R 400.1903(1)(d) · R 400.1903(1)(d) Licensee responsibilities. Inform parents when a child care staff member is providing care in the absence of the licensee.
There is insufficient evidence that Sally Eberhart failed to provide parents with notification that she would be away from her child care during the week of 7/21/2025-7/25/2025. These were planned absences and Sally Eberhart both provided the parents of enrolled children with both written and verbal notice that she would be not be at her child care home at all times.

R 400.1911(1) · R 400.1911(1) Care; supervision; children. A licensee shall ensure appropriate care and supervision of children at all times.
There is no evidence that Sally Eberhart or her child care staff members failed to provide appropriate care and supervision to Child A on 7/21/2025 by not allowing him to use the restroom. CCSM 1 stated that Child A was asked several times throughout the day if he needed to use the restroom, including just prior to being picked up at the end of the day by his father. Witness 2 stated that he observed Child A leaving the home of Witness 1 in dry clothing.

There is a lack of evidence to indicate that Child A was slapped by Witness 1. I was able to view a picture of Child A taken by Michigan Department of Health and Human Services worker Jeremy Rothig the day after Child A was allegedly slapped. The picture of Child A’s face showed no redness, bruising or swelling. Witness 1 denied slapping Child A.
