On January 12, 2023, I reviewed an incident report received from Licensee Designee Angela Westermeyer. After Child Care Staff Member 1 and Child Care Staff Member 2 left the bathroom with their classroom, the bathroom area smelled of marijuana. Child Care Staff Member 1 told Administrator Susan Beem that the marijuana odor came from Child Care Staff Member 2, as he told her earlier that he was going to get high. Child Care Staff Member 1 told Ms. Beem that approximately one-week prior Child Care Staff Member 2 showed Child Care Staff Member 1 a video of him smoking on the playground at the child care center. On January 18, 2023, I completed an unannounced on-site inspection. I individually interviewed licensee designees Audrey Hill and Angela Westermeyer, Administrators Sarah Beem and Susan Hollister Petit, Child Care Staff Member 1, Child Care Staff Member 2, Child Care Staff Member 3, Child Care Staff Member 4, Child Care Staff Member 5, Child Care Staff Member 6, Child Care Staff Member 7, Child Care Staff Member 8, Child Care Staff Member 9, Child Care Staff Member 10, Child Care Staff Member 11, Child Care Staff Member 12. Licensee Designee and Program Director Audrey Hill stated that on January 12, 2022, Administrator Sarah Beem smelled a marijuana odor in the hallway by the bathroom. Ms. Beem stated that she could not tell exactly where the smell was coming from and asked Child Care Staff Member 1 if the smell came from a parent that recently dropped a child off to her classroom. Child Care Staff Member 1 told Ms. Been that it was not the parent but Child Care Staff Member 2 who smelled of marijuana, as Child Care Staff Member 2 told her that "he was going to get high" and showed her a "weed pen." Child Care Staff Member 1 denied observing Child Care Staff Member 2 smoking marijuana but assumed he did, as they took their classroom to the bathroom shortly before Ms. Beem smelled the marijuana odor. After speaking to Ms. Beem, she went to the bathroom area and smelled a marijuana odor. Ms. Hill stated that she called Licensee Designee Angela Westermeyer and informed her of the allegations and Ms. Westermeyer facilitated a video meeting with her and Administrators Sarah Beem and Susan Hollister Petit. Ms. Hill questioned Child Care Staff Member 2 with Administrators Sarah Beem and Susan Hollister Petit present. Child Care Staff Member 2 denied smoking marijuana in the bathroom or anywhere on the premises including the playground or having a "weed pen" at the child care center. Child Care Staff Member 2 denied showing a video to any Child Care Staff Members of him smoking on the playground. Child Care Staff Member 2 consented to allow Ms. Hill to smell his clothing, hair, skin, and hands. Ms. Hill stated that Child Care Staff Member 2 did not smell of marijuana or cigarette smoke. Child Care Staff Member 2 was placed on leave from January 13, 2023, through January 17, 2023, until further investigation was completed. Ms. Hill 3 stated that a previous employee spread rumors about Child Care Staff Member 2 to current Child Care Staff Members alleging that Child Care Staff Member 2 was in a relationship with a friend that ended bad due to certain actions of Child Care Staff Member 2. Ms. Hill stated that Child Care Staff Member 1 and other Child Care Staff Members were friends with the previous employee and may have formed a preconceived negative view of Child Care Staff Member 2. She also stated that Child Care Staff Member 2 has been employed at the child care center for six weeks and is a "stellar employee." He works well with the children and the parents have expressed good things about him. Administrator Sarah Beem stated that on January 12, 2023, she smelled a marijuana odor in the hallway by the bathroom. She stated that she was not sure where the odor was coming from, and she walked back down the hallway approximately two minutes later and did not smell the odor. Child Care Staff Member 2 was not observed to act in a manner not conducive to the welfare of children, as Child Care Staff Member 2 was not observed by anyone smoking marijuana at the child care center or on the premises or to smell of marijuana. Although Child Care Staff Member 1 alleged Child Care Staff Member 2 showed her a video of him smoking marijuana on the playground at the child care center, Child Care Staff Member 2 denied this occurred and Child Care Staff Member 1 was unable to provide a copy of the video.

On July 11, 2022, I made an unannounced onsite inspection to the center. I interviewed Susan Hollister Petit, assistant director. Ms. Hollister Petit was unaware of any injuries or bruises sustained by a child that may have been at the hands of a child care staff member. I explained that the complaint was specifically, about Kara Kelley. She explained that Ms. Kelley had difficulty adjusting to the infant/toddler room. She did not have good verbal skills for that age group. She explained things in ways that were not age appropriate. But Ms. Kelley was never observed doing anything that could result in a bruise on a child. Ms. Hollister Petit said Ms. Kelley was provided with training regarding interactions with very young children and decided to move her to an older age group. At the time of my onsite inspection, Ms. Kelly has been working with the older toddlers and preschool children for about two months. Kara Kelley was surprised by the allegations and said she did not know of anyone at the center who would suggest she might hurt a child. She said she had not really spent any time with infants prior to this job. She had trouble because she did not always know what they wanted. She felt much better when she was moved to an age group that had some communication skills. I asked if she ever got frustrated on the job and she said "yes". When that happens, she asks for a break. She said she is unaware of anything she could have done that would have resulted in a bruise on any child, but definitely not one on a child's face. Paula Staebler, child care staff member, said she never saw a bruise on a child who was in Ms. Kelley's care. Ms. Staebler knew that Ms. Kelley received new worker training. She had no concerns working with her. Kendra Thomas, child care staff member, worked with Ms. Kelley in the toddler room. She stated that she never observed anything that gave her concern regarding Ms. Kelley's ability to provide care to the children. She is comfortable working with her. Megan Long, child care staff member in the infant room, stated that she saw a bruise near the eye of Child C (18-month-old) in Ms. Kelley's care. She did not remember when she saw the bruise but thought it was the week of July 5, 2022. Ms. Long showed me a photo of the bruise. It was very difficult to see, but it appeared there was some type of mark near the child's eye. Ms. Long sent a photo of the bruise to Child C's Mother. Ms. Long reported that Child C's Mother did not think the bruise was there when she dropped him off at child care. Ms. Long showed the photo to Susan Hollister Peitit, assistant director. Ms. Long stated that she believed Ms. Kelley was too rough with this child. I asked if she actually saw something occur that could have resulted in this mark or if someone else told her they saw something inappropriate happen. Ms. Long said she did not see it, and no one told her anything, she just knew that Ms. Kelley was too rough. I asked her if she had any proof that Ms. Kelley caused the mark, and Ms. Long stated "no". Maggie Duve, child care staff member in the infant room, agreed that Ms. Kelley did 3 not have great skills in interacting with the babies. Ms. Kelley's mannerisms were brisk and sometimes came off as aggressive. I asked if she ever saw behavior on Ms. Kelley's part that resulted in a child getting a bruise or being injured in anyway. She said she was not aware of that happening. She added that Ms. Kelly was moved to an older classroom and she felt that was a better fit. During the onsite inspection, I observed all of the classrooms. The center is an open floor concept. You can easily see into any classroom from just about anywhere in the big room. Voices carry throughout the big room. If anyone deliberately or unintentionally injured a child, anyone working at the time would probably know from visual observation or hearing something.
