On 03/24/2023, I spoke with the complainant. On 03/24/2023, I spoke with Child A's Father. He said there were two incidents regarding Child A using the bathroom. The first incident was "pretty small", he was using the bathroom and covered his hands in his feces. An incident report from the child care was provided and Child A's Father will email both reports associated with each incident. He is unsure what date this incident occurred. The second incident, which occurred on 03/13/2023, Child A's Mother was called to come pick up Child A because when he was using the bathroom, Child A smeared feces over the stall walls, floors and toilets and had toilet paper in his mouth. When Child A's Mother arrived, Ms. Simmons was present along with another child care staff member, unknown name. Child A's Mother cleaned up the mess and took Child A home. Child A's Father said child care staff members did not provide an explanation of how this could have happened, but he is concerned that Child A was left unattended in the bathroom long enough to play in his feces without intervention. On 03/24/2023, I received an email from Child A's Father with letters from six child care staff members, including Ms. Simmons and CCSM 2, writing their concerns with Child A. Concerns range from Child A having frequent bowel movement accidents to having difficulties following directions and saying comments that are unkind to child care staff members. One letter, written by CCSM 6, explained a situation when Child A had a bowel movement accident and when taken to the bathroom, he began playing with his feces and trying to wipe it on his hands and legs. CCSM 6 wrote she helped Child A clean up with wipes, but he thought it was funny to touch different things with feces on his hands and tried to touch CCSM 6 with them. CCSM 6 was able to clean Child A with wipes. On 03/27/2023, I received an email from Child A's Father. An incident note was attached to the email from the center. The note stated on 03/13/2023 at 12:30PM Child A put wet paper towel in his mouth after he was told to stop and he had a bowel movement accident and played in it, putting his feces on the wall, stall wall and his hands. A second incident note was also included. This note stated on 02/13/2023 at 1:40PM, during nap time, Child A had a bowel movement accident and child care staff members asked him to sit on the toilet until someone could clean him up, while waiting Child A yelled loudly, waking up sleeping children. On 03/30/2023, I made an unannounced visit to the center. Rebekah Simmons, program director and licensee designee was interviewed. She explained to be part of the preschool program, all children need to be potty trained, which was explained to Child A's Mother and Father. They said Child A is still working on having bowel 3 movements in the toilet, but he is doing well. However, he has been having bowel movement accidents almost daily. Child care staff members would clean and make sure he was taken care of. There was an incident with Child A on 03/13/2023, CCSM 2 came out of the classroom and said Child A had a bowel movement accident and was playing in it, so CCSM 5 called Child A's Mother. Ms. Simmons was not present in the room when the incident occurred, but when she arrived in the classroom, CCSM 2, CCSM 3, CCSM 4 and CCSM 5 were present in the classroom. CCSM 5 was in the bathroom with Child A and CCSM 4 was with Child A prior to this. Child A's Mother arrived and cleaned up Child A along with the walls and toilets. She was not expected to clean the bathroom stalls, but she did and child care staff members sanitized the space. The bathroom is located directly in the preschool classroom and has two stalls. I interviewed CCSM 1. She said on 03/13/2023 after lunch, children use the bathroom and wash their hands before they get settled in for nap time. Child A was told to go use the bathroom when he finished eating and CCSM 1 followed him into the bathroom. Child A then "shoved

On 03/24/2023 1 spoke with Child A's Father. He said he received written documentation from the CCSM 2 in the preschool classroom stating that she cannot take care of Child A because she has only one child care staff member with 28 children in this classroom. When Child A's Father is in the classroom, most of the time there is one child care staff member, but sometimes there are two. When he drops off, there is usually only one child care staff member in the classroom. The number of children he has observed varies, but he said there have been over 10 children with one child care staff member, "but I don't have a firm count". He does not have a specific day or time frame of when the classroom operates out of ratio. He has no other information about this. On 03/27/2023, I received an email from Child A's Father. A letter from CCSM 2 written to Child A's Mother and Father was attached. In the letter, she expressed her concerns for Child A's