(2) ...If the department determines that a service, facility, applicant, licensee, child care staff member, or a member of household is not conducive to the welfare of the children, the department shall deny that application or revoke that licensee's license according to section 11.
On 12/17/2021, I received an intake to conduct a conducive to the welfare of children assessment of Margaret Thomas, who is currently working as a staff member at the GSRP program at A School for the Mind and Body in Clarkston. History According to the special investigation report by Child Care Licensing Consultant, Catherine Edgar (2014D0520110) dated 10/31/2013, Ms. Thomas's child care license (License # DC440312073) was summarily suspended on 10/31/2013. Ms. Thomas was the program director/licensee designee of Little Friends Child Care Center located at 301 E First St. Imlay City, MI. The events were as follows: On 2/12/2012, Licensing Consultant Catherine Edgar completed a special investigation report (SIR#2021D 0521009) and substantiated that the program director Margaret Thomas violated R 400.5107(2)(a). Ms. Thomas grabbed a child care child by the arm and spanked him on his bottom at the child care center on 2/3/2012. The special investigation report stated that the child care consultant, Ms. Edgar watched the video where Ms. Thomas came into the room, got the child off the chair and swatted him on his bottom. The allegation was that Ms. Thomas swatted the child on the bottom because the child threw a block at another child. As a result, Ms. Thomas completed a corrective action plan on 2/8/2012, stating that she would not use physical discipline with child care children. On 10/10/2013, Ms. Thomas struck Child A on the back of his head, grabbed his shirt and shoved him after he defecated in his pants at Little Friends Childcare Center, Inc. On 10/15/2013, Ms. Edgar watched a video recording which showed that Ms. Thomas walked into the preschool room, checked the back of Child A's pants and proceeded to strike Child A on the side of his head with an open hand and grabbed his shirt and swung him towards the door. On 10/16/2013, Ms. Thomas admitted to Ms. Edgar that on 10/10/2013, she checked Child A's pants and "popped" him on the back of his head and told him to 611 W. OTTAWA. P.O. BOX 30664. Ms. Thomas admitted that she had lost her temper with Child A and that she also pushed him towards the bathroom after hitting him on the head. On 11/07/2013, Ms. Thomas signed a settlement agreement with the Department and agreed to a violation of the Child Care Organizations Act or a licensing rule promulgated under the Act. It was agreed that Ms. Thomas would not apply for a license or a certificate of registration for a child care organization licensed under Child Care Organizations Act for a period of 2 years. On 12/02/2013, Ms. Thomas pled guilty and was convicted of misdemeanor assault and battery and received probation for two years. Ms. Thomas paid restitution to the court. During probation, she underwent drug and alcohol testing, and reported to her probation officer three times annually for two years. Conducive to the Welfare of Children Assessment On 12/28/2021, I conducted a virtual assessment interview with Margaret Thomas. Area manager, Jacquelin Sharkey was present at the interview. During the interview, Ms. Thomas said that she worked at another center for about 4 weeks in October/November of 2021 and she left the job and moved to another child care center. Ms. Thomas said that she did not like working at the previous center since they left her alone with the children with no training on their policies and procedures or their philosophy on child care. Ms. Thomas said that she has been working at A School for the Mind and Body for about a week, and she likes it very much. She said that she works with the 3- and 4-year-old children and is happy with her job. In response to the substantiated allegation of smacking a child on his bottom on 2/03/2012, Ms. Thomas stated that she did not smack the child. Ms. Thomas stated that the child had behaviors like spitting and throwing blocks at other children, and the staff in the classroom asked her to
