On 04/23/2021, I spoke with Program Director and Licensee Designee, Eustolia Chapa, who was reporting the incident. Ms. Chapa was not present, nor did she witness any of the events. Ms. Chapa stated that the information was provided to her by child care staff member, Laura Woodard. Ms. Chapa then submitted an incident report as required. The incident report indicated that on 04/22/2021 during lunch time child care staff member, Belinda Evans, took Child A's lunchbox, threw it across the room and stated that she was done with the lunch box and done with him. Other children tried to pick up the lunch box, but Ms. Evans told the students not to and that Child A will pick it up when she tells him to get up and do it. There was then a second incident on 04/22/2021 as the children were getting ready for nap time. Child B was on his cot and playing with a dust pan. A loud noise was heard by child care staff member, Laura Woodard, and when she looked the dust pan was on the floor. It was reported to Ms. Chapa that Ms. Woodard asked Child B if he threw the dust pan. Ms. Evans spoke up and said "no I did and I threw a lunch bag earlier." Ms. Evans then stated that she was going to lunch and walked out the room. On 4/23/2020, I privately spoke by telephone with Child A's Mother. She reported that she has not had any concerns nor have any incidences been reported to her. Child A has also not come home reporting any incidences occurring while at the center. I explained to her that there was an incident reported regarding his lunch box being thrown across the room. Child A's Mother indicted that Child A did not say anything to her about it. She reported that Child A likes going to the center and 3 wants to stay there instead of going to Kindergarten because he likes his teachers and his friends. Child A's Mother gave me permission to interview him. I explained that I would follow back up with her after I speak with him. On 4/23/2021, I privately spoke by telephone with Child B and C's Mother. She stated that Child B and C have been attending the center since September 2020 and they love it. She did not have concerns and indicated that no incidences have been reported to her by the center. She stated that both children came home and said they had to go to the office, but she could not really get out of them why. Child B said something about a lunch bag being thrown, but that it was not his. He did not say who threw it or what happened after that. She gave permission for me to interview Child B and C. I explained that I would follow back up with her after I speak with them. On 04/26/2021, I completed an unannounced on-site inspection. I arrived at the center at 10:00 AM and privately spoke with child care staff members, Laura Woodward, Constance Miller, Eustolia Chapa, and Pam Vollen about the incident involving Ms. Evans and Child A and Child B that occurred on 04/22/2021. Ms. Woodward stated that she was present in the room for both incidences. The first incident occurred at lunch time. Ms. Woodward was in front of the room and Ms. Evans was toward the back. They were eating when Ms. Woodward heard Ms. Evans say "I asked you 5 times to stop playing with that, I am done with this and done with you." When Ms. Woodward looked up, she saw the lunchbox on the floor. Ms. Woodward did not see Ms. Evans throw it. Ms. Evans was saying that statement to Child A. Child A just continued to sit at his seat and put his hands in his lap. Ms. Woodward was not sure who picked up his lunch box. Nobody said anything else after that happened and that it was "crickets in the room". The class then transitioned to nap time and the children were using the rest room and getting their cots ready. Ms. Woodward stated that she came back in the classroom after using the rest room and noticed that Child B was on his cot and was holding a dusk pan that hangs on the wall near his cot.
