On 6/30/2023, I completed an unannounced on-site inspection at the child care home. I informed licensee Erin Waterman of the allegations. Ms. Waterman said about a year ago she and her husband went to Georgia for a long weekend. They left for their trip on a Thursday and returned on a Monday. Ms. 2 Waterman informed parents of her intentions to have her CCSMs care for the children on Thursday, then closed the child care home on Friday and Monday. Ms. Waterman showed me her text conversations with parents that were consistent with what she described. The messages indicate Ms. Waterman went on vacation to Georgia from 06/16/2022 to 06/20/2022. She informed parents her CCSMs would provide care on 6/16/2022 and the child care home would be closed 6/17/2022 and 6/20/2022. While I was at the child care home, I observed there to be a white board calendar hung in the main entryway where Ms. Waterman documents events relevant to the child care home such as closures, special events, and Ms. Waterman’s scheduled appointments. I interviewed Child Care Staff Member 1 (CCSM 1). CCSM 1 said she remembers when Ms. Waterman and her husband went on a trip to Georgia “a long time ago” over a long weekend. CCSM 1 said since it was so long ago, she cannot remember if Ms. Waterman closed the child care home, or if she had the CCSMs provide care for the children while Ms. Waterman was away. CCSM 1 said there are former child care parents who were “always upset” if Ms. Waterman was not present in the same room as the children at all times. CCSM 1 provided an example where a parent complained because Ms. Waterman was in the kitchen preparing a meal while the CCSMs were caring for the children in a different room although the CCSMs and children were within the required licensing ratios while Ms. Waterman was in the kitchen. I interviewed Child Care Staff Member 2 (CCSM 2). CCSM 2 said she was not working at the child care home when Ms. Waterman took a trip to Georgia. Since CCSM 2 started working at the child care home, Ms. Waterman always notifies parents electronically via the Brightwheels application if she will be away from the home for any amount of time during child care hours. CCSM 2 said Ms. Waterman has “never just not been here and not tell parents.” On 10/30/2023, I contacted Child A’s Mother, Child B’s Mother, and Child Cs Mother by e-mail. I requested responses to provide feedback on the child care home. On 10/31/2023, I spoke to Child A’s Father by telephone. Child A’s Father said Ms. Waterman informed parents when she was not going to be at the child care home or if she was closing unexpectedly for a day. Although she notified parents of unexpected changes in her schedule, many times, he felt like Ms. Waterman did not always give them enough of a notice to find alternate child care. On 11/19/2023 I completed an exit conference via e-mail with Erin Waterman. 3
Ms. Waterman went to Georgia and left her child care staff members (CCSMs) to provide care for the children but did not inform child care parents she was leaving. Ms. Waterman’s allowed Adult 1 to spend the night at her home when he was homeless. Adult 1 did not complete a background check. Ms. Waterman’s home contained black mold in child use areas.

(7) The licensee shall cooperate with the department by ensuring that all individuals requiring a comprehensive background check are entered into the child care background check system and processed for eligibility as required by section 5n of the act, MCL 722.115n, and R 400.1925.
On 6/30/2023, I completed an unannounced inspection at the child care home. I informed Erin Waterman of the allegations. Ms. Waterman said there was a short period of time, for a couple of weeks, where her brother, Adult 1, came to her home “sporadically” to visit while he was in between homes. Ms. Waterman said Adult 1 would only enter her home after child are hours ended for the day. Adult 1 left the home to go to work at 5:30 a.m. prior to child care hours. Ms. Waterman said Adult 1 did not visit her home every day as he also visited other family member’s homes, depending on his work schedule. Ms. Waterman said there was a time Adult 1 arrived at her home right before she closed the child care home for the day. Adult 1 remained in his car until child care hours were over before he entered the home. A couple parents asked Ms. Waterman who was in her driveway when they came to pick up their children. Ms. Waterman explained her brother’s situation. The parents who asked seemed to be comfortable with her explanation. Ms. Waterman said Adult 1 was never in the home when children were present the few times, he spent the night at her home. Ms. Waterman said Adult 1 does not have any concerning criminal history. She did not think to have Adult 1 complete a background check because he only visited the home when the child care was closed, and he only spent the night a few times with in about a two-week period between the end of March 2022 and mid-April 2022. Adult 1’s visits were not and are not a regular, reoccurring situation. Adult 1 has been living in his own home for several months now. I interviewed CCSM 1. CCSM 1 said she recalls a very limited time several months ago where Ms. Waterman mentioned Adult 1 spent the night a few times at the home after child care hours. CCSM 1 does not even know what Adult 1 looks like 4 because she has never seen him in the home. CCSM 1 typically arrives at the home at 8:00 a.m. and Adult 1 was never in the home when she arrived for work. I interviewed CCSM 2. CCSM 2 said there was a week or two several months ago when Adult 1 came to the home after child care hours. CCSM 1 said Adult 1 was around the home no more than two weeks before he moved into his current home. CCSM 2 said she only saw Adult 1 at the home on two occasions at the most and it was not during child care hours. On 10/30/2023, I sent e-mails to Child A’s Mother, Child B’s Mother and Child C’s Mother requesting feedback on the child care home. I included my e-mail and telephone contact. On 10/31/2023 I spoke to Child A’s Father by telephone. Child A’s Father said the only people he has seen in the home are Ms. Waterman, her husband and the regular child care staff members.

