    R 400.8125 · .............. R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 05/31/2023, the department received an incident report from program director, Robin Brown. The incident report indicated that three children exposed themselves to each other, as well as touched each other. The incident took place under the picnic table and on the buddy bench on the playground. On 06/05/2023, I completed an unannounced inspection at the facility. I was unable to interviewed any child care staff members (CCSM) because the After-School Program was closed for the summer. CCSM1 was interviewed on 6/07/2023 via telephone. He stated that he was aware that Child A (8 year-old, Female), Child B (8 year-old, Male)and Child C (8 year-old, Male) were friends and that they often played together outside. He had never seen, nor had he been informed of any inappropriate activity while outside. They playground is open and wraps around the building. There is a picnic table for sitting, where the children would hang out. He walks around while outside and sometimes 2 he has to take children inside the building to use the bathroom or for other reasons. There are about an average of 30-35 children with 3 staff members while outside. He denied having any knowledge of the inappropriate activity or noticing anything inappropriate with the three children identified. On 6/7/2023 I called Child A's Mother. She said that Child A informed her that while they are outside during latchkey time, she and Child B and Child C would go near the picnic tables and touch each other and look at each other's private areas. She said that it happened about 8 times so far. Child A also informed her that it was mostly Child B that would be exposing himself to her. The timeframe was between March and May of 2023. On 6/7/2023 I called Child B's Mother. She was informed of the incident by the school principal. Child B reported that he and Child A had gone under the picnic table about 5-6 times. While they were under the picnic table, they would touch each other and look at each other's private. He said Child C was also present, but he did not want to do it anymore, so he stopped. Child C's Mother was called on 6/7/2023, and 6/14/2023 and 7/13/2023. The number listed is a non-working number. The customer could not take any calls at the time, and I could not leave a message. This was the only number on file with the center for Child C's Mother. On 06/7/2023, I spoke to Ms. Robin Brown, the program director who self-reported the incident. She was made aware of the incident after the principal stated that he received an email from a parent. She is investigating the matter and has relocated CCSM1 to a different location. She stated that the picnic table is in plain sight and it is not secluded. She is aware that it was a lack of supervision on behalf of the child care staff members. On 6/14/2023 I called and interviewed CCSM 2. She said that she sits at the table all the time. Her legs can barely fit underneath the table so she is confused how the children could fit under the table. She also works at another center twice a week, on Tuesday and Thursday's. The incidents didn't happen on her watch because she is always watching the children. The three of them (CCSMs) will take children inside the building as needed, but she denied ever seeing any inappropriate contact with children at any time. CCSM 3 was called on 6/7/2023, and 6/14/2023, and 7/13/2023. Messages were left requesting a return call. I was not able to make face-to face-contact with the involved CCSM, due to the end of the school year and program closing. 3