behavior and stated she uses the tools she can, to help Child A during challenging moments but she has 27 other children to teach. CCSM 2 does not say in this letter that she is specifically left alone with 28 children, but that she has 28 other children to focus on as well and cannot provide one-on-one care to Child A. On 03/30/2023, I made an unannounced visit to the center. Ms. Simmons was interviewed. She said she has no concerns that the preschool classroom is or has been operating out of ratio and does not know why someone would have a concern with this. The age group in this classroom is between 3 years and 5 years of age and this classroom operates a 1:10 ratio. Depending on the day, if there are 20 children, then there are two child care staff members, if there are more than 20 children present, then there are 3 child care staff members. She said there has never been a time the preschool classroom did not operate in a 1:10 ratio. The first child care staff member is scheduled to arrive at 6:30AM and the second one arrives at 7:30AM. Usually the preschool room will have approximately 10 children around 8:00AM and then there is a third child care staff member who arrives at 8:00AM. Sometimes during drop off's, it can seem chaotic as there are a lot of moving pieces during this time. There have not been any complaints that the preschool classroom is out of ratio by a child care staff member or by a parent. Ms. Simmons provided a schedule and time cards for the child care staff members as well as the preschool classroom attendance sheet. I interviewed CCSM 1. She said she works in the preschool classroom and the ratio is 1:10. She said there have been a couple of times that she has had 12-13 children by herself, but this is usually when another child care staff member is stepping out of the classroom to use the bathroom, which was for approximately two to three minutes. She does not recall a date for this. She said she usually comes in the classroom at 7:50AM and Ms. Simmons is usually the classroom opener. She said she has never seen Ms. Simmons with more than 10 children when she arrives. She said there was a time that CCSM 6 was in the classroom and CCSM 1 believes she was alone with 12 children, she is unsure how long she was alone with 12 children. She does not recall a date that this happened. She said she believes this has happened before but does not recall any dates and said this was not a frequent occurrence. Currently, when she arrives at the center there are only five to six children in the preschool classroom. She said no one has ever told her they were left alone with 20 children and no parents have complained to her that she had too many children. I interviewed CCSM 2. She said she works in the preschool classroom and the ratio in the is 1:10 and children are between the ages of 3-5 years old. On 03/24/2023, I spoke with Child A's Father. He said Child A came home one day and said CCSM 1 held down his legs with her legs at nap time. He has an incident report that states CCSM 2 had to physically assist Child A with staying on his mat during nap time. Child A's Father recently had a meeting with CCSM 2, Ms. Simmons and CCSM 4. When asked about the incident report, CCSM 2 explained she said she sat next to Child A to keep him on his mat but didn't say how she kept him on his mat. He said he had explained multiple times that the prior program he attended allowed Child A to have a choice of if he wants to nap or not, he does nap at home but because he enjoys cuddles with his parents beforehand. At first, he was told Child A must nap per licensing rules, but then was told Child A can do quiet activities on his mat. Child A's Father wrote an email to Ms. Simmons on 2/28/2023 regarding what Child A disclosed and he will forward the email. Ms. Simmons replied and said CCSM 1 denied doing this. Child A has never mentioned this happening previously and did not have any marks or bruises as a result. On 03/27/2023, I received an email from Child A's Father. Attached was an incident report. The incident report was dated 3/15/2023 with a time range of 12:30PM- 2:30PM. The incident report said during nap time, Child A was yelling, running around the classroom and attempted to leave the classroom. Under actions taken, it stated CCSM 2 had to help Child A stay on his mat and be respectful to the other children who were sleeping. On 3/30/2023, I made an unannounced visit to the center and interviewed Ms. Simmons. She said she received an email from Child A's Father about Child A disclosing that CCSM 1 holds his legs down during nap time. She received the email rj at approximately 5:30PM on 2/28/2023. The next day, 03/01/2023 she spoke with CCSM 1 about the email and if she uses her legs to hold down Child A's legs. CCSM 1 said she did not do this, and she does not hold any child down during nap time. Ms. Simmons did not speak with any other child care staff members