    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    An anonymous complaint was received on 06/28/2022. According to the complaint, CCSM, Stephanie Marshall was eating food from a local convenience store. She fed some of the food to Child A. Later in the day, the food had made Ms. Marshall's stomach upset and she threw up the food. Ms. Marshall was bragging and laughing about feeding Child A some of her food to two of her co- workers. A CCSM told Ariana Fuller, program director, about the incident but no 2 action was been taken. Lack of action from management is a common issue at this facility. On 06/29/2022, I completed an unannounced onsite inspection at The Goddard School. I spoke to Ms. Fuller, and CCSMs, Ms. Marshall, Gensis Ponce, and Jodi Reed. The infant room was observed. There were seven infants, ages 6 weeks to 12 months, with two CCSMs. Parent handbook, attendance record and child information cards were provided for review. Ms. Fuller stated that on 06/29/2022 many of the CCSMs at the child care center was moved to new rooms. Several of the CCSM were upset because they were moved. Ms. Fuller stated a couple of the CCSM were complaining about their new co-workers. On 06/27/2022, Ms. Fuller was told about Ms. Marshall feeding Child A from CCSM, Paige Smith. Ms. Fuller stated there was non-stop confusion with the room changes, she was unsure what to believe. Ms. Fuller stated that she was unable to prove the concern as there are no cameras at the center. Ms. Fuller stated that she talked to Ms. Marshall, but she did not ask her specifically if she fed Child A some of her food. On 06/24/2022, Ms. Marshall informed Ms. Fuller that she had gotten sick from eating a burrito. She had only taken a bite out of it and stated that she was going to return it to the store where she purchased it. According to Ms. Fuller, the parents of the infants provide their child's food and snack each day. Child A is currently in the Cousteau (ages 6 weeks to 12 months). Ms. Marshall is a new CCSM in the Robinson room. However, last week she was working in the Cousteau room with Child A. Ms. Marshall stated that she purchased a breakfast burrito from the local convenience store on 06/24/2022. She was eating her burrito while feeding Child A. Ms. Marshall stated that she is the only CCSM that can get Child A to eat his food. Child A's food is provided daily by Child A's Mother. Child A does not eat solid foods. He eats puree food, apple sauce, yogurt, grits and teething crackers. Ms. Marshall tricks Child A with the bait and switch to get Child A to eat. On 06/24/2022, she was using a piece of sausage from her breakfast burrito as bait then she switched to his puree. Ms. Marshall stated that she uses his food for bait. Ms. Marshall stated that she had just started to get Child A to eat when she realized that the ham on her burrito was green and molded. She stated that she said, "Oh my God this burrito is moldy. I am going to throw up and I'm feeding Child A." Ms. Marshall stated that she did not feed Child A any of the burrito. The other CCSMs must misunderstood her, she was just stating that she was feeding Child A while eating. Ms. Marshall denied bragging about the incident and stated that she told three other CCSMs (Ms. Fuller, Ms. Ponce and Ms. Smith) about what occurred. Ms. Marshall stated that the burrito did not make her sick but the thought of her eating it made her sick. Ms. Ponce is the lead CCSM in the Cousteau room. Child A is in the Cousteau room and Ms. Marshall was his primary caregiver. She was responsible for feeding, changing and documenting Child A's daily interactions. Ms. Ponce said she was in the room when the burrito incident occurred last week. The incident occurred 3 around lunch time at 11 a.m. Ms. Marshall was feeding Child A and she opened her burrito and started eating. Ms. Ponce heard Ms. Marshall say, Aww... like something had happened. She asked what happened and Ms. Marshall stated, "Oh my God, I gave it to Child A". Ms. Ponce asked her if she was serious, and

    R 400.8155 · R 400.8155 Child accidents and incidents; child and staff illness. (5) A center shall have a written policy detailing when children, staff, and volunteers will be excluded from the center due to illness.

