    Marilyn Hayford does leave the home allowing Child Care Staff Member 1 to care for children alone. There have been occasions that CCSM 1 was caring for more than 6 children when Marilyn Hayford returned to the home. I

    R 400.1913 · R 400.1913 Discipline; child handling. (2) Developmentally appropriate positive methods of discipline that encourage self-control, self-direction, self-esteem, and cooperation must be used.

    Upon receipt of the allegations on 08/18/2021. and I made contact with one another and then made a telephone call to Ms. Hayford's child care staff member April Morrison. Ms. Morrison advised that she has been working for Ms. Hayford off and on for about She left recently due to concerns regarding Ms. Hayford and physical discipline. Ms. Morrison spoke about a few incidents where she was aware that Child A had been physically disciplined. Near the beginning of August, around the 3rd, Child A pushed Child B, causing him to hit his head "really hard" on a stack of cots. Ms. Morrison said it scared her so she spanked Child A, hitting her "twice" on the buttocks. She said, "I wasn't thinking at the time". After she spanked Child A, Ms. Hayford took Child A into the bathroom and spanked her again, for the same incident. Later, Ms. Morrison overheard Ms. Hayford telling Child A's Guardian that they had both spanked Child A and that she had spanked her with a brush. Ms. Morrison stated that Child A's Guardian had given her verbal permission to spank Child A but she had specifically said that Ms. Hayford could not spank Child A. Ms. Morrison believed she was given permission because of her close relationship with the family. She believed that Ms. Hayford was not given permission because of an incident that happened with Child A and Ms. Hayford's hearing aids. Ms. Morrison did not know any details of the matter. There was another incident, sometime around August 16, where Ms. Hayford threw a spatula at Child A, causing her to cry. Ms. Morrison witnessed the incident. She said Child A was in a highchair in the kitchen while Ms. Hayford was preparing peanut butter and jelly sandwiches. Ms. Hayford was spreading peanut butter with a spatula and the spatula broke. Child A asked what happened and Ms. Hayford said the spatula broke. Child A repeated, questioning "the spatula broke?" and Ms. Hayford then proceeded to throw the spatula at Child A, hitting her in the neck. Child A cried. Ms. Morrison asked Ms. Hayford why she threw the spatula and Ms. Hayford would not respond. Ms. Morrison said she saw a "little red line" where the spatula hit. At pick up time the day of the spatula incident, Child A's Uncle arrived to pick her up. When Child A saw him, she told him that Ms. Hayford threw a spatula at her. He asked Ms. Morrison if Child A was telling the truth and Ms. Morrison said yes. 3 Ms. Morrison said that when she was on vacation, the week of July 4th, she heard that Ms. Hayford pushed Child A. Child A's Uncle was present at the time and some type of altercation ensued. Child A's Uncle has not been allowed in the house since. When asked if any other children were spanked, Ms. Morrison said that Child B has been spanked. Child B's Father gave permission for Child B to be spanked. She estimated that she has spanked Child B "one or two times" and Ms. Hayford has spanked Child B `two or three times" to her knowledge. Ms. Morrison denied knowledge of any other children being spanked in Ms. Hayford's child care home. She denied that any marks or bruises had ever resulted from the spankings. On 08119,2021 On 08/16/2021 On 08/20/2021 and I conducted an unscheduled on-site inspection. We interviewed Ms. Hayford regarding the allegations, questioned Ms. Hayford about specific incidents in chronological order. After interviewing Ms. Hayford regarding the above incidents, I spoke with her specifically regarding licensing rules. I asked her if she was aware that physical discipline of any kind, such is spanking or swatting, was against the rules and asked her if she was aware of that. She said she was aware. I asked why she used physical discipline, knowing it was against the rules and she said, "I guess I just got 6 upset". She said that Child A "'has always been a little wild" and that "she's getting worse". Ms. Hayford denied using physical discipline with Child A in any way, at any other time, other than in the incidents mentioned above. She deni

    I had email correspondence with Child Care Licensing Consultant Amy Steger on 3/22/2021. Ms. Steger informed me that she did not receive notification of Child A's injury from Marilyn Hayford. ~During the onsite inspection Ms. Hayford informed me that she found out Child A his_on 3/19/2021. She did not report the injury to her licensing consultant. Ms. Hayford knew the incident was reported to "the state" by Child A, Child B and Child C's Guardian and was just waiting for her licensing consultant to come to her house to discuss the details. She agreed to complete an incident report and email it to me. Marilyn Hayford emailed me a copy of the incident report on 3/23/2021.