about this. Ms. Simmons said she has observed CCSM 1 during nap time, CCSM 1 usually sits by a child and rubs/pats their backs. She has never observed CCSM 1 to hold down a child or be aggressive with them in any manner. Ms. Simmons explained Child A either needed a nap and would fall asleep right away, or he would appear to be tired, but become disruptive and a child care staff member would have to sit with him. There were many times Ms. Simmons was helping the preschool classroom during nap time and would often rub Child A's back, to which he would fall asleep. She would spend approximately five minutes rubbing his back and he would be asleep. She said there are some non-nappers in the classroom who read stories, but she does not have details about this. She has no concerns with the preschool classroom during nap time. I interviewed CCSM 1. She said Ms. Simmons asked if she has ever used her legs to hold Child A down on his mat. CCSM 1 said she has put her legs next to Child A because he was kicking the wall, but she has never put her legs on top of his body. She said if Child A lets her, she rubs his back, but stops if he pushes her hands away. Child A would nap when he settled down but would also become disruptive on the days he does not nap. Child A typically goes with Ms. Simmons if he doesn't want to nap to help calm him down. When Child A would return to the classroom, he was offered quiet choices like books. Child care staff members have children try to lay down for rest time for approximately 30 minutes, afterwards they are offered quiet activities such as books, pop its, coloring choices, etc. Most of the children in the preschool classroom do nap. CCSM 1 has never seen any child care staff member force any child to lay on their mat. She has no concerns for the preschool classroom during nap time. I Interviewed CCSM 2. Rebekah Simmons, program director and licensee designee, reported that a child care child was without supervision while on center property. Ms. Simmons stated that Child A was dropped off by Child A's Father's Girlfriend. She is the person that usually brings him to child care. Child A's Father's Girlfriend did not sign Child A into the center or take him to his classroom. None of the child care staff members knew that Child A was in attendance. Ms. Simmons stated that Child A's Father's Girlfriend rarely signs in Child A. She has been asked in the past to please remember to sign him in. I observed the sign in sheet which is located just inside the main door. Ms. Simmons said she has talked with Child A's Father and informed him that it is child care policy that children are signed in and shown to their room. His father agreed that he would always be signed in and taken to his room in the future. Kyle Arends, child care staff member, stated on July 22, 2022, Child B's Father dropped Child B off at his room. He informed Mr. Arends that a child was outside, 2 near the door. Child B's Father then went out the door and returned within a few minutes with Child A. Mr. Arends said he asked Child A if "mom" dropped him off that morning. Child A refers to his father's girlfriend as "mom". Child A acknowledged that she had brought him to child care. Mr. Arends found Child A's backpack just inside the main door, near the sign in sheet. Mr. Arends informed me that he did not see Child A's Father's Girlfriend or Child A when he was brought to the center. The classroom has large windows that open to the lobby. Child A's Father's Girlfriend could have waved or knocked on the window if she was in a hurry. But it is believed she did not step all the way into the lobby. Logan Halliwill, child care staff member, did not see Child A dropped off at the center on July 22, 2022. Mr. Halliwill stated he was working in Child A's classroom and "mom" did not come into the room or bring Child A to the room. She did not interact with any child care staff member. While at the center, I observed the video feed from July 22, 2022, covering the time Child A was brought to the center. Child A's Father's Girlfriend is seen pulling into the lot and leaning into the back seat of her car. Then she stood up and Child A exited the car. They walked up to the door and entered together. The time on the video feed showed 33 seconds in between the time they entered the child care and when Child A's Father's Girlfriend exited the building. Child A exited the building 29 seconds after that, running towards the parking lot. Child A's Father's Girlfriend was already in her car. Her car was parked facing the sidewalk where Child A was running towards her. The video feed showed Child A's Father's Girlfriend backing out and leaving the parking lot. Child A just stood for a couple seconds and then walked back to the child care door. The door unlocks with a code. Child A did not know the code and just stayed near the door. When Child B's Father came up to the door, Child A tried to hide in a