On 6/30/2023, I completed an unannounced inspection at the child care home. I informed Erin Waterman of the allegations. Ms. Waterman said on Saturday, 2/11/2023, she had a birthday party for her grandson at her home. The next day while she was cleaning up from the party, she noticed what appeared to be mold around the sliding doors in the room at the back of her home. The room is not insulated so it is common for condensation to develop around the doors. On 2/12/2023 around 8:00 p.m., Ms. Waterman notified parents she was closing the child care home on 2/13/2023 because she found mold around the doors and she wanted to clean around all the sliding doors and windows before children returned to 5 the child care home. Ms. Waterman did not observe mold in any other area of the home. Ms. Waterman and CCSM 1 used a spray cleaner and found that the mold around the doors and windows wiped away easily. Ms. Waterman did not have the mold tested so she does not know that it was black mold. She said she checks around the doors and windows in the uninsulated room daily to make sure the mold does not come back. One of the child care father’s told Ms. Waterman that the mold she described sounds like a non-harmful kind of mold that commonly grows where there is regular condensation. She has not seen any more mold since that day. Ms. Waterman resumed regular business hours on 2/14/2023. I observed the areas around the sliding doors and windows in the room where the mold occurred, and I did not observe any type of mold in that area, or any other area of the home. I observed Ms. Waterman’s text notification of the mold she found. The text notification Ms. Waterman’s provided to the parents was consistent with what Ms. Waterman described in her interview. I interviewed CCSM 1. CCSM 1 said there was one occasion several months ago where Ms. Waterman found mold around the sliding doors in the room that is not insulated. CCSM 1 assisted Ms. Waterman with cleaning around the doors and windows to remove the mold. She and Ms. Waterman also pulled everything out of the room and cleaned the floors and shelves thoroughly. CCSM 1 only saw the mold around the sliding doors. CCSM 1 had never observed mold prior to that day and she has not seen any mold since that time. She is not sure that mold was harmful black mold or just a mold that developed due to moisture as Ms. Waterman did not have the mold tested. I interviewed CCSM 2. CCSM 2 said she remembers when Ms. Waterman found mold in one room several months ago. CCSM 2 did not notice the mold at the time. CCSM 1 helped clean up the mold. CCSM 2 assisted with organizing the room after Ms. Waterman and CCSM 1 removed everything out of the room to clean the floors and shelves. CCSM 2 said since Ms. Waterman and CCSM 1 cleaned up the mold, she has not seen mold anywhere in the home. On 10/31/2023 I spoke to Child A’s Father by telephone. Child A’s Father said he has never had any concerns regarding the condition of the home.

