On 05/25/2022, 1 conducted a telephone interview with Complainant. Complainant indicated that when children in care are "misbehaving" and not listening, the children are put in high chairs. The children are placed in the high chair at the back of the room or moved to the kitchen. A child care staff member would sometimes stay in the kitchen with the child, but at times the child was left alone in the kitchen with the door closed to "scare them." Children were also given quiet activities to do at the kitchen table when they need to come out of their classroom because they were acting out. The children taken to the kitchen were two to three years old. The children are usually only in the kitchen long enough for them to calm down, but no longer than five minutes. However, children are left in the high chairs in the classroom "a long time," sometimes up to 20 minutes. I asked if anyone ever said anything about the children being put in the high chairs or in the kitchen unsupervised. Complainant stated that "the boss," Tiffany Sullivan, would tell child care staff members to use this practice, so no one questioned it. There is no plan at the center on how to deal with children with challenging behaviors. Parents are not aware of what is happening or that child care staff members are not trained to deal with behavioral issues. Complainant stated that on Friday, 05/20/2022, Child A (three-year-old male) and Child B (three-year-old male) were acting out. When a child care staff member had Child A and Child B "sit out" of an activity because the children were not cooperating, Ms. Sullivan told the child care staff member that was not allowed. Ms. Sullivan explained that children could not be excluded like that. However, another 3 child care staff member, China Whitfield, put the child in "time out" and Ms. Sullivan did not say anything to her. The Complainant indicated she had pictures of children crying while sitting in the high chairs in the corner of the room. I asked the Complainant to forward the pictures to me and on 05/25/2022, I received videos and pictures of a children sitting and crying in high chairs. In one picture, it appears to be nap time and a child is in a high chair with the high chair facing the wall. I asked Complainant who the child was in the corner and Complainant identified the child as Child B. Another picture shows a child who looks like Child B in a high chair crying. In one video a child is being pulled to another area while sitting in the high chair. In the second video, it appears that a child care staff member is talking to a child about his behavior while the child is again in the high chair. On 05/25/2022, I conducted an unannounced onsite inspection at The Learning Center. I met with the program director and licensee designee, Ms. Sullivan. I informed Ms. Sullivan that a complaint had been received and I discussed the allegations in the complaint with her. Ms. Sullivan stated that on Friday 05/20/2022, she was conducting an interview with a parent when she heard a child care staff member, Amber Crenshaw, tell children they were not allowed to participate in an activity because they were misbehaving. Ms. Sullivan finished the interview with the parent, then asked Ms. Crenshaw to explain why the children were separated and not allowed to participate in the activity. Ms. Crenshaw explained that the children were misbehaving and by allowing the children to participate, she was rewarding bad behavior. Ms. Sullivan explained that was not how things works and informed Ms. Crenshaw she could not exclude children from activities as discipline. Ms. Sullivan provided Ms. Crenshaw with some alternatives like splitting the children into smaller groups and Ms. Crenshaw stated she was not going to do that. Ms. Sullivan advised Ms. Crenshaw that she could leave if she was not going to use a different approach and Ms. Crenshaw left. During the 05/25/2022 telephone interview with the Complainant, the Complainant indicated that there are child care staff members who do not have the required CPR and first aid training. During the 05/25/2022 interview with Ms. Sullivan, she indicated that all of the child care staff members with the exception of Ms. Latondras and Ms. Harrison had current CPR and first aid certification. Ms. Sullivan explained that Ms. Latondras has been working at the center for about two weeks and was working on getting her CPR/first aid training completed within 90 days of hire. Ms. Sullivan asked Ms. Harrison repeatedly to get her CPR/first aid certification or training completed, but she never followed through. Ms. Harrison had been employed at the child care center for about six months and never obtained CPR/first aid training or certification. On 05/25/2022, I received an email from Ms. Sullivan with documentation of CPR/first aid training for all child care staff members except Ms. Latondras and Ms. Harrison. During the 08/09/2022 exit interview with Ms. Sullivan, I informed her that I had found a violation of the rule requiring staff to have CPR/first aid training within 90 days of being hired. Ms. Harrison did not have CPR/first training or certification and was working at the center for about six months before leaving. Ms. Sullivan indicated that Ms. Latondras has now completed her CPR/first aid training. I provided technical assistance and consultation regarding CPR/first aid training and certification. 10