    On 05/20/2022, a complaint was received with the allegations that Ariana Fuller and Child A tested positive for Covid-19 and have been seen throughout the building (kitchen, hallways and classrooms) without a mask. On 05/24/2022, I spoke with Ms. Ariana Fuller, program director and Kristen Gerhard, assistant program director. Ms. Fuller stated that she or Child A have not tested positive for COVID-19. They have not been exposed to COVID-19. Child A is currently enrolled in the Jemison classroom and there have not been any positive COVID-19 cases in the classroom. Elizabeth Sauter, Child Care Staff 2 Member, and Kirtidaben Bhavar, Child Care Staff Member have never reported that they have tested positive or been exposed to COVID-19. Ms. Fuller explained that CCSM1 was hospitalized in May 2022, however it was not COVID related. On 05/19/2022, there were three CCSMs that call off work. None of the staff reported that they were calling off due to testing positive or being exposed to COVID-19. Ms. Fuller stated that on 05/19/2022, she did not tell Kristen Gerhard, assistant program director that she had COVID-19 and was working, and she could not understand why her employees were calling off work with COVID-19. I spoke with Kristen Gerhard and she stated that Ms. Fuller did not tell her that she had COVID- 19. She did not have a conversation with Ms. Fuller regarding staff calling off work because they were positive for COVID 19 on 05/19/2022. According to Ms. Fuller, she follows the sick policy from the employee handbook. When an employee calls off work for two or more consecutive days the director may require the employee to provide a return to work note from their doctor. On 05/25/2022, I received a copy of the employee handbook, the COVID-19 action plan, and the email that was sent to the parents regarding the changes to the COVID-19 procedures. I reviewed the sick policy in the employee handbook. There was a statement that documented the information that Ms. Fuller stated above. I reviewed the COVID- 19 action plan from 11/17/2020. The guidelines for procedure and expectations for employees and children who are returning to work and care were outlined in this section of the COVID-19 action plan. Employees and children must be fever free for 72 hours before returning to the child care center for work or care. If a staff member or child exhibits multiple symptoms of COVID-19, suspects possible exposure or individual tests positive for COVID-19, the individual must stay home until the following occurs: other symptoms have improved and at least 10 days have passed since their symptom first appeared. I reviewed the email that was sent to the parents on 03/18/2022. The email outlined the COVID procedure changes. The parents were informed that due to the mask mandate being lifted effective 03/28/2022 masks would be optional at the child care center.

    On 04/27/2022, I completed an onsite inspection. The center was closed when I arrived. I called Ms. Fuller, Program Director. She said the infants are placed on their backs when they are in the crib. Ms. Fuller explained that some of the children can turn themselves over once they are placed on their backs. Ms. Fuller reported that on 04/22/2022 Angela Flis, Child Care Staff Member (CCSM) told her that there were infants sleeping on their back. Ms. Fuller immediately spoke with Genesis Ponce-Sanchez, CCSM and Sadie Simmons, CCSM. Both child care staff members explained that the children were placed on their backs, and they rolled over on their own. On 05/02/2022, I spoke with Ms. Flis. She is a floater at the child care center. She stated that on 04/22/2022, she was covering in the infant room for a few hours during the morning because one of the child care staff members was running late. Ms. Flis observed one of the infant child care staff members putting an infant to sleep on their stomach. When the child care staff member left the room, Ms. Flis put the child to sleep. Ms. Flis spoke with Ms. Fuller regarding what she observed in the infant classroom. She said she has not worked in the infant room since the day she floated on 04/22/2022. Ms. Flis said she could not recall which CCSM was in the room on this day or which infant was involved in the incident. On 05/03/2022, I received a written statement from the Witness. The statement indicated that an infant was placed on their belly in a crib and patted to sleep. Another teacher in the room said this happens often and one of the infants uses a blanket. The Witness stated that other child care staff members have witnessed the infants being placed on their stomach in the crib. The witness was unable to provide the names of the infants observed. On 05/06/2022, I completed an onsite inspection. I spoke with Ms. Fuller and Ms. Kristen Gerhard, Assistant Program Director. They both stated that they never observed any child care staff member place a child on their stomach in the crib. They have never witnessed any toys or blankets in the crib with infants. During the onsite, there was one infant and one child care member in the classroom. The infant was not in the crib. There were no blankets in the cribs during the onsite inspection. Ms. Fuller stated that there are two child care staff members that work in the infant room, Genesis Ponce-Sanchez and Sadie Simmons. She explained that there are floaters that also work in the infant classroom. All of the infant classroom child care staff members are aware that children in the infant classroom must be placed on their backs to sleep. The staff received training on Child Care Educational Institute and MI Registry during orientation. Ms. Fuller has never observed any child care staff member in the infant room placing children on their stomachs to sleep. She checks in the classroom throughout the day. According to Ms. Fuller she has never received any complaints from parents 4 regarding children being placed to sleep on their stomach. Parents are not allowed in the infant classroom due to COVID-19. I spoke with Genesis Ponce- Sanchez, CCSM, Sadie Simmons, CCSM, and Jodie Reed, CCSM. They all stated that children are placed on their backs in their own crib. They never lay the infants on their stomachs. Blankets or toys are not allowed in the cribs and are never allowed to be draped over the cribs. Ms. Ponce-Sanchez explained that there are times when she may lay an infant on his or her stomach and pat them to sleep. However, she does not leave the infant sleeping on their stomach, as she will roll them over to their back after they have fallen asleep. Some infants can roll on their stomachs by themselves, however, if they roll to their stomach, she will place the child on their back. If the child wakes up during their nap, she will pat them softly on their belly until they fall back asleep.

