure how she came to this belief and denied knowing she was specifically told this by anyone. She confirmed with this new knowledge that the 1 to 4 ratio must be maintained at all times (including staff lunch breaks), she shared there has been times when the room has been out of ratio during lunch breaks, including today. 4 I spoke with CCSM 9 regarding the allegations. She shared the infant classroom in which she's assigned always maintains ratio. She denied any knowledge of the classroom being out of ratio. She reported herself, CCSM 8 and CCSM 2 as working in the room today. She confirmed CCSM 8 as being on lunch break leaving the room at 11:45am. I spoke with CCSM 8 who was working in room A107. She shared she started her day in the infant/toddler classroom around 7:45am but was told by CCSM 2 that she was being reassigned to preschool (room A107). She could not recall the number of children present when she left but confirmed she has been in room A107 the entire day and has not returned to the infant/toddler classroom to work since she left at 8am. I spoke with CCSM 1 working in classroom A107. She confirmed CCSM 8 has been working with her in the room since approximately 8am when her classroom started. She directed me to the staff attendance sheet which showed CCSM 8 as being signed in at 8am. CCSM 1 denied any ratio concerns for her classroom. I completed a ratio head count for the room, and ratio was maintained with 2 CCSMs and 10 children. I viewed CCSM's sign in sheet and CCSM 8 signed into the room at 8am. After speaking with CCSM 8 (who was working in another classroom room during my ratio check) I returned to speak with CCSM 2. I informed CCSM 1 that CCSM 8 shared she's been working in the classroom I observed her in since 8:00am and was not on lunch break as she indicated to me. CCSM 2 began to apologize and stated, "I'm so sorry, I just panicked and knew we were out of ratio, so I just said she was working with us." She shared Mr. Robinson was aware that the room would be out of ratio when he called this morning; she told him they had 10 children. It was at this time he told her to send CCSM 8 to the preschool classroom. CCSM 2 shared normally the room is in full compliance with the 1 to 4 ratio but there was a need in the preschool classroom, and she was simply following the orders she was given from supervision. On 05/02/2023, I made contact with CCSM 7 in classroom A111. I confirmed ratio with 7 children being present and 1 staff. She reported working in the classroom full time and denied ever being out of ratio in her room since her employment began in 2022. She confirmed starting her mornings off with another CCSM to maintain ratio but due to multiple children only participating in half day care, the other CCSM leaves at 12pm. The facility is maintaining the required staff to child ratio. I completed three unannounced visits and each time ratio to staff I was observed to be maintained for the preschool rooms.

Accurate records detailing staff daily arrival and departure times is not maintained. At the time of my initial onsite inspection there was no specifical record tracking system used by staff. On 05/30/2023, I checked attendance records for a total of eight random days and throughout the month of May. Each of those I days had one or more staff were not sianed in or out accurately.