On 2/17/2023, I completed an unannounced on-site inspection. I informed licensee Erin Doty of the allegations. Ms. Doty said she owns two homes. She said she lives in the home where she provides child care. Ms. Doty said her daughter lives in the other home that is owned by Ms. Doty. Ms. Doty often spends her evenings at her second home to help her daughter out with her children. Ms. Doty said although she is often away from the child care home in the evenings, she sleeps at the child care home. Ms. Doty's child care area is on the same level as the area of the home where she resides. However, the two areas are separated into two separate halves. Ms. Doty said the area where she resides could appear to someone as if she is moving or not living in the area. Ms. Doty explained her basement has recently been remodeled so she is moving the contents of various rooms to different areas of the home. Therefore, she has many boxes scattered throughout the half of the home where she resides. Ms. Doty provided me with a tour of the part of the home where she resides. I observed rooms to contain boxes piled up. I observed the basement which appeared to be recently remodeled also with boxes. I observed the room which Ms. Doty identified as her bedroom. I observed there to be a bed with bedding and clothing to indicate Ms. Doty's belongings are at the child care home. The basement and half of the home where Ms. Doty resides are not licensed for child care use. I interviewed child care staff member (CCSM) 1 and CCSM 2. CCSM 1 said, "I can promise you she (Ms. Doty) lives in the home." CCSM 1 said Ms. Doty spends a lot of time at the other home she owns where her daughter lives, but the child care home is Ms. Doty's residence. CCSM 2 said, "that is a crazy allegation. She (Ms. Doty) absolutely lives in this home." On 5/12/2023, I spoke to Child A's Mother by telephone. Child A's Mother said she believes Ms. Doty does not reside in the child care home. Child A's Mother said she often drives by the child care home as the home is on her way to work and to run any errands. She said Ms. Doty's van is rarely in the driveway at all hours of the day. Child A's Mother said she does not believe Ms. Doty has ever lived at the child care home. Child A's Mother believes Ms. Doty does not live in the home because she does not see Ms. Doty at the home. On 5/16/2023, I completed an unannounced on-site inspection at the child care home. Ms. Doty was present. Ms. Doty said she continues to live at the child care home. Ms. Doty provided me with a tour of the side of the home where she resides. Several boxes continued to remain scattered throughout the home. Ms. Doty showed me her office on the main area that she had moved from the basement. I found Ms. Doty's office area to be unpacked and set up as opposed to boxes stacked up all over the room at the previous unannounced on-site inspection. Ms. Doty also showed me her newly remodeled basement area where she moved more furniture down from the main level. I also observed Ms. Doty had placed various 3 decorative items on the walls and around the basement area. I observed mail on Ms. Doty's counter that was addressed to Ms. Doty at the child care home location. On 5/26/2023, I placed a telephone call to Child B's Mother. I left a voice message requesting a return call. On 5/26/2023, I spoke to Child C's Mother by telephone. Child C's Mother said she believes the child care home is "amazing." Child C's Mother said she likes that the child care home is a private setting with very personable care. Child C's Mother said she believes Ms. Doty resides at the child care home. She has never had any concerns that Ms. Doty lives elsewhere. On 5/26/2023 I completed an exit conference by telephone with Ms. Doty. .............

R 400.1903 · 1 R 400.1903 Licensee Responsibilities. (1) A licensee shall be responsible for all of the following provisions: (a) When the child care home is in operation, the licensee shall be present in the home on a daily basis and provide direct care and supervision for the majority of time children are in care, except for any of the following circumstances: (i) Vacation or personal leave, which must not exceed 20 days within a calendar year. The 20 days of vacation or personal leave means the licensee is absent the entire day or at least 51% of the day when the child care home is operating. A licensee may have a short periodic absence from the home.
On 2/17/2023, I completed an unannounced on-site inspection. I informed licensee Erin Doty of the allegations. Ms. Doty said she transports her granddaughter to school then returns directly to the child care home every morning. Ms. Doty said she is away from the child care home less than a half hour total to transport her granddaughter to school. Ms. Doty is very active in her church and participates in many activities. Ms. Doty said if there are six or less children at the home, she will leave about 30 minutes before the child care home closes to attend church functions on occasion. The only other times Ms. Doty leaves the home during child care hours is if she has medical appointments. Ms. Doty said she believes she is present in the child care home at least 95% of the time children are in care even 4 considering the times she is away from the child care home she described. Ms. Doty said all of the child care parents were notified she will be absent from the child care home briefly every morning to take her granddaughter to school. If Ms. Doty leaves early for a church function or has a medical appointment, Ms. Doty notifies parents via the Brightwheel application she uses to communicate with parents. If she goes away for vacation, she closes the child care home. Ms. Doty showed me her Brightwheel application and provided examples of her communication with all child care parents where she informed them of her daily transportation to take her daughter to school and various occasions she left the child care home a little early. I interviewed CCSM 1 and CCSM 2. They both said Ms. Doty is present in the home more than 51 % of the time children are in care. They said all the parents are aware Ms. Doty leaves the house briefly every morning to take her granddaughter to school. If Ms. Doty leaves the child