On 06/04/2024, the center provided appropriate care and supervision of Child A although he was injured while at the center. Child A did not cry or complain about the injury. CCSMs notice a small change in Child A’s behavior and attempted to assess the problem.

On 01/31/2023, I received an email containing an audio recording that a parent touring Tutor Time observed a child care staff member roughly interacting with a child. After listening to the recording, I contacted the complainant. The gentleman on the telephone was an interested parent who was trying to enroll his child in Tutor Time. He said on Friday 01/27/2023, while he and his wife were waiting to sign paperwork, they saw an adult male roughly handle a child. The adult has been identified as child care staff member, (CCSM 1), He said he and his wife were extremely upset by seeing this. They decided to enroll their child in a different child care facility. On 02/01/2023, I conducted an unannounced inspection. I interviewed Assistant Director, Brittney Burke. Ms. Brittney said on 01/27/2023, the interested parents had a meeting with her to enroll their child because they had been on the waiting list. Ms. Brittney remembers the parents being upset because they had many questions and wanted help completing the paperwork. Ms. Brittney said she was trying to accommodate them as best as she could, as well as try to complete the daily operations of the center. Ms. Brittney said she has not seen CCSM 1 be inappropriately aggressive with any of the children. I interviewed STEM Director, Cynthia Dunbar. She said she received a phone call from District Director, Jennifer Gundersen stating that a complaint came in stating some interested parents saw a CCSM mishandle a child. Ms. Jennifer told Ms. Cynthia that she would view the camera to investigate the allegation. I asked Ms. Cynthia if she had ever witnessed CCSM 1 be aggressive with children. She said she has worked with CCSM 1 on many occasions and has never seen him do anything inappropriate to children. I interviewed CCSM 2. She said she has worked with CCSM 1 for about 1 year. She said she has never seen CCSM 1 be aggressive or forceful with children. She said she worked with him on 01/27/2023, the day of the incident, and he was very disheartened and frustrated because he of the type of day Child A was having. CCSM 2 said she was in and out of the room on that day because she was assisting in other rooms or where she was needed. CCSM 1 was called out of the room by the directors and CCSM 2 went in the classroom to relieve him. When she arrived, Child A was sitting on CCSM 1's lap. CCSM 1 was gone about 10 minutes. When CCSM 1 returned, CCSM 2 left to assist in another room. On 02/02/2023, I contacted Jennifer Gunderson. She said she viewed the video and did not see anything inappropriate on the video from CCSM 1. I requested that I view the video. Ms. Jennifer said she would contact me when I could come and view the video. On 02/02/2023, I contacted Child A's Mother. She said her son and CCSM 1 don't get along and as a result, she randomly checks the cameras so that she can see 4 their interactions. She said on 01/27/2023, she decided to view the camera at naptime. She said when it came on, she saw CCSM 1 holding her son. He had his arm over him, across the width of his chest while he was laying on the cot. She said she didn't understand why he was trying to make her son lay down because there were other children up walking around. She said after watching it for about 10 minutes, she drove to the center. She saw the STEM Director, Ms. Cynthia. She asked her if they could chat for a moment? At that time, CCSM 2 came out in the lobby and Child A's Mother asked CCSM 2 to please go and see where Child A was. Child A's Mother told Ms. Cynthia what she saw on the video. CCSM 2 brought Child A out into the lobby. When Child A's Mother saw Child A, she asked him what was going on in the room with him and CCSM 1. Child A told his mother that he wanted to get a puzzle and a book. Child A's Mother had the opportunity to speak with CCSM 1 and asked him what was going on with him and Child A because she had seen the video of him insisting Child A lay down. On 02/08/2023, I received new allegations. It was reported that on 02/14/2023, a parent counted 10 children and 2 CCSMs in a room where the ratio was 1:4. On 02/15/2023, I conducted an unannounced onsite inspection and interviewed Director Jennifer Gundersen and center director, Jordyn Phifer. I counted the staff to children ratio in each classroom. All classrooms were in ratio. I told Ms. Jordyn that I received a complaint that on 02/14/2023, it was reported that there were 10 children and only 2 child care staff members. When asked if the center was out of ratio on 02/14/2023, Ms. Jordyn answered, "yes, the center was out of ratio in the "Two's" Classroom." In reviewing the attendance records during that time, the center was also out of ratio on 02/08/2023.The Two's Classroom is for toddlers who are 2 — 2 1/2 years old. There should have been 3 child care staff members with 10 children.