On 9/16/22, the department received a complaint stating that the new lead caregiver in the infant/toddler room was probably not qualified since the previous lead caregiver's name is on all the documents. I could not get more information since there was no contact information for the complainant. On 9/20/22, I conducted an unannounced, onsite inspection at the center. There were 3 staff members that worked in the infant/toddler classroom during the inspection. On 9/20/22, I interviewed Ms. Jaynes who has recently taken over the lead position in the infant/toddler classroom on September 6, 2022. Ms. Jaynes said that she had been a GSRP teacher in the preschool room for several years and took over the lead position in the infant/toddler classroom in September 2022. She said that she 2 has a Child Development Associate (CDA) credential in preschool and has 5 years of experience working with the children. Ms. Jaynes said that she had applied for a renewal of CDA and was in the process of getting the document. Ms. Jaynes said that she was currently working on getting her coursework through Child Care Education Institute to get her infant toddler course requirement of 4.5 ceu's. Ms. Jaynes has until March 6, 2023, to get her 4.5 ceu's of infant/toddler coursework. On 9/20/22, I interviewed the program director, Mr. Jones who stated that Ms. Jaynes was working as a caregiver under his supervision since April 2022 and took over as a lead caregiver in the current classroom as of September 2022. On 10/21/22, I received the current updated CDA certificate from Ms. Jaynes to confirm that she is qualified to be a lead caregiver in the infant/toddler classroom. R 400.8122(7) Lead caregiver; qualifications; responsibilities. On 9/16/22, the department received a complaint stating that the infant/toddler classroom does not have a structured routine. There was no contact information available to find out further details about the complaint. On 9/20/22, I interviewed the lead caregiver, Ms. Jaynes who said that she had taken over as lead caregiver in September and the infant/toddler staff were trying to come up with the most suitable program and lesson plans for the group of children they have. She pointed to the daily schedule that was posted on the wall in the classroom for the parents to see and stated that a schedule was mailed to the parents. Ms. Jaynes said that even though it is very hard to follow the times of the schedule since the infants and toddlers up to 18 months of age have on demand schedules regarding sleep and food, they try their best to follow the activities on the schedule. For example, children get to engage in arts, crafts, free play, circle time and reading every day as per the schedule, even though the amount of time spent on each activity may vary by the day. Ms. Jaynes said it was play based learning and they are making every provision to meet the needs of the children. Ms. Jaynes said that the parents are aware of the schedule and none of them had come to her for any concerns or additional information. On 9/20/22, I reviewed the daily schedule that included breakfast, free choice play, circle time, small groups consisting of art, motor, sensory activities, outside exploration, lunch time and nap time. While I was inspecting the room, toddlers were getting free exploration time, followed by lunch and nap time as indicated on the daily schedule. The age range in the classroom was 8 months to 2 years of age. On 9/20/22, I interviewed the assistant caregiver, Ms. Bidwell, who said that she had worked in this program for 8 years and her schedule is 7:30 am to 2:30 pm every day. Ms. Bidwell said that she had always followed a schedule in the classroom, and they follow it like clockwork. Ms. Bidwell said that the parents have received a daily schedule and they send pictures to the parents of the activities that children do daily. Ms. Bidwell said that most of the children currently enrolled are 18 months and older and they can keep up with the schedule most of the time. 5 On 9/20/22, I interviewed Ms. Kelly who stated that she had been working since June 2022 from 7:45 am to 4 pm most days. Ms. Kelly said that they follow the schedule daily. The schedule includes, diaper changes every two hours at specific times, age-appropriate activities such as arts and crafts, painting and reading, and specific mealtimes. Ms. Kelly said that younger children eat and sleep at different times, but they always follow the individualized routine based on the needs for each child. On 9/20/22, I interviewed Ms. Parker who said that she had worked in the classroom for 6 years. She said that she worked mostly in the afternoons, daily. Ms. Parker said that the afternoon schedule was very similar to the morning after the children wake up from their naps. The diaper changes and mealtimes are every two hours at specific times or on demand schedule for infants/toddlers. The activities include reading, painting, arts and crafts and free choice play. Ms. Parker said that they always have a daily schedule.

on 1/19/2022 I spoke with the complainant. She stated the latchkey program at Davisburg Kids Program is consistently out of ratio. She said that she is concerned that there is not enough staff to care for the children. The complainant informed me that older children take younger children to the bathroom because there is only one staff member present. On 1/21/2022 I conducted an unannounced onsite inspection at Davisburg Elementary. I observed programming in the latchkey program from 3:30 to 4:00 pm. There were 17 children and 3 child care staff members present during the inspection. Child care staff members Ashleigh Swartz, Katie Lang, and Riley Parker were present when children arrived in the classroom at 3:45 pm. I interviewed Child Care Staff Member Ashleigh Swartz. Ms. Swartz works during the morning and afternoon sessions of the latchkey program. She works from 6:00 am to 8:30 am and from 3:00 pm to 6 pm. She also works in the infant and toddler program on Mondays and Wednesdays. Ms. Swartz stated that staff to child ratios are always met in the afternoon. She said there are always at least two staff members working during that session. However, 3 the morning session has been out of ratio. Ms. Swartz stated there has been a lot of staff turnover recently and staff illness and that has caused staff coverage issues. Ms. Swartz stated she was out of ratio in the morning of 1/13/2022. I interviewed child care staff member Carrie Lang. She stated she works in the afternoon from 3 pm to 6 pm, Monday through Friday. Ms. Lang said that ratio was not an issue in the afternoon. The afternoon program is always in ratio unless someone calls in. She does not work in the morning program. I received and reviewed attendance records for 01/ 13/2022. Ms. Swartz had twenty children in her care by herself during the morning session. Of the twenty children, four children were between the ages of 4 years old and 5 years old. At 7:38 am there were thirteen children in care. From 7:38 am to 8:30 am, Ms. Swartz was out of ratio. Children ages four to five years old are required to be in a staff to child ratio of 1:12. At 8:03 am the nineteenth child arrived. School agers are required to be in a staff to child ratio of 1:18. Ms. Swartz worked by herself until 8:25 am when children were dismissed for the school day. She cared for a total 20 children by herself I completed a second onsite inspection on 2/23/2022. Upon my arrival at 7:40 am, Ms. Swartz had fifteen children in her care. At 7:48 am, there were seventeen children present and a second staff member, Chrissandra Padilla arrived. Ratios were maintained throughout the rest of the AM Session. At 8:25 am, children were dismissed from the program and directed to their assigned preschool and elementary classrooms. I received and reviewed attendance records and enrollment logs. The latchkey classroom consisted of twenty-five children of mixed ages. Children in the classroom were between the ages of 3 years old and 12 years old. Of the twenty-five children that attended care on the morning of 2/23/2022, Child A was 3 years old, and five of the children were between 4 and 5 years old; Child B; Child C; Child D; Child E; and Child G. Nineteen of the children were school age. When children are in a mixed age group, the center is responsible for maintaining the ratio requirements for the youngest child. A 3-year-old-child arrived at 7:07 am. He was the eleventh child to arrive. Children ages 3 to 4 are required to be in a staff to child ratio of 1:10. Ms. Swartz worked by herself until 7:48 am, when Chrissandra Padilla arrived. A four-year-old child arrived at 7:06 am. At 7:13 am, 13 children were present. Children ages 4 to 5 are required to be in a staff to child ratio of 1:12. Ms. Swartz worked by herself until 7:48 am. 4 I interviewed Assistant Principal for Early Childhood Programs, Chrissandra Padilla. Ms. Padilla was the second staff member to arrive during the AM session on 02/23/2022. She inf

