On 9/22/21, the department received a complaint stating that a staff member dropped a vape a couple of times when she was working with the children in the classroom and on the playground. The concern is also that the same staff member vaped in front of the children. This was brought to the program director's (Leslie Garbacz) attention and no action was taken about it. The staff members that are aware of this issue are Ms. Jackson, Ms. Givens, Ms. Lund, Ms. Lavely and Ms. Miller. Ms. Larsen was the staff member using the vape. There was no further information regarding the dates and times of the incidents since there was no contact information for the complainant. On 9/24/21, I conducted an unscheduled onsite visit at the center. I interviewed all the staff members that were listed in the complaint. Ms. Larsen was hired to work at the center the first week of September 2021. Ms. Larsen works in Twaddler room A as an assistant child care staff member. 2 On 9/24/21, I interviewed the lead caregiver in Twaddler A, Ms. Givens, who said that in the first week of September, on Ms. Larsen's second day at work, she saw a vape on the floor during nap time. Ms. Givens did not know what it was at first but later understood that it was a vape. She picked it up from the floor and left it on the counter. The vape was a dark, purplish color. Ms. Givens said that she did not say anything about this to anybody or ask Ms. Larsen about the vape. Ms. Givens did not see Ms. Larsen pick up the vape from the counter. Later when she heard about the vaping from other staff members and realized that it was a vape. On 9/20/21 01 9/21/21, she saw that Child A had something in his hand, and Ms. Larsen went up to him, pulled it from Child A's hands and walked away to put it in her purse. As Ms. Larsen was walking by her, she could smell something fruity. Ms. Givens said that she did not actually see what Ms. Larsen had in her hand. This time Ms. Givens decided to talk to Ms. Garbacz and told her about the incident 3 weeks ago and the current incident. Ms. Garbacz asked her some specific questions about the incidents and told her that she would talk to Ms. Larsen about it. Ms. Givens said that she had not seen Ms. Larsen drop the vape on the playground or see her vape in front of the children. On 9/24/21 I interviewed Ms. Jackson who said that some days ago, when the toddlers were on the playground in a combined class, she saw a vape in Ms. Larsen's hand. As Ms. Larsen walked around her in the playground, she could smell something fruity around her, like a grape flavor. Ms. Jackson said that she works in Twaddler B, and they come together for outdoor play with Twaddler A classroom. Ms. Jackson said that she had only seen the vape in Ms. Larsen's hand once and had never seen it dropped on the playground or seen her vape. Ms. Jackson said that the vape was a purplish color and had a fruity flavor to it. Ms. Jackson said that she had heard from Ms. Miller and Ms. Givens that Ms. Larsen had dropped her vape in the classroom in front of the children but had not seen that herself. On 9/24/21, I interviewed Ms. Lund who works in the Twaddler B classroom. Ms. Lund said that on 9/20/21, she had seen a vape in Ms. Larsen's hand. The vape fell out of Ms. Larsen's pocket 3 to 4 times and Ms. Larsen would pick it up and put it in her pocket, when they were on the playground with the children during outdoor play. Ms. Lund said that she did not talk to Ms. Larsen about it or say anything about it to anybody since she was aware that Ms. Givens had spoken to Ms. Garbacz about it. Ms. Lund said that she had not seen Ms. Larsen vaping or a child getting any access to it. Ms. Lund said that the vape is a purplish pink color. On 9/24/21, I interviewed Ms. Lavely who works in the Twaddler A classroom as an assistant child care staff member. Ms. Lavely said that she had seen Ms. Larsen vaping outside on the playground on September 16 at about 4:30 pm when children were outside. Sh

On 08/03/2021 I spoke to the complainant. The complainant stated that the center is not meeting child care staff member to child ratios on a regular basis. The school age room has had one staff member working, when there should be two. The complainant said this issue has been going on for months. Staff are not given breaks and work 10 to 12 hour shifts every day. The complainant did not recall any specific dates that the center was of ratio. On 08/04/2021 I completed an announced onsite inspection at The Learning Experience. I observed child care staff member to child ratios in all classrooms. The 2 classrooms I inspected included: Infant A, Infant B, Toddler A, Toddler B, Twaddler B, Prepper, Preschool 1, Preschool 2, and Pre-Kindergarten/School Age. Toddler B, Twaddler B, Prepper, and the PreK/School Age classroom did not meet ratio requirements. Toddler B had 1 child care staff member with 8 children. To meet the requirement the center is required to provide 1 staff member for every 4 children, ages 18 months to 24 months old. One child care staff member worked as the only child care staff member from 12:30 pm to 1:00 pm. Twaddler B had 1 child care staff member with 8 children. To meet the requirement the center is required to provide 1 staff member for every 4 children, ages 24 months to 30 months old. One child care staff member worked as the only staff in the classroom from 12:30 pm to 1:30 pm. The Prepper classroom had 1 child care staff member with 12 children. To meet the requirement the center is required to provide 1 staff member for every 8 children ages 30 months to 3 years old. One child care staff member worked as the only staff in the classroom form 1:00 pm to 1:55 pm. 3 The Prek/School Age classroom had 1 child care staff member with 22 children. Although this a mixed-age classroom, all children are currently school age children in room. To meet the requirement the center is required to provide1 staff member for every 18 children ages 5 through 12 years old. One child care staff member worked as the only staff in the classroom from 1:05 pm to 1:15 pm. A second staff member was added to this room when I told Ms. Garbacz she was out of ratio in this room. I interviewed Ms. Garbacz. She stated she did not recall a specific time that classrooms were out of ratio. She said she provided staff coverage in classrooms as needed to help maintain ratios and give staff lunch breaks. She said they have had some issues staffing the PreK/School Age room this summer, but a new staff member has been recently hired to work in that classroom. Ms. Garbacz said she was unaware that ratios needed to be maintained during naptime, and as long as children were asleep, other staff could take a break. Ms. Garbacz stated that staff members break each other in the older classrooms regularly. I informed her that ratios are required to be maintained during all parts of the day, including naptime. She said now that she is aware of this rule, she will make sure that classroom ratio requirements are always met. I interviewed Ms. Hemming (Prek/School Age staff), Ms. Young (Prepper staff), Ms. Harvey (Preschool 2 staff), Ms. Robertson (Preschool 1 staff), and Ms. Sewell (Toddler B staff).