(a) Infants and toddlers, birth until 30 months of age. The child care staff member to child ratio is 1 to 4, the maximum group size is 12.

    On 02/24/2022, I spoke with the complainant. The complainant stated that Kaitlyn Davis, Child Care Staff Member placed Child A on the cot with force. Child A's Mother witnessed Ms. Davis forcing Child A onto the cot. It is reported that Child A was screaming. The complainant stated that Kristen Gerhard, Assistant Program Director allegedly showed Ms. Davis the technique. According to the complainant, the incident was reported to Carl Pittner, Licensee. It is reported that Mr. Pittner stated that the technique was okay to use. The technique requires the CCSMs to put one arm across the child's body and use the other hand to pat the child's back. On 02/28/2022, I completed an unannounced inspection. I spoke with Arianna Fuller, Program Director. She stated that Mr. Pittner received a text message from Child A's Mother regarding the allegations. According to Ms. Fuller, Kaitlyn Davis never said she used force to place Child A on the cot or that she applied pressure. Ms. Kaitlyn Davis stated that Child A does not sleep, Kristen Gerhard suggested that she try using the hand-arm pat technique. Arianna Fuller stated children who do not sleep have the option of having quiet time i.e. (books, quiet time, and music). Ms. Fuller stated the hand-arm technique is an approved technique used by the center. It helps to soothe children and assist them in falling asleep. Child A could also come to the front office with Ms. Fuller to rest on a cot during nap time or have quiet time. I spoke with Mr. Pittner, Licensee he stated that he received the text message from Child A's Mother regarding the allegations and forwarded the information to Ms. Fuller to address. On 02/28/2022, I spoke with Kristin Gerhard. She stated that they had been working with Child A at naptime. She stated that the CCSMs would hold her while she napped so that she would not cry. Kristin Gerhard stated that she spoke with Kaitlyn Davis regarding cot training, the child would lay on their tummy, the child care staff member would place their hand on the child's upper back and the other hand would be used to pat the child's back. She stated that there is no force used and the technique does work to help the children to fall asleep. On 02/28/2022, I spoke with Kaitlyn Davis, CCSM. She stated that Adrienne Vial, CCSM works with her in the classroom. On 02/16/2022, all the children in the classroom were asleep except Child A. Child A cries daily at nap time. Child A has been provided with quiet time, where she is allowed to sit quietly with an activity, however, it does not work. Child A will continue to cry. It was suggested by Ms. Gerhard that Ms. Davis try using the pat on the back technique. She had never utilized the technique with any other children. Ms. Davis said she tried the technique twice and no force was used at all. She said she reached out to Child A's Mother and explained to her that it was recommended that she try the technique. She texted her that she wanted to clarify that she was not putting any pressure on Child A or the cot. She told Child A's Mother that she would 3 stop using the technique if she was uncomfortable with it. I reviewed a copy of the text messages between Child A's Mother and Ms. Davis. I interviewed Tamara Mayes, CCSM, she explained that she was not aware of Child A being placed forcefully on a cot during nap time. She stated that if she has a restless child who is having a difficult time sleeping, she will pat them on their back, and they will go to sleep. She will also allow the children to lay on their cot and have quiet time with a book, soft toy, or doll if the child is having a difficult time falling asleep. On 03/01/2022, I spoke with Child A's Mother. She is a former CCSM at the center. She stated that she is no longer employed at the childcare center. She explained that on 02/16/2022, she went to Child A's classroom and Child A was crying and screaming. She observed Kaitlyn Davis leaning over Child A on the cot. She asked Ms. Davis t