During the 05/25/2022 interview with the Complainant, the Complainant indicated that children in care are using unapproved climbing equipment in the outdoor play area. Child care staff members are told to remove the slide when licensing arrives. There are pictures of children on the slide because child care staff were not aware that the children were not supposed to be using it. On 05/25/2022, the Complainant forwarded pictures of children in the enclosed outdoor play area climbing on residential play equipment. During the 05/25/2022 onsite inspection, I observed the outdoor play area with Ms. Sullivan. Some broken residential equipment including the equipment in the pictures was observed outside of the fenced play area. I asked Ms. Sullivan about the equipment and the allegation that child care staff members used the unapproved equipment but removed it when licensing was present. Ms. Sullivan indicated that the climbing equipment was not used by children in care. I showed Ms. Sullivan a picture of children playing on the equipment in the fenced in area. Ms. Sullivan explained that the picture was several months old. I reminded Ms. Sullivan that residential equipment was not allowed in the outdoor play area and could not be used by children in care which had been the case since the center opened. 11 Ms. Sullivan stated that although she told child care staff members not to use the equipment, they would repeatedly put the equipment back in the play area. She finally broke the equipment so they could not use it. I asked why the equipment was at the center in the first place and she explained that she did not want to throw it away, but people who said they wanted it never picked it up. During the 05/25/2022 interview with Ms. Whitfield, she confirmed that the children had used the climber in the play area. However, they were informed that it was against regulations and it was removed. She was not sure when the slide was removed from the outdoor play area. During the 05/25/2022 interview with Ms. King, she said in the two weeks she has been working at the center, the climbing equipment has not been in the play area. The equipment has been outside of the fenced area and not used by children in care. During the 05/26/2022 interview with Ms. Latondras, she stated that when she first started a couple of weeks ago, there was a slide in the outdoor play area. She did not see any children on the slide, but just recently it was not in the play area anymore. She was not sure when the slide was removed. During the 08/09/2022 exit interview with Ms. Sullivan, I informed her that there was evidence to support a violation of the outdoor play area rule. Children in care were using residential equipment in the outdoor play area that is not approved for child care use. Ms. Sullivan indicated she understood the rule violation.

Only space that has received prior approval for child use by the department may be used for child care.

(10) All child care staff members who work directly which children are required to be trained in first aid and pediatric, child, and adult cardiopulmonary resuscitation (CPR) within 90 days of being hired. Prior to issuing a license to operate a child care center, and prior to the renewal of a license, the department shall verify that at least 50% of the child care staff members who work directly with children are currently certified in first aid and pediatric, child, and adult CPR. Each of these child care staff member's first aid and CPR certificates must be valid and retained on file in the center.

(13) All pieces of playground equipment that have an elevated playing or climbing surface, regardless of the height of the playing or climbing surface, must be surrounded by a shock absorbing surface and meet the guidelines defined by the Consumer Product Safety Commission (CPSC) Handbook for Public Playground Safety, which is available at no cost at www.cpsc.gov. On December 21, 2020, I initiated my investigation by interviewing Child Care Staff Member 1. Child Care Staff Member 1 stated that she was working with Ms. Sullivan the second week in December and they were preparing the children for naptime after they finished lunch. Child Care Staff Member 1 stated that Child A and Child B were struggling behaviorally and were giving her a difficult time. Child Care Staff Member 1 stated at this time is when Ms. Sullivan told her to take her lunch break. Child Care Staff Member 1 explained that when she returned from her break, Child A and Child B were in their cots and Child B had already fallen asleep. Child Care Staff Member 1 asked Ms. Sullivan how she got Child A and Child B to settle down, and Ms. Sullivan admitted to her that she "popped" Child A at the beginning of nap time. Child Care Staff Member 1 explained that she did not directly witness Ms. Sullivan physically discipline any of the children, but it was just reported to her. Child Care Staff Member 1 also stated that Ms. Sullivan expressed that Child A & Child B's Mother gave her permission to physically discipline her children if they are not following the rules at the center. Child Care Staff Member 1 also stated that there was one more incident with Child A & Child B with another child care staff member regarding inappropriate discipline. Child Care Staff Member 1 explained that she was working with Child Care Staff Member 2 and the children were playing outside. Child Care Staff Member 2 was outside with Child A & Child B and she stated to Child Care Staff Member 1 that Child B had spit on her and then she "popped" him so that he could stop spitting. Child Care Staff Member 1 further explained that she was not outside when the reported incident happened as she was inside with the other children. Child Care Staff Member 1 stated that she has never personally witnessed any of the child care staff members inappropriately discipling the children, but just what was reported to her directly by the child care staff members. In addition, Child Care Staff Member 1 stated that she has never witnessed any injuries on the children. Child Care Staff Member 1 stated that she has only witnessed Ms. Sullivan on multiple occasions to threaten Child A and Child B by stating to them "do you want to get thumped?" and had her fingers positioned ready to "flick" her fingers on the children. 3 Child Care Staff Member 1 stated that she is not in agreement with this discipline philosophy and does not participate in handling the children in this manner. On December 23, 2020, I conducted an unannounced onsite inspection with Department of Health and Human Services Worker (DHHS) We arrived at 11:55 a.m. On December 23, 2020, I interviewed Licensee Designee Tiffany Sullivan. Ms. Sullivan stated that she has never "flicked" any of the child care children, including Child A and Child B. Ms. Sullivan further expressed that she would never threaten to hurt or physically discipline any of the children at the center. In addition, Ms. Sullivan explained that she has never witnessed any of her child care staff members physically discipling the children while in care or threaten any of the children to physically discipline them. Ms. Sullivan stated that Child A and Child B are a challenge while in care because they struggle with following rules, and it has been a trying month with their behaviors. Ms. Sullivan expressed that she knows her staff are frustrated, but they all follow the center's discipline policy. Ms. Sullivan explained that with structure and consistency she has seen some positive changes with Child A and Child B Ms. Sullivan stated that Child A and Child B respond better in structured activities and if they get aggressive, she and her staff redirect the children to another activity or area.