On 1/21/2022 I conducted on an unannounced onsite inspection at Davisburg Elementary. I arrived at 2:30 pm and observed programming in the infant and toddler classroom. The infant and toddler classroom had one child and two staff members present. Infant and toddler staff members included Tricia Parker and Taylor Parker. Both staff members stated there are usually eight children present, but some of the children were sick and others were on vacation. I interviewed Tricia Parker. She said that she works from 2:00 pm to 6:00 pm, Monday through Friday. She does not recall a specific time and date that the infant and toddler classroom was out of ratio, however, she has observed the infant and toddler room being "short-staffed" when she delivered food to the classroom in the morning. During morning food delivery, infant and toddler staff informed her that they were out of ratio. I interviewed Taylor Parker. She did not recall a time that the infant and toddler classroom was out of ratio. She stated that another child care staff member would work past their shift to help maintain ratios, if needed. Both Tricia Parker and Taylor Parker stated they were aware of the child to staff ratios and understood the ratio to be one staff to four children in the infant and toddler classroom. On 2/23/2022 I conducted a second onsite inspection. I observed ratios in the infant and toddler room. There were three children and one child care staff present. A second child care staff member arrived at 8:00 am. I interviewed child care staff member Charlene Cone. She is the lead infant and toddler caregiver. She stated that ratios are maintained in the classroom. She said she will work later into the afternoon, past her shift, which is 6:00 am to 2:30 pm, Monday through Friday, to ensure ratios are met. Ms. Cone said she was sick the week of 01/10/2022 thru 01/14/2022 and was not able to work. Ms. Cone usually works at 6:00 am. When she was absent, coverage was not provided until 9:00 am. This resulted in staff being out of ratio in the mornings while she was gone. 10 On 03/09/2022 I conducted a third onsite inspection at Davisburg Kids Program. I observed child care staff to child ratios in the school age room and infant and toddler room. The infant and toddler room had two staff members and four children present. On 03/16/2022 I received and reviewed attendance records for the infant and toddler room. Records were provided for the week of 01/10/2022 thru 1/14/2022. On all records, child care staff member Kelly Bidwell arrived at 7:00 am. Ms. Bidwell worked alone until 9:00 am, when a second staff member, child care staff member, Jennifer Rodenbo arrived. The ratios were as follows 2nd • 01/10/2022-1 staff to 5 children at 8:27 am; 8 children at 8:47 am; staff child care staff member, Jennifer Rodenbo arrived 9am • 01/11/2022- 1 staff to 5 children at 8:45 am; 2nd staff child care staff member, Jennifer Rodenbo arrived 9am • 01/12/2022- 1 staff to 5 children at 8:15 am; 8 children at 8:30 am; 2nd staff child care staff member, Jennifer Rodenbo arrived 9am • 01/13/2022-1 staff to 5 children at 8:15 am; 8 children at 8:50 am; 2nd staff staff child care staff member, Jennifer Rodenbo arrived 9am 5th • 01/14/2022- 1 staff to 4 children; a child was present; however, a sign in time was not noted on the attendance sheet. Ms. Swartz worked by herself until 8:25 am when children were dismissed for the school day. She cared for a total 27 children by herself.

