    R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.

    On 09122/2021 licensee Ashley Smith submitted an incident report to her licensing consultant, Stephanie Shell, outlining an incident of inappropriate contact between two children at her home that occurred on 9/20/2021. The incident report stated that during nap time Child B was sleeping and Child A got 2 up to use the bathroom around 1.30pm. Child A then went back into the room to lay down with a book, Ms. Smith stated she went into the room around 1:45 pm to check on the sleeping children and noticed that Child A was still reading a book but had moved cot closer to Child B's nap € ot. Ms. Smith stated she helped Child A move nap cot back to its original spot and explained that other children were sleeping so needed to be respectful of that space. Ms. Smith outlined in the incident report tha she re-entered the room 10-15 minutes later and observed Child B laying face down on nap cot whining. Child B's pants were pulled down and Child A was sifting on op of Child B. Ms. Smith included that Child A She stated that Chil still had all his clothing on and jumped off when she walked into the room. The incident report stated that when Ms. Smith spoke to both children following the incident Child A admitted to pulling down Child B's pants. On 1010612021 l completed an unannounced onsite inspection at Ms. Smith's home. Ms. Smith stated she has spoken to both parents regarding the incident, and they did not have any concerns with the way the situation was handled. Ms. Smith was asked if she was aware of Child A exhibiting these types of behaviors prior to this incident and she denied every witnessing this type of behavior or being told about Child A acting out in this way before. I observed the bedroom where Child A and Child B were placed in during nap time. The room was located right off the living room and about four feet from the dining room table where Ms. Smith stated she was sitting during nap time. Ms. Smith stated that the door is usually left open during nap time and was left open on 9/20/2021. She stated she was sifting at the dining room table, homeschooling one of her children, when she heard commotion in the bedroom. She identified that she got up and checked on the children and immediately stopped the inappropriate contact between Child A and Child B. On 10/2512021 l spoke to Child A's Mother by phone. She stated that she spoke to Ms. Smith about the incident. She denied that Child A has ever exhibited these types of behaviors before, and this was a one time thing. She identified that Ms. Smith is great with communication, and she has no concerns regarding her care. On 1012512021 1 spoke to Child B's Mother by phone. Child B's Mother was aware of the incident. She stated that Ms. Smith handled it appropriately and she did not have any concerns regarding Ms. Smith's supervision. She stated that Ms. Smith is good with communication and has a great relationship with the children.