bush. But he did come out when Child B's Father came back out of the building and invited him inside. The time between Child A exiting the building and him entering with Child B's Father was 42 minutes and 21 second. I observed the lobby and the location of Child A's classroom. If Child A's Father's Girlfriend opened the door for him and sat his backpack inside the door, which is where it was located, it would be difficult for child care staff members to see them. During my interview with Child B's Father, he described seeing Child A hiding in the bushes by the child care door. He said to him "Hey buddy, whats up? [Child A] said something about his mom, but I could not understand him". I took him inside to Kyle Arends. Kyle stated that he did not know Child A was at the center. On March 27, 2022, I spoke to the Complainant. The Complainant stated on March 23, 2022, scratches were observed on Child A's back, "the scratches looked like he had been dragged on the carpet." The Complainant attempted to take pictures of the scratches the following day, but the scratches were healed, and were not taken. The Complainant also stated that relatives saw the scratches on Child A on March 22, 2022, but did not mention it, as the relatives thought the Complainant observed them. The Complainant stated that Child A did not receive the scratches at home and assumed that Child A sustained the scratches at the child care center and did not receive an incident report. On March 28, 2022, I completed an unannounced on-site inspection at the child care center. When I arrived at the child care center, I asked to speak with program director, Rebekah Simmons. I was told by child care staff member Kyle Arends that she was on vacation for the week and would return on April 4, 2022. I individually interviewed child care staff members, Kyle Arends, Rebecca Livingston, Saige Petermann and lead child care staff member Samantha Allen. Kyle Arens stated that he helps out in classrooms as a child care staff member when needed. He previously worked in the classroom as a child care staff member for five years but now primarily works in the office and is completing classes to become the assistant program director. He stated that he was not aware of Child A or any other child sustaining scratches the week of March 21, 2022. The policy is to provide incident reports to parents of minor accidents, injuries, or incidents, which would include visible scratches, marks, and biting. The lead child care staff members and director review and sign the form. If the director is out for the day the form is signed by another lead child care staff member. The incident report is given to the parent and a copy is kept on file at the child care center. Mr. Arens provided me a copy of the policy. He also provided copies of the incidents reports for Child A's room for the month of March. The only incidents for the week of March 21, 2022, were biting incidents. There were no reported scratching incidents for Child A. Rebecca Livingston stated that she occasionally works as a child care staff member in classrooms when needed but she primarily works in the office. She stated that she was not aware of Child A, or any other child sustaining scratches the week of March 21, 2022. She stated that child care staff members fill out the incident report and turn them into the office to be signed by the director. The incident report is given to the parent and a copy is kept on file at the center. Lead child care staff member Samantha Allen stated that she did not observe Child A to have any scratches the week of March 21, 2022. The incidents in the room the week of March 21, 2022, were biting. The policy is to provide incident reports for 3 injuries, scratching, bites, and rashes. The incident report is also signed by the director and given to the parent. A copy is also kept on file at the center. Ms. Allen stated that she sometimes reaches out to parents on Facebook to notify them in addition to filling out the incident report if she will be gone before they arrive to pick their child up. Child care staff member Saige Petermann stated that she did not observe Child A to have scratches the week of March 21, 2022. The only incidents in the room during the week of March 21, 2022, were biting. The policy is to provide incident reports for injuries, marks, scratches, and bites. She stated that she did not observe Child A to have scratches the week of March 21, 2022. On March 27, 2022, I spoke to the Complainant. The Complainant stated that Child A had frequent diaper rashes. The diaper rashes cleared up on the weekends and reoccurred during the week while Child A attended child care. The Complainant stated that the diaper rashes reoccurred due to the child care center not frequently checking his diaper. The child care center provided a written daily record of Child A's elimination patterns and frequency. On March 28, 2022, I completed an