On 11/30/22 and I completed an on-site inspection at Tutor Time. I spoke with Jordan Phifer program, director regarding the allegations. The entire center was observed, and each classroom I observed was within the required ratios. In the infant 1 room, there were four infants, ages 6 weeks to 6 months, with one child care staff member (CCSM). In the infant 2 room, there were four infants, ages 6 months to 12 months, with one CCSM. In the toddler 1 room, there were five children, ages 12 to 18 months, with two CCSMs. In the toddler 2 room, there were eight children, ages 18 to 24 months, with two CCSMs. In the twos room, there were five children, ages 2 years old, with two CCSMs. In the early preschool, there were nine children, ages 2 to 3 years, with two CCSMs. In the preschool room, '/2 there were 13 children, ages 3 to 4 years, with two CCSMs. In the pre-k room, there were seven children, ages 4 to 5 years with one CCSM. Six additional pre-k children were participating in electives, in the school-age class, with one CCSM. According to Ms. Phifer, the eight rooms at the center are rarely out of ratio. They had a parent complained months ago about one of the room's ratios, but there has not been any recent concern. Ms. Phifer and the office staff keep track of the children enrolled and their weekly schedules. They schedule CCSMs according to the children's schedules and the center is fully staffed. In each room, the CCSMs track the children by completing the face-to-name sheets throughout the day. When the children enter a room, the CCSMs add them to the face-to-name sheet with the time. A child is crossed off the sheet when they leave the classroom or if they are bumped to another room. The center is monitored on a camera system. She stated if a room is out of ratio, it is not for long. They work to adjust the schedule, to ensure all rooms are covered. On 11/30/2022, I interviewed the complainant. Concerns about ratio have been discussed with administration, but nothing has changed. On 11/29/2022, there was nine children with two CCSMs, in a classroom with a 1 to 4 ratio. There was also an issue with ratio before Thanksgiving. The children's parents have notice there is a ratio issue at the center. The center is regularly run out of ratio. On 01/12/23 I spoke to CCSM 1, Child A's (17-month-old, female)'s Mother, Child B's (20-month-old, male) Mother, and Child C's (31-month-old, male) Mother regarding the allegations. According to CCSM 1, she works with children ages, 12 months to 18 months at the center. The classroom is always in ratio of four children per CCSM. There are eight children enrolled in the room and the number of children varies depending on the day. If the CCSMs need to go to the bathroom or staff need a break they have other CCSMs come in and provide coverage. There are no concerns at the center regarding ratio. According to Child A's Mother, Child A is in the toddler 2 room. The ratio is four children per CCCSM. She stated that she has not seen any issues regarding ratio. 3 The room is in ratio at drop off and at pick up. They are updated daily of the care that is provided to Child A and the center provides amazing care. Child B's Mother stated that Child B is in the infant 1 room. She has no concerns regarding ratio. There are usually three or four CCSMs in the room at a time. At most, she has seen six children with two CCSMs. The center is doing well, and she has no concerns. Child C's Mother stated that Child C is in the twos class. She stated occasionally at drop off, she has seen five children with one CCSM. She was unsure when another CCSM arrives, but believed they comes in later in the day. During pick-up, Child C is moved to the early preschool room because they combined the rooms. There is one CCSM with approximately eight children which is concerning to her due to Child C's age. She stated the ratio in the twos room is four children to one CCSM.
