(b) Be able to ensure that services and facilities are conducive to the welfare of children. (c) Act in a manner that is conducive to the welfare of children. (d) Demonstrate a willingness and ability to comply with the act and these rules.

On January 7. 2022. 1 interviewed cniltl A'S Mother was mtorrneo by Crystail Lutes, n January 5, 2022, thatMHHM 1 disclosed, that asked Child A to touch A forensic interview is scheduled for today for Chi A. Child A remains at the child care facility. 3 On January 13, 2022, 1 completed an unannounced onsite inspection with Child care children were not in attendance on January 13, 2022. We interviewed Adisyn Lutes. Ms. Lutes reported that there was an incident between Child A and MHHM 1. Ms. Lutes observed Child A and MHHM 1 walk out of the bathroom together. Both said that MHHM 1 was helping Child A with. pants. Ms. Lutes told her mother, Crystal) Lutes about the incident and both children were questioned by Crystall Lutes separately. Ms. Lutes was unable to identify when this occurred, but it was after the incident between MHHM 1 and MHHM 2. MHHM 1 was not supposed to be alone with children because there was an incident between MHHM 1 and MHHM 2 in October or November of 2021. MHHM 1 was aware he was not supposed to be alone with other children. Ms. Lutes does not have any concerns with MHHM 1 being alone with child care children. No child care children have reported to Ms. Lutes that MHHM 1 had inappropriate contact with them. On January 13, 2022, 1 interviewed Crystal) Lutes with . In October of 2021 MHHM 1 had an incident of inappropriate contact with MHHM 2. Crystall Lutes was unsure of the date, but it was in October of 2021. AHHM heard MHHM 2 making a sound and went to check on MHHM 2 per Crystal) Lutes has a developmental disability. observed MHHM 1 on top of MHHM 2 and MHHM 1 was thrusting■ pelvis back and forth on top MHHM 2's leg. MHHM 1 was taken for a mental health evaluation following the incident. Irystall Lutes~an made the decision to keep MHHM 1 separated from and supervised with other children including child care children. No one told them this had to occur. Crystall Lutes was not aware of the requirement to report mental health services for household members to the department. Monday or Tuesday of the week following the incident between MHHM 1 and MHHM 2, came into the bedroom where Crystal) Lutes was folding laundry and reported that MHHM I and Child 4 A came out of the bathroom together. did not see anything occur between MHHM 1 and Child A. Crystal( Lutes was not in the same area of the house as MHHM 1 and Child A and indicated Ms. Lutes and were suj" be supervising Child A and MHHM 1. She w i droom folding laundry. was cooking at the stove in the kitchen and was in the garape. The stove faces away from the bathroom that Child A was utilizing. During cookinç. would have his back to the bathroom entry door and Crystall Lutes is not aware if he heard anything going on in the bathroom with Child A and MHHM 1. MHHM 1 was in the family room before the incident. MHHM 1 got in trouble for being in the bathroom with Child and had his electronic privileges removed for a week.