unannounced on-site inspection at the child care center. I individually interviewed child care staff members, Kyle Arends, Rebecca Livingston, Saige Petermann and lead child care staff member Samantha Allen. Ms. Livingston, Ms. Allen, and Ms. Petermann never observed Child A to have a diaper rash. They stated that diapers are checked frequently every 30 minutes to one hour. Diapers are checked every 30 minutes for the children that are potty training. Diapers are also checked between transition times. Child care staff members have never been observed to leave a child in a soiled or wet diaper and diapers are immediately changed if soiled or wet. Written daily records are completed noting times that diapers are checked and indicating if wet or dry. The records are sent home daily with parents. Mr. Arens stated that he does not work in the infant or toddler classrooms. He works in the classrooms with older children and does not complete diaper changes. On 09103/2020, I completed an unscheduled on-site inspection. I first spoke with Ms. Rebekah Simmons, program director/licensee designee. She said on Thursday 08/20/2020, she received a telephone call from Child A's Mother around 7:00p.m. Child A's Mother said Child A was picked up from child care around 5:30 p.m., and was provided With an incident report indicating Child A had a mark on her from throwing a tantrum. Later that evening she noticed on Child A's Mother was concerned because she felt as if the incident report and explanation she received did not match the on Child A's and she wanted clarification of the incident. Child A's Mother also texted Ms. Simmons pictures of the - Ms. Simmons sent me a copy of the two pictures she received from Child A's Mother. The first picture showed The second oicture show 3 Ms. Simmons did not work on 08/20/2020 or 08/21/2020, so on Monday, 08/24/2020, Ms. Simmons spoke with the staff regarding the incident. She first reviewed the incident report dated 08/20/2020. The report was completed by Ms. Ashley Alden, child care staff member. According to the incident report. Child A became upset during art and began wiping paint in her eyes. Child A was asked to stop because the paint would hurt her eyes. As Child A was being cleaned up, she was "throwing a fit," on the floor. Ms. Simmons said Ms. Ashley Alden, Ms. Kaitlynn Franklin and Ms. Saige Petermann were the child care staff members working in the classroom at the time of the incident. Ms. Simmons said the center does not have cameras. When Ms. Simmons spoke with Ms. Alden, who said the children were doing "messy painting," Child A rubbed her eyes and got some paint in her eyes. Child A became upset and was trying to rub her eyes again. Ms. Alden took Child A over to tile area where Ms. Franklin was cleaning up the children. Child A was "throwing a fit" on the floor. Ms. Alden had to hold Child A's wrists while Ms. Franklin cleaned and wiped Child A's eyes and hands. Ms. Alden noticed the mark on Child A's when she was putting Child A's shirt on. Ms. Simmons contacted Child A's Father to tell him what Ms. Alden told her. Child A's Father told Ms. Simmons the on Child A's looked more like fingernail - to him and then stated, "I don't think you can convince me they're not." Ms. Simmons said based on the story told to her by the caregivers, she believes the - was caused by the broken molding piece on the floor. Child A is no longer enrolled at the center. I then spoke with Ms. Ashley Alden. She has been working at the center- years as the lead caregiver in the toddler classroom. On 08/20/2020, the day of incident, the children were doing an art project with "messy paint," which included bird seed and oatmeal for texture. The children wear "paint shirts," and not their own shirts when they paint. Ms. Alden said while painting Child A got paint in her eye and became very upset. A small amount of bird seed was very close to Child A's eye. Ms. Alden told Child A not to rub her eyes because the paint would hurt her eyes. Child A was still very upset, so Ms. Alden picked Child A up out of the chair and walked her old to the tile area where Ms. Franklin was cleaning the children. Child A was still very upset and "threw" herself to floor and started "flaring her body." Ms. Alden then held Child A by her wrists to prevent Child A from getting paint her eyes, while Ms. Franklin began cleaning the paint off Child A's hands and face, Child A continued to flare her body. Ms. Alden attempted several times to talk to Child A and calm her down. After a "couple of minutes," Child A calmed down, so Ms. Alden took Child A into the changing area to take off the paint shirt. When Ms. Alden removed Child A's paint shirt, she noticed a "mark" on Child A's _ I showed Ms. Alden the pictures that were taken of Child A's _ Ms. Alden pointed to the first picture with and stated, "this is the mark I saw; these other_ were not on her body when I changed her shirt."
