    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times. ........................... .............

    On 7/27/2023, I interviewed the complainant over the telephone. She stated Child A had disclosed to his foster parents that Child B had touched him in his privates. He in turned slammed Child B to the ground and kicked him. Child A's Guardians were not notified of this incident by the center. On 7/31/2023, I conducted an inspection at the center. I interviewed the program director Victoria Crandall. She was not present when this incident happened and only know what the CCSMs told her. When asked why this incident was not reported to the department, she stated she did not know she was supposed to report it. She also did not know the parents and/or guardians needed to be contacted right way. Ms. Crandall stated CCSM1 was monitoring the children at lunch and saw Child A "take down Child B". CCSM 1 reported the incident to CCSM2. Child A's Guardians met with Ms. Crandall and they made a verbal plan that Child A and Child B would be in separate groups. Child A told his Guardian they were still playing together. Ms Crandall stated the boys were friends and they were constantly being redirected to stay away from each other especially during before and after care. Neither boys are currently attending the center. Child A's Guardian removed him from the program on 7/24/2023. Child B's last day was 7/26/2023. I interviewed CCSM2. She stated she was told by CCSM1 that Child A and Child B were playing. Child B touched Child A's private part while playing. Child A pushed Child B off of him and told CCSM1 Child B touched him. CCSM2 stated it was not 3 intentional. CCSM talked with Child A and Child B and they both stated it was an accident. Child A and Child B were separated during the afternoon on site field trip but later on they were playing together. CCSM2 did not contact the parents or write an incident report, On 8/1/2023, I interviewed CCSM1 by telephone. She stated Child A and Child B were at the picnic table eating lunch. She was at the next table and saw Child A slam Child B to the ground and kick him. She asked what happened and Child A stated Child B touched his private parts. Child B initially stated it was an accident, then said "if Child A said I did it on purpose, then I did it on purpose." CCSM1 stated she was not surprised something like this happened, Child B disregards the rule about keeping his hands to himself, however no one else had ever accused Child B of touching them. She stated Child A and Child B were friends and always played together. Even later that day they were playing together. CCSM1 stated she did not fill out an incident report or talk to Child A's Guardian or Child B's Father. On 8/10/2023, I interviewed Child A's Guardian by telephone. Child A told her Child B reached over and grabbed his private part on purpose. He then pulled Child B down and started kicking him. Child B said it was an accident. This incident happened on Friday, 7/21/2023. Child A's Guardian stated it took all weekend for him to tell her what happened. She stated she was most upset that the center never contacted her about Child A being touched or about him kicking Child B. She met with the program director, Ms. Crandall the following Monday 7/24/2023. They made a verbal agreement where the boys would be separated but the agreement was not being followed so she removed Child A from the center. I made several attempts to contact Child B's Father. He has not returned any of my phone calls. Child B is no longer attending the center. Ms. Crandall stated she believes the family is on vacation out of the country.