Ms. Swartz was out of ratio. She had twenty children in her care by herself during the morning session. Of the twenty children, four children were between the ages of 4 years old and 5 years old. Prior to Ms. Padilla's arrival, Ms. Swartz cared for a total 17 children by herself. The classroom was out of ratio for 7:07 am to 7:48 am. When children are in a mixed age group, the program is required to follow the ratio requirement for the youngest child present. The youngest child present was three years old; therefore, the required staff to child ratio was 1:10. On 03/09/2022 required ratios for mixed age groups were not met. The classroom had one staff member with twenty-seven children. Children in the classroom ranged in age from 4 years 1 month to 11 years old. There were five children ages 4 years old to 5 years old. When children are in a mixed age group, the program is required to follow the ratio requirement for the youngest child present. The youngest child present was three years old; therefore, the required staff to child ratio was 1:12.

On 01/10/2022, Ms. Bidwell cared for 5 to 8 children by herself from 8:27 to 9:00 am. Ms. Rodenbo arrived at 9:00 am. On 01/11/2022, Ms. Bidwell cared for 5 children by herself from 8:45 am to 9 :00 am. Ms. Rodenbo arrived at 9:00 am. 01/12/2022, Ms. Bidwell cared for 5 to 8 children by herself from 8:15 am to 9:00 am. Ms. Rodenbo arrived at 9:00 am. 01/13/2022, Ms. Bidwell cared for 5 to 8 children by herself from 8:15 am to 9:00 am. Ms. Rodenbo arrived at 9:00 am. On 01/14/2022, Ms. Bidwell cared for 5 children. However, it is not clear what time the fifth child arrived. The child is not signed in for the day.

On November 16, 2021, I completed an unannounced on-site inspection. I interviewed program director, Ms. Marti Bunner, Child Care Staff Member (CCSM) 3, and CCSM 4, separately. Ms. Bunner said she's listed as a program director because she has the highest qualifications at the center. Ms. Bunner said she's just a child care staff member in the Preschool Classroom. She doesn't know if the latchkey program has child information cards for all of the enrolled children. I interviewed CCSM 3 and CCSM 4, separately. CCSM 3 said there are approximately 48 children enrolled in the latchkey program. CCSM 3 and CCSM 4 both said they didn't have any children information cards at the beginning of the school year in September. CCSM 3 said the latchkey program started on September 4, 2021. They didn't get children information cards until last Monday, November 8, 2021. During the inspection, I reviewed 37 children's records and found the following: Fifteen of the thirty-seven children's records reviewed did not have children information cards: Child A (female 4 years old), Child H (female, 6 years old), Child J (female, unknown), Child Q (female, 10 years old), Child U (female, 48 years old), Child X (male, 9 years old), Child Y (female, 10 years old), Child Z (female, 37 months old), Child CC (male, 11 years old), Child DD (female, unknown), Child EE (male, 4 years old), Child FF (male, 7 years old), Child GG (male, 5 years old), Child HH (male, 8 years old), and Child II (female, 10 years old). • Child B (male, 6 years old) and Child G (male, 6 years old) are siblings. Child B and Child G are sharing one child information card. Child CC (male, 11 years old) and Child HH (male, 8 years old) are siblings. Child CC and Child HH are sharing one child information card. • Fourteen of the thirty-seven children information cards reviewed (Child D, Child E, Child F, Child G, Child K, Child L, Child M, Child N, Child R, Child S, Child T, Child V, Child W and Child KK) were missing information such as: Allergies, special needs, parent's employment information and telephone number, physician information such as name, phone number, and parent's signature and date. 3 On November 17, 2021, I called and spoke with CCSM 5. CCSM 5 said they didn't have any children information cards for the latchkey program for at least a month or more. She thinks they just got the cards about a week ago. On November 29, 2021, I completed an unannounced on-site inspection. I observed a child information card binder located by the child care staff desk. I reviewed the previous 15 missing children information cards and noted that 10 of the 15 were still missing cards: Child H, Child Q, Child U, Child X, Child Y, Child EE, Child FE, Child GG, Child HH and Child II. On January 4, 2022, I called and completed an exit conference with Assistant Superintendent, Ms. Jennifer Herbstreit. Ms. Herbstreit confirmed that licensee designee, Ms. Sarkella, resigned. The position will be posted within the next two weeks. On November 16, 2021, I completed an unannounced on-site inspection. I interviewed CCSM 1, CCSM 2 and CCSM 3, separately. During the inspection, I inspected the Nursery which is a large room with dividers. The Nursery is located on one side and the other side is currently being used as a blended preschool room. There are two gates in the Nursery, one by the blended preschool room and the other is located by the exit door that leads outside. The gate by the exit door is attached to the children's lockers. There are also toy shelves and children's furniture used as dividers to keep the children within the room. CCSM 1, CCSM 2 and CCSM 3 all said they realized that the cribs didn't fit through the gates during the last fire drill in October 2021. CCSM 2 and CCSM 3 both said they used the buggy and stroller to transport the children out of the building. CCSM 1 said the licensee designee, Ms. Jodi Sarkella, is aware of the problem and has ordered a new gate. I provided technical assistance, consultation and assisted with room arrangement. informed CCSM 1 that a gate was not needed and suggested moving the shelves and furniture vertically from the exit door. Supervision will be needed when parents are picking up or dropping off to ensure the children are not leaving the room or building. CCSM 1 said the Nursery and the blended preschool class use the exit door during pick up and drop off. Parents are not allowed in the building due to COVID 19. Prior to leaving the child care center, CCSM 1 informed me that she had rearranged the furniture in the Nursery room. I inspected the Nursery and observed the children's lockers were against the same wall as the exit door. By removing the gate and rearranging the lockers it provided several feet of open space to accommodate the cribs. On January 4, 2022, I called and completed an exit conference with Assistant Superintendent, Ms. Jennifer Herbstreit. Ms. Herbstreit was aware of the issue and thought that it had been corrected prior to my inspection. I informed Ms. Herbstreit that the child care staff members rearranged the classroom during my inspection.