care home early to attend a church function, Ms. Doty notifies parents via the Brightwheel application. CCSM 1 said some parents have said they don't always check the messages on Brightwheel, but Ms. Doty always sends messages to all parents if she leaves to go to a church function or to a medical appointment. Ms. Doty typically leaves the child care home about 30 minutes early to attend a church function if there are six or less children present. CCSM 1 and CCSM 2 said Ms. Doty closes the child care home if she takes a vacation. CCSM 1 and CCSM 2 said since Ms. Doty resides in one half of the home and provides child care in the other half of the home, there are times when parents come to pick up children and the might not see Ms. Doty because she is doing something in the other side of the home. On 5/12/2023, I spoke to Child A's Mother by telephone. Child A's Mother said Ms. Doty is "never" at the home when Child A is dropped off in the morning. Child A's Mother said Ms. Doty would often close the child care home on short notice due to medical issues or being short staffed and unable to meet ratio. Child A's Mother said she does not recall getting notification from Ms. Doty that Ms. Doty would be transporting her granddaughter to school every morning. Child A's Mother said she was aware Ms. Doty cares for her granddaughter, but she did not know about the transportation. Child A's Mother said she does not recall getting any type of notifications from Ms. Doty regarding her absences for church functions some evenings. On 5/16/2023, I reviewed Ms. Doty's 3 previous renewal inspection reports. All the renewal inspection reports indicated Ms. Doty was present during the unannounced on-site inspections. On 5/18/2023, I spoke to Ms. Doty's previous child care licensing consultant, Samantha Struppa by telephone. Ms. Struppa said she only completed one interim inspection with Ms. Doty. Ms. Struppa confirmed the interim inspection she 5 completed on 5/3/2022 was unannounced and Ms. Doty was present when Ms. Struppa arrived at the child care home. On 2/17/2023, I completed an unannounced on-site inspection. informed licensee Erin Doty of the allegations. Ms. Doty said there have been a few times where parents have unexpectedly arrived early to drop off their children while only CCSM 3 was present. Ms. Doty said on these occasions the parent arrived during the time Ms. Doty was away from the home taking her granddaughter to school. Ms. Doty said she schedules her CCSMs according to the times parents arrange drop off and pick up times. Ms. Doty spoke to the parent who was dropping their children off early and explained the importance of sticking with the scheduled drop off times so the child care home will meet the required 1:6 personnel to child ratio at all times. Ms. Doty said CCSM 3 is no longer employed at the child care home. Ms. Doty instructed CCSM 1 and CCSM 2 to ask parents to wait until an additional CCSM arrives if a parent's early arrival will cause the home to be out of ratio. During my on-site inspection, I observed there to be eight children present with three CCSMs. This to meet the required 1:6 personnel to child ratio. Ms. Doty showed me her Brightwheel application she uses to communicate with parents, she pulled up the previous two weeks of both child and CCSM attendance records. I found the attendance records to indicate the child care home was within the required 1:6 personnel to child ratio. I interviewed CCSM 1 and CCSM 2. CCSM 1 said she and CCSM 3 used to work together in the morning every day. CCSM 1 said she has "never" been left alone at the child care center with more than six children. CCSM 1 is comfortable asking parents who arrive early to stay at the child care home until Ms. Doty returns from dropping her granddaughter off from school or until CCSM3 arrives for her shift. CCSM 1 said none of the parents seem to mind when she asked them to stay. CCSM 1 said she has also remained late after her shift ends if parents are late to pick up their children. CCSM 1 said she has never left the child care home out of ratio. CCSM 2 said she works the afternoon shift. CCSM 2 said when she arrives at the child care home at 3:00p.m. there are usually eight children with two child care staff members present. CCSM 2 said she has been present with CCSM 1 or CCSM 3, who sometimes stay late after their shift was supposed to end to make sure the required ratio is maintained. 7 On 5/12/2023 I spoke to Child A's Mother by telephone. Child A's Mother said has observed one CCSM present at the child care home with more than six children on multiple occasions all hours of the day. Child A's Mother could not identify specific dates. She said she believes the child care home is out of ratio every day, at all times. I asked Child A's Mother if she believes it is possible a second CCSM was in another area of the home when she is at the child care home. Child A's Mother said that based on the number of cars that are in the driveway, she does not believe that to be the situation. On 5/16/2023 I completed an unannounced on-site inspection at the child care home. I found there to be nine child care children present with two CCSMs. That is more than enough CCSMs to meet the required 1:6 personnel to child ratio. On 5/26/2023 I spoke to Child C's Mother by telephone. Child C's Mother said there are usually two or three CCSMs present in the home. Child C's Mother said if there are only a few children left at the end of the day, then a CCSM might go home early.
R 400.1910 · R 400.1910 1 Ratio of personnel to children. (1) The ratio of personnel to children present in the home at any 1 time must be not less than 1 member of the personnel to 6 children. The ratio must include all children in care who are not related to any personnel and any of the following children who are less than 6 years of age: (a) Children of the licensee. (b) Children of a child care staff member or child care assistant. (c) Children related to any member of the household by blood, marriage, or adoption.
Ms. Doty disclosed that the child care home has not meet the required 1:6 personnel to child ratio on a few occasions when parents arrived early to drop off their children causing the child care home to be over ratio.