On November 16, 2021, I reviewed the addendum reports dated November 8, 2019, November 21, 2011, and August 23, 2021. The latchkey program was approved for school-age only in the latchkey room which is next to the Nursery. The cafeteria was never approved for child care use. On November 16, 2021, I completed an unannounced on-site inspection. I interviewed program director, Ms. Marti Bunner, and CCSM 1, CCSM 2, CCSM 3, and CCSM 4, separately. Ms. Bunner, CCSM 1, CCSM 2, CCSM 3, and CCSM 4 all said the latchkey program is no longer located next to the Nursery. The latchkey program moved to the cafeteria in October. A blended preschool program is now using the former latchkey room. During the inspection, I inspected the Nursery and the latchkey classroom. This is a large room with dividers. The Nursery is located on one side and the other side was currently being used as a blended preschool room. On November 29, 2021, I completed an unannounced on-site inspection. I observed CCSM 5 and CCSM 6 in the cafeteria with the latchkey children. I interviewed CCSM 5 who said the latchkey program has been in the cafeteria since the beginning of October. On January 4, 2022, I called and completed an exit conference with Assistant Superintendent, Ms. Jennifer Herbstreit. Ms. Herbstreit was unaware that the 7 cafeteria was not approved for child care use. She thought that all of the cafeterias were approved.

The attendance records for November 12 and November 15, 2021, for the latchkey program did not have the children's last names, the arrival and departure time. The attendance record for November 29, 2021, did not have the children's last names.

On November 12, 2021, the after- school latchkey program was out of ratio. CCSM 5 was alone with 25 children. The youngest child is 3 years 11 months old; therefore, the ratio is one child care staff member to ten children. On November 15, 2021, the after- school latchkey program was out of ratio. CCSM 5 was alone with 29 children. The youngest child is 3 years 1 month old; therefore, the ratio is one child care staff member to ten children.

On November 29, 2021, the after- school latchkey program was out of ratio. CCSM 5 was alone with 26 children from 3:45 P.M. to 3:50 P.M. CCSM 6 arrived at the child care program at approximately 3:50 P.M. However, the youngest child present is four years old; therefore, the ratio is one child care staff member to twelve children. The after- school latchkey program was still out of ratio with two child care staff members and twenty-six children